On 6 January 2011, the above subject was referred to the Committee on Laws,
Ordinances and Legal Matters and the Committee on Rural and Urban Development for
review and recommendation. Thus, after careful review of the same, together with all the
documents attached thereto, these Joint Committees have the honor to report before this
August Body the following:
1. That, the above request for authority is anchored on Section 465(b)(1)(vi) of the
Local Government Code of 199, which grants power to the Provincial Governor to
“Represent the province in all its business transactions and sign in its behalf all bonds,
contracts, and obligations, and such other documents upon authority of the
sangguniang panlalawigan or pursuant to law or ordinance”.
2. That, the site of the Oriental Mindoro Chest Clinic and Dispensary, originally belongs
to the Provincial Government of Oriental Mindoro, but was awarded to the former
by virtue of a Deed of Donation. The building was, however, constructed out of
Countrywide Development Fund (CDF) of then Representative Renato Leviste.
3. That, the Oriental Mindoro Chest Clinic and Dispensary, located at Camilmil,
Calapan City, Oriental Mindoro, which is a semi-government entity being controlled,
operated, and supervised by the Philippine Tuberculosis Society, Inc. was officially
closed and its services were terminated sometime in February 2004 because of
financial difficulties to run and maintain its operations.
4. That, the official closure of the Oriental Mindoro Chest Clinic and Dispensary would
mean that the usage of the said building and the site is no longer needed by the
Philippine Tuberculosis Society, Inc. in their operation at the Province of Oriental
Mindoro.
5. That, the Provincial Government of Oriental Mindoro is in need of spaces, sites and
buildings for its effective operation.
6. That, the Philippine Tuberculosis Society, Inc. formally expresses its intention to turn
over the absolute ownership of lot described as Lot 24-A of subdivision plan PSD50857 covered by TCT No. T-6603 with an area of 5,229 square meters and building
of the Oriental Mindoro Chest Clinic and Dispensary in favor of the Provincial
Government of Oriental Mindoro.
7. That, on 5 April 2010, the Sangguniang Panlalawigan passed Resolution No. 832-2010
entitled “Resolution authorizing Honorable Arnan C. Panaligan to enter into a
Memorandum of Agreement and Deed of Donation with the Philippine Tuberculosis
Society, Inc. (PTSI) regarding the turnover of the ownership of land and building of
the defunct Oriental Mindoro Chest Clinic Dispensary, located at Barangay
Camilmil, Calapan City”. However, the MOA and Deed of Donation were not
executed between the PGOM and PTSI until the end of the term of former Gov.
Arnan C. Panaligan in June 2010. Hence, there is a need to pass a new resolution
authorizing Gov. Alfonso V. Umali, Jr., to enter into a Memorandum of Agreement
and Deed of Donation with the Philippine Tuberculosis Society, Inc. (PTSI).

8. That, Atty. Kristine Grace L. Suarez, Provincial Legal Officer issued a Certificate of
Legal Sufficiency dated 03 December 2010 stating that the Memorandum of
Agreement (MOA) and the Deed of Donation both for execution by and between
the Philippine Tuberculosis Society, Inc. (PTSI), represented by Ms. Zenaida Quezon
Avancena, PTSI President, and the Provincial Government of Oriental Mindoro
(PGOM), represented by Hon. Alfonso V. Umali, Jr., Provincial Governor, relative to
the turnover of the ownership of land and building of the defunct Oriental Mindoro
Chest Clinic and Dispensary (OMCCD) located at Brgy. Camilmil, Calapan City,
Oriental Mindoro, to the PGOM, were reviewed by the Provincial Legal Office and
were found to be in conformity with the law, public order and public policy.
Recommendations:
Based on the foregoing premises, these joint committees respectfully recommend to
this August Body to pass and approve a RESOLUTION AUTHORIZING HON. ALFONSO V.
UMALI, JR., PROVINCIAL GOVERNOR, TO ENTER INTO A MEMORANDUM OF AGREEMENT
AND A DEED OF DONATION WITH THE PHILIPPINE TUBERCULOSIS SOCIETY, INC., RELATIVE TO
THE TURNOVER OF THE OWNERSHIP OF LAND AND BUILDING OF THE DEFUNCT ORIENTAL
MINDORO CHEST CLINIC AND DISPENSARY (OMCCD) LOCATED AT BARANGAY CAMILMIL,
CALAPAN CITY, ORIENTAL MINDORO TO THE PROVINCIAL GOVERNMENT OF ORIENTAL

CREATING THE PUERTO GALERA DANGEROUS DRUGS ADMINISTRATIVE

For review and recommendation of the Committee on Peace and Order,
Unification and Reconciliation and Committee on Laws, Ordinances and Legal Matters is
the above subject which was referred on 16 December 2010. After careful review of the
subject ordinance, these Joint Committees have the honor to report before this Honorable
Body the following:
1. That, the subject ordinance was passed on 01 December 2010 during the Regular
Session of the Sangguniang Bayan of the said municipality.
2. That, said ordinance was unanimously enacted by all the Members of the
Sangguniang Bayan present during the said Regular Session.
3. That, the said ordinance was enacted for the purpose of creating the Puerto Galera
Dangerous Drugs Administrative Board.
4. That, its enactment was primarily for the creation of an administrative board who
will be responsible for the following duties:
a. Receive complaints for the abatement of drug related public nuisances.
b. Conduct hearings in connection with the foregoing sub-section;
c. Declare the place or premises in question as drug related public nuisance if the
circumstances so warrant;
d. Abate drug related public nuisances.

5. That, Sections 52 and 53 which were mentioned as basis for the enactment of the
said municipal ordinance as embodied under Sections 4 and 5 of the said
ordinance were in accordance with Republic Act 9165, otherwise known as The
Comprehensive Dangerous Drugs Act of 2002.
6. That, the passage of the subject ordinance is founded on Section 16 (General
Welfare Clause) of the Local Government Code of 1991 which grants power to the
Sangguniang Bayan to “Exercise the powers expressly granted, those necessarily
implied therefrom, as well as powers necessary, appropriate, or incidental for its
efficient and effective governance, and those which are essential to the promotion
of the general welfare. Within their respective territorial jurisdictions, local
government units shall x x x promote health and safety of their inhabitants”.
7. That the subject ordinance is within the scope of prescribed powers of the
Sangguniang Bayan of the Municipality of Puerto Galera to enact and the same is
not in contravention with any existing policies, guidelines, rules and regulations
prescribed/set by laws. However, compliance on existing relevant laws, rules and
regulations shall be the responsibility of the LGU in the implementation of the Code.
Recommendation:
Above premises considered, these Joint Committees respectfully recommends to
this Honorable Body to pass and approve a RESOLUTION APPROVING MUNICIPAL
ORDINANCE NO. 37, SERIES OF 2010 ENTITLED “AN ORDINANCE CREATING THE PUERTO
GALERA DANGEROUS DRUG ADMINISTRATIVE BOARD” subject to compliance with the
findings of these Joint Committees, as stated under Item No. 7 of this Joint Committee
Report.

On 3 February 2011, the subject request for accreditation of cooperative was
referred to the Committee on Cooperatives, POs and NGOs of the Sangguniang
Panlalawigan of Oriental Mindoro. The said request was forwarded to the Office of the
Provincial Planning and Development (PPDO) for evaluation and validation of the
documents submitted. On February 8, 2011, an indorsement coming from the Provincial
Planning and Development Office, signed by Mrs. Noime V. Baldos, was received by the
office of the Sangguniang Panlalawigan.
After thorough review and evaluation of the subject matter, this committee has the
honor to report before this Honorable Body the following:
1. That, the 2nd indorsement dated 08 February 2011 signed by Mrs. Noemi V.
Baldos, OIC-PPDO, bears recommendation for accreditation of the SAMAHANG
KABABAIHAN NG STA. RITA of Sta. Rita, Pinamalayan, Oriental Mindoro, is a
legitimate Non-Government Organization registered under the Department of
Labor and Employment, with registration number 008-208 dated March 12, 2008
per documentary .
2. That, Sections 34, 35 and 36 of R.A. 7160 otherwise known as the Local
Government Code of 1991 mandate every Local Government Unit to promote
the establishment and operation of the people’s and non-government
organizations in its jurisdiction for their remarkable contributions in the effective
delivery of basic services to the people.

3. That, likewise, Section 108 of the same Code mandates the local sanggunian
concerned to accredit Non-Government Organizations (NGOs) and People’s
Organizations (POs), subject to such criteria as may be provided by law.
4. That, in accord with article 64 of the Implementing Rules and Regulations of
Republic Act No. 7160, the Department of the Interior and Local Government
(DILG) on July 17, 2007 issued a Memorandum Circular No. 2007-81 signed by
Secretary Reynaldo Puno, with subject : “Accreditation of People’s Organization,
Non-Governmental Organizations and similar Aggrupations, and Selection of
Representatives to the Local Special Bodies”, setting therein the submission of
documentary requirements (one copy each) for accreditation, to wit:
a. Letter of application;
b. Duly accomplished Application Form for Accreditation;
c. Board resolution signifying intention for accreditation for the purpose of
representation in the local special bodies;
d. Certificate of Registration;
e. List of current officers and members
f. Annual accomplishment Report; and
g. Financial Statement, at the minimum, signed by the executive officers of
the organization and indicating therein other information such as the
sources of funds.
5. That, the Samahang Kababaihan ng Sta. Rita of Pinamalayan, Oriental
Mindoro submitted to the Sangguniang Panlalawigan all the above
mentioned documentary requirements.
6. That, further, the Sangguniang Panlalawigan recognizes the important role of
the cooperatives, POs and NGOs as the province’s strong partners in the
realization of its developmental goals.
Recommendation:
Above premises considered, this Committee respectfully recommends to this
Honorable Body to grant the request of SAMAHAN NG KABABAIHAN NG STA. RITA, for the
August Body’s accreditation of the same organization. Relative thereto, this Committee
also recommends to this Honorable Body the passage of a Resolution accrediting
SAMAHAN NG KABABAIHAN NG STA. RITA, as Non-Government Organization (NGO) in the
Province of Oriental Mindoro.

profound congratulations and recognition to the Oriental Mindoro delegation for bagging

six out of seven major awards in the recently concluded MIMAROPA Regional Athletic

DRUGS ADMINISTRATIVE BOARD”
On joint motion of Hon. Romeo G. Infantado and Hon. Abraham R. Abas, jointly
seconded by Hon. Ramil O. Dimapilis, Hon. Gideon B. Abuel and Hon. Alfredo R. Viaña, be
it;
RESOLVED, to approve, as it is hereby approving Municipal Ordinance No. 2010-037
of the Municipality of Puerto Galera, entitled “An ordinance creating the Puerto Galera
Dangerous Drugs Administrative Board”, subject to the condition that compliance with
existing relevant laws, rules and regulations shall be the responsibility of the LGU in the
implementation of the Code.
RESOLVED FURTHER, that copies of this resolution be furnished the Municipal Mayor
and Sangguniang Bayan, thru its Secretary to the Sanggunian, all of the Municipality of

PROFOUND CONGRATULATIONS AND RECOGNITION TO THE ORIENTAL MINDORO
DELEGATION FOR BAGGING SIX OUT OF SEVEN MAJOR AWARDS IN THE RECENTLY
CONCLUDED MIMAROPA REGIONAL ATHLETIC ASSOCIATION MEET HELD ON FEBRUARY 1318, 2011 AT CALAPAN CITY
WHEREAS, the MIMAROPA Regional Athletic Association Meet, is an annual sports
competition for elementary and secondary students in Region IV- B and the said annual
sports competition was held on February 13-18, 2011 at Calapan City;
WHEREAS, the Oriental Mindoro Delegation maintained composure and showed
high spirits throughout the entire duration of the Regional Athletic Meet;
WHEREAS, aside from sports competition, a contest for every delegation is also at
stake.
The Oriental Mindoro Delegation was awarded Cleanest Delegation, Most
Disciplined Delegation, Best in Parade, Most Creative Presentation, Best in Uniform and 2 nd
Best in Saludo. In the over-all results of the annual Regional Meet, the province’s
delegation was declared 2nd runner-up in the Elementary Division and 3rd runner-up in the
Secondary Division;
WHEREAS, the said remarkable feat of the Oriental Mindoro Delegation mirrors the
character, perseverance, determination and commitment of the officials, trainers,

coaches and athletes representing the Province of Oriental Mindoro to the said regional
sports competition;

declared the Session adjourned at 10:15 in the afternoon after the proper motion thereto

was made by the Honorable Floor Leader Ramil O. Dimapilis.
WHEREAS, the prestigious Sangguniang Panlalawigan salutes the Oriental Mindoro
Delegation with the strong belief that the athletes from the Province of Oriental Mindoro
will do even better in the next season of the MIMAROPARAA Meet through the proper
guidance of officials, trainers and coaches;
WHEREAS, as an expression of warm appreciation and heartfelt gratefulness of the
Sangguniang Panlalawigan of Oriental Mindoro, it is necessary and appropriate to extend
profound congratulations and recognition to the Oriental Mindoro Delegation for bagging

request that copies of the same be disseminated to all concerned school officials under
the said Division.
