Minutes of Selectboard Meeting Monday, April 12, 2010 Board Present: Guests: Robert Vasseur and Ed Read Stuart Hallstrom, Al & Sally Molnar, John Williams, Marc & Jennifer Hammond, Mr. & Mrs. Haviland, Mr.Smith, Shayne Jaquith, Tom Urell, Bob Crean, Meeting called to order 6:30 p.m. 1. Ed Read (Ed) made the motion to approve the minutes from March 22, 2010. Robert Vasseur (Robert) seconded, no further discussion, all in favor, motion carried. 2. Al Molnar (Al) and others addressed the Selectboard with question and concern over the repair of Stark Mountain Road and sections along Mansfield Road. They requested four things of the Town: a. that the Town restores the headwall at the intake of their culvert to its original state, destroyed he believes while searching for the culvert itself. b. that the Town place more gravel or stone on the curve on Old Mansfield Road below Stark Mountain Road. c. that the Town place stone dams in Town ditches to slow and turn water d. that the Town fill in the washed out curve going into Stark Mountain Road. Also requested was that until the situation is corrected there is need to place orange cones on the right hand side of Mansfield Road up to the entrance of Stark Mountain. Selectboard assured him of the placement of more cones in the morning. Discussion followed including but not limited to; Past history of the Stark Mountain Road culvert, The rain event that caused the most recent washout, Possible effects of construction above this road, Change in slope of Mansfield Road, The originating direction of water that utilizes that culvert, and Who owns the culvert (Al is sure that the Town Culvert Inventory Map depicts this culvert as Town owned but Stuart notes no private road culverts are on the map). Selectboard determined that a site visit was necessary. Selectboard will contact Homeowners to participate in that site visit when it happens. Al noted that if the Town did the above the Stark Mountain homeowners would keep the culvert clean in the future and repair their road. 3. Shayne Jaquith asked the Selectboard if they would be willing to adopt interim zoning regulations to solve a timing issue. FEMA requires the update of flood plain zoning language on a regular basis and for Washington County, the deadline is May 30, 2010. If not complete, it could affect those homeowners who have flood insurance in a negative way. The Planning Commission is working on a complete re-write of the Town Plan, with some sections complete, but not the entire document. Interim zoning would include adopting all sections that are complete to date. Selectboard asked that Shayne try to get an extension from FEMA rather than adopt interim zoning. Shayne also informed the Selectboard that he is leaving Fayston in May, 2010. 4. Bob Crean (Bob) went over the Permit for Work in Public Right-Of-Way on Slide Brook Road. While the document says the road could be up to sixteen wide Bob understands that nobody wants to see two lanes and eight feet wide and that his engineer suggest that he does not widen at all but rather put in some pull offs to make it a two lane road for that amount of traffic and to remove snow. This plan would also alleviate the need for a storm water discharge permit by keeping the impervious surface area below one acre. He would cut back some brush, install culverts vs. water bars and remove a few large trees at the entrance to the road. The road foreman will approve all work. Robert noted that the permit referenced a six-lot subdivision and he believes this was no longer the case. Bob will have Sheila Getzinger change that to a four- lot subdivision (three building and one conservation). Ed made a motion to accept and Permit for Work in Public Right-Of-Way presented by Bob Crean with the above noted amended. Bob seconded, no further discussion, all in favor, motion carried. See attached. Bob will also have Sheila Getzinger complete the Quit Claim Deed (including PTTR) for an easement and the Declaration of Covenants and Restrictions and record both in the Town of Fayston Land Records. 5. Stuart reminded the Selectboard that he would be meeting with contractors on 4/14/2010 at 9a.m. at the barn across from the school in order to solicit bids for the German Flats Road culvert project. He asked if they wanted the Town to supply the gravel or have the contractors bid for that as well. Selectboard want the contractors to bid the entire project. 6. Selectboard did not appoint a CVRPC representative due to lack of candidates. Selectboard will place an ad in the Valley Reporter. 7. Annual financial plan postponed to next meeting due to error. 8. Patti Lewis instructed to submit a structures grant for the North Fayston Road culvert (by Viens) this week. 9. Selectboard discussed Carroll Road concern of Rick Avery. While it was determined that the problem lies with a Waitsfield culvert, Fayston will do some ditching up to, but not touching, that culvert. 10. Selectboard signed liquor license applications for: Weathertop Mountain Inn Snuggery, Inc. Millbrook Inn & Restaurant Spice of Life Spirits Cooperation Glenhouse Mt. Ellen Mad River Glen Ski Area 11. Selectboard signed excess weight permits for; Rice Lumber Co. Birdseye Sitework R.P. Frost, Inc (VT Well and Pump) Jerry Haskins Sr. Green Mountain Power Corporation Curtis Lumber Co., Inc. Jack C. Johnson 12. Selectboard read mail and signed orders of March 29, 2010, April 5, 2010 and 4/12/2010. 8:20pm – Ed made a motion to adjourn. Robert seconded, no further discussion, all in favor, meeting adjourned. The next Selectboard meeting will be April 26, 2010 at 6:30 p.m. at the Fayston Municipal Building.
