The Committee expressed their sympathy to Mr Freeley on his recent family bereavement. MATTERS ARISING 63/09 - EVENTS IN PARADE GARDENS 64/09 - ANN COURT AGENDA ITEMS 65/09 RECONSIDERATION OF REQUEST FOR DOCTORS’ PARKING BAYS – PATRIOTIC STREET/PLACE Previous minute 31/09 refers The Committee were advised that the food festival in Parade Gardens planned for early May was not going ahead, but a similar event was planned as part of the Fête de St Helier. Previous minute 28/09 refers The Constable said that a survey carried out by the Town Residents’ Rejuvenation Association had found that the least favoured temporary use of the site was for private parking but its use for open space and play areas would be supported. The Constable said that the future use of the site was still under review but if the outcome was for private parking he was prepared to take a proposition to the States. The Roads Committee indicated that it would like to see public (shoppers’) parking included in the temporary use. Previous minute 10/09 refers Drs King and Parris made representation following the Committee’s decision to refuse the request for 6 on street doctors parking bays for the new medical practice. They explained to the Committee that the spaces were required for on call doctors who would be on duty solely to respond to emergency calls and as time was of the essence in these cases their close proximity to the practice was essential, valuable time in responding to the call would be lost if the doctors had to park some distance away. There would generally be a minimum of 4 doctors on call at any one time and the additional 2 spaces were required for extra on call doctors and to ensure the safety of female doctors when working out of hours. They pointed out that the amalgamation of the 3 medical practices would free up 6 paycard spaces elsewhere in the town. Mr Stievenard pointed out that designated doctors spaces do not have legal standing but are usually treated with courtesy by the public. Dr King said that the practice had not been given the opportunity to purchase any parking spaces in the new development as they had only been made available to the residential properties but the practice had registered an interest should any of them come up for sale. Mr Wilding asked if they had not been able to secure any of the spaces on the ground floor of Patriotic Street car park and the doctors confirmed that this approach had been unsuccessful. Mr Blake raised the issue of patients being dropped off/picked up, the doctors acknowledged that they were also concerned about this as they expected between 300 – 400 patients attending the surgery each day and felt that cars stopping even briefly on Gloucester Street would cause traffic congestion. They hoped that Patriotic Place could be utilised as this had been closed off by Dandara during the development works and this did not appear to cause too many problems. The Committee were sympathetic to the case put forward by the doctors and, apart from Mr Jennings, voted to support the allocation of at least 4 spaces for the on call emergency doctors, but felt that a holistic review of the parking in the streets surrounding the site was necessary and Mr Stievenard agreed to carry out a review and bring the results to the next meeting. 66/09 - SCAFFOLDING DURING SUMMER EMBARGO PERIOD – MUSEUM STREET Previous minute 271/08 refers A further request was received from Jersey Arts Centre to erect scaffolding from 13 July – 12 September during the summer embargo period to carry out essential work to their heating and ventilation system. Mr Daniel Austin and Mr Steven Edwards from the Arts Centre made representations to the Committee to support the written request. The Arts Centre had been able to secure funding for the work to be carried out from Education, Sport & Culture. They felt that this was the only window in their schedule as during this period they mainly held alfresco performances and to close the centre at any other time of year would be financially unsustainable. They did not feel that the Committee’s previous comment that Museum Street was a major road in the town was justified and they felt that erection of the scaffolding would not affect tourists and visitors. They pointed out that the scheduling for productions had to take place 2 years in advance. The Committee agreed to support the erection of the scaffolding for the 9 week period and Mr Jennings asked that if possible the scaffolding should be visually enhanced. 67/09 - SCAFFOLDING DURING SUMMER EMBARGO PERIOD – WHARF STREET The Committee received a request to erect scaffolding for 4 – 6 weeks during the summer embargo period at 4 Wharf Street in order to renew the roof. It was stated that it was essential to carry out the work during the summer as the building would be open to the elements. Mr Stievenard stated that Planning permission had not yet been received for the work, the Constable then suggested that the applicant should attend the June Committee meeting to present their case. The Committee were in agreement with this suggestion and hoped that these works could be carried out in conjunction with other planned works in the proximity. 68/09 - DRUG AND ALCOHOL USE IN PARISH PARKS & CEMETERIES The Constable felt that consideration should be given to address the problems of drug and alcohol use in Parish Parks & Cemeteries following many recent complaints and the accident to a young boy who had pricked himself with a used needle. Mr Peter Goguelin and Mr Tony Andrews from the Parish Parks and Gardens Department attended the meeting and said that they were concerned about drug and alcohol use in the Parks and Cemeteries, especially at those parks that had children’s playgrounds in them. They had received reports of people being intimidated by language and behaviour and were now refusing to use them. Mr Andrews said that glass and needles were littering the parks and the public toilets were being used by drug users and needles were often found in them. He pointed out that there were health and safety issues for Parish staff. Mr John Hodge from the Shelter Trust and Rev Geoff Houghton from All Saints Church were concerned that banning drugs and alcohol from the Parish parks would just move the problem elsewhere. They were also keen to point out that users of drugs and alcohol were usually separate groups of people and each needed a different approach. Mr Hodge and Rev Houghton expressed concern about the availability of alcohol from some retail establishments at very low prices and both were concerned that the needle exchange system appeared to have broken down. They were both in favour of the employment of outreach workers and felt that this was an important resource and that additional resources of this type could possibly be funded by the Parish. The Committee were in agreement that people should feel safe and comfortable when using the Parish parks and did not want to move the problem from one location to another. Some members felt that banning alcohol in the parks was not the solution as this would affect other law abiding citizens eg people having picnics. There was some discussion whether disposal bins for needles should be provided but some members felt this might attract users to these sites. Mr MacKenzie said that a total ban on alcohol had worked in some cities ie Coventry and that in Manchester a screened off area had been effective. The Constable thanked all parties for their input and said any changes would be publicised. 69/09 - ILLEGAL ENCROACHMENT – CHARLES STREET Previous minute 04/09 refers The Committee were asked to consider the illegal encroachment onto the highway of an outward opening fire exit door in Charles Street. Although the door had received Planning permission the Committee felt that the door should be recessed further into the building and were not prepared to licence the encroachment. 70/09 - OUTWARD OPENING DOORS – LEWIS STREET The Committee were asked to consider the illegal encroachment onto the highway of a number of outward opening doors at the new Kensington Place car park development. The Committee decided that the wicket doors to the five garages on the western elevation of the building were an unacceptable encroachment and should be changed so as to either open inwards, or be set back so that when opening outwards they do so within the boundary of the site. The lobby door was felt to be particularly dangerous and it was felt that it could be restricted to an inward opening door. There was much discussion about the two doors adjacent to the projecting column however it was felt that any form of encroachment would be a potential hazard, therefore the Committee (apart from Mr Blake) agreed that these should also be adjusted so that, if they open outward, the degree of projection should be no more than between 5 and 50mm as the architect had stated was feasible. 71/09 - ALFRESCO FACILITIES –KING STREET The Committee were asked to consider an application for alfresco facilities for Coffee Republic, 45 King Street. Mr Stievenard identified that at this point the precinct in front of the site was at its narrowest over the whole length of King and Queen Street and was concerned about the effect of funnelling pedestrians into narrow spaces. The applicant had asked for a space of 1.80m out from the face of the building but the Committee agreed to approve a reduced area 1.20m wide on a trial basis for the remainder of 2009, subject to approval from adjacent businesses. 72/09 - ALFRESCO FACILITIES – LA MOTTE STREET The Committee were asked to consider an application for alfresco facilities at the S Bar on La Motte Street. The alfresco facilities would involve the shared use of an unloading bay and had already received Planning approval as part of the overall revamping of La Motte Street. It was proposed that the unloading bay would be in operation until 11.00am daily. The Committee agreed to the proposal provided that tables and chairs were not placed out until space on the unloading bay was secured to ensure pedestrian access, and that adjacent businesses were consulted by the applicant. 73/09 - ALFRESCO FACILITIES – HAVRE DES PAS The Committee were asked to consider an application for extended alfresco facilities at the Marina Hotel, Havre des Pas. An area directly in front of the hotel had last been licensed in 2001 but in addition to requesting a licence for this area the applicant requested extension of this area by approximately 4 metres to incorporate an area in front of Allix’s Shipyard. The Committee apart from Mr Pearce, Mr Blake and Mr Jennings, were supportive of the application as long as agreement for the proposals could be reached with the Procureurs of the Vingtaine de la Ville and with the stipulation that if the facility did proceed no sun umbrellas should be used on this section. 74/09 - HIGHWAY ENCROACHMENT – LE BRETON LANE Previous minute 06/09 refers The Committee were asked to reconsider the previously agreed permanent encroachment of a gutter and fascia assembly in Le Breton Lane. Upon further investigation the surveys found that the existing fascia could not be removed as originally thought due to the location of part of the structure of the building. This means that the overall projection from the building will be 430mm and as the current gutter extends to 400mm a further 30mm was not thought to be of any detrimental affect, particularly at the height if 6.858m. The Committee agreed to issue the appropriate licence under the Highways Law, 75/09 - PROPOSED IMPROVEMENTS – SEALE STREET Previous minute 32/09 refers Following the Committee’s decision to widen the footpath on both sides of Seale Street representation was received from a resident of the Street querying why the pavement on the Town Hall side should be increased more than on the residential side. It was agreed that as future additional uses of the Town Hall indicated an increased footfall to the building the wider pavement would be maintained on the Town Hall side. Mr Noble said that TTS had indicated they were not in favour of the provision of a Jersey crossing at the junction but the Committee agreed that TTS should be informed that they were strongly in favour of a Jersey crossing with a continuous footway and if necessary the Constable would take a proposition to the States to achieve this. 76/09 - OFFER OF LAND FOR ROAD IMPROVEMENT – CORNER OF VAL PLAISANT & WINCHESTER STREET The Committee were reminded that as part of an application for redevelopment of the building on the corner of Val Plaisant and Winchester Street in 2006, approval was given subject to a small triangle of land, 20 sq ft, being ceded to the Parish for road improvement. The Parish has now received a formal offer from the developer to cede that land at a nominal cost of £10 on condition that the Parish pay the legal fees for the transaction. The Committee accepted the offer of the land and this decision would now need to be ratified at a Parish Assembly. 77/09 - REMOVAL OF ONE ON STREET PARKING SPACE – RUE DE TRACHY The Committee were asked to consider representation from the proprietor of riding stables who was having a great deal of difficulty entering and exiting their premises because of on street parking in Rue de Trachy. The problem had been exacerbated since the recent closure of the top end of Old Mont Cochon. The parking space causing the problems is situated between the two access points to the riding stable and is often occupied by a high sided vehicle. The Committee agreed that the single parking space is removed, subject to the usual on site consultation notice, but consideration to be given to replacing this with motor cycle parking. First Tower Park Since the improvement of the playground facilities at First Tower Park a number of complaints have been received with regard to the adequacy of parking, the main reason why the above matter was brought before the Committee. Mr Noble suggested that a solution could be to allow restricted parking by paycard until 6.00pm on the road that bisects the park. Some members of the Committee were concerned about allowing cars into the park and also felt that traffic calming measures may be necessary. Mr Stievenard pointed out that there was another area that could be considered for parking at the bottom of the park adjacent to the Church although this would require the removal of some flowerbeds, but this would need Planning permission which would not be necessary with Mr Noble’s proposal. The Committee agreed that T & E Services should draw up some plans for both parking proposals, including a photo montage showing the visual impact to the park, and bring them back to the June Committee meeting to allow members of the public opportunity to comment. 78/09 - SCENIC LANES AWARDS 2009 The Committee were asked to nominate a lane in St Helier for this year’s awards. A number of possible nominations were discussed and Mr Stievenard pointed out that a number of them did not fit the criteria for assessment. Mr Jennings was keen to nominate an urban lane and the Committee agreed to allow Mr Jennings to nominate a lane on behalf of the Committee and he would notify Mr Stievenard in due course of his decision. PLANNING APPLICATIONS 79/09 - 15 CHEAPSIDE, ST P/2009/0180 HELIER 15 Cheapside, St Helier Change use of existing hairdressing salon to bakery and café. The Parish’s concern over traffic related issues have not been suitably addressed by the representation received. It is noted that the new bakery intends to develop its business to supply other outlets in the Island, the result of which will be the necessity for increased vehicle trips and additional loading time. The effective doubling of existing café space will likewise increase vehicular activity in the area. The Parish can therefore not support the application. The proposed refuse storage and collection arrangements are not considered satisfactory. The proposed café and bakery will generate considerably more refuse than the current unit and it is suggested that the unit cannot operate safely and satisfactorily without a large dedicated refuse store, accessed directly from the highway. This store will need to allow for future separation and recycling. 80/09 - FIELD 1278, WARWICK FARM, LA GRANDE ROUTE DE ST JEAN, ST HELIER P/2009/0656 Field 1278, Warwick Farm, La Grande Route de St Jean, St Helier Create a temporary (3 years) public green waste reception facility at the south east side of the site, widen existing access from La Grande Route de St Jean, landscape south of site and relocate poly tunnel from south to north of site. The Parish has no objection to this application. 81/09 - DE GRUCHY & CO LTD, 8 – 14 NEW STREET, ST HELIER, JE2 3TE P/2009/0885 De Gruchy & Co Ltd, 8 – 14 New Street, St Helier, JE2 3TE Demolish existing buildings. Construct new building to include basement, ground and first floor retail, with 39 No residential apartments above. To include associated roof gardens and balconies. The Parish is supportive in principle of the proposed development subject to further discussion and agreement regarding a suitable Refuse Strategy and the important aspect of serviceability of the site when it is complete. 82/09 - 2 BEAULIEU PARK, ST HELIER P/2009/0672 2 Beaulieu Park, St Helier Construct 2 storey extension to north elevation to create new dwelling. The Roads Committee has no objections to the above submission as the proposed car parking arrangement is accessed from a private road. 83/09 - HAUT DU MONT, LA RUE DE LA HAUTEUR, ST HELIER P/2009/0705 Haut du Mont, La Rue de la Hauteur, St Helier Alterations to vehicular access. The Roads Committee has examined plans for the above submission and comment as follows:Whilst the Parish support every effort to improve vehicular visibility at entrance/exits it is requested that the applicant considers moving the entrance slightly further north so that a minimum distance of 25m is achieved in both directions. 84/09 - SOMBRERO, LA ROUTE DU FORT, ST HELIER P/2009/0717 Sombrero, La Route du Fort, St Helier Convert 2 No bedsits into 1 No dwelling. The Parish has no objection to the above submission. 85/09 - 2 HAUTBOIS VILLAS, BELLOZANNE ROAD, ST HELIER P/2009/0748 2 Hautbois Villas, Bellozanne Road, St Helier Remove existing roadside wall to form 1 No parking space. Replace part of roadside wall in granite. The Roads Committee has examined plans for the above submission and gives approval provided: A condition is imposed that only one space is approved. That the parking area is surfaced with concrete or tarmacadam and all surface water generated on the area is to be disposed of within the site by soakaway or other appropriate means. The kerb and footpath must be lowered by the Parish of St Helier at the expense of the applicant. That a line of 50mm wide split blocks shall be laid flush at the junction between the private land and the rear of the public footpath for the width of the site. That everything within the visibility line is permanently kept below 900mm from footpath level. That the vehicle shall drive forward into and out of the space, and that no reversing onto the carriageway will be permitted. 86/09 - THE GARAGE, SANTA MONICA PARK, BELLOZANNE VALLEY, ST HELIER P/2009/0721 The Garage, Santa Monica Park, Bellozanne Valley, St Helier Demolish garage. Construct 1 No dwelling. The Roads Committee has examined plans for the above submission and gives approval provided:The visibility splays shown on the site plan can be maintained across the south of the site to achieve maximum height above road level of 900mm. The current plan and elevations do not appear to accommodate this and should be altered accordingly. 87/09 - COMO, LA VALLÉE DES VAUX, ST HELIER P/2009/0805 Como, La Vallée des Vaux, St Helier Demolish existing two bedroom dwelling and construct 2 No one bedroom flats. The Roads Committee has examined plans for the above submission and comment as follows:Support cannot be given for the proposal as no provision has been made for private off street car parking. There is no public on street parking in the vicinity and the construction of two units of accommodation could result in illegal parking on Vallée des Vaux at an important clearway location. The applicant has not indicated how refuse will be stored and placed for collection. 88/09 - 4B THE QUEEN’S ASSEMBLY ROOMS, BELMONT PLACE, ST HELIER RW/2009/0664 4B The Queen’s Assembly Rooms, Belmont Place, St Helier Replacement windows. The Roads Committee has examined plans for the above submission and gives approval provided:That any windows bordering the Public Road or Footpath shall be of a type whose opening lights do not open beyond the face of the building. 89/09 - JERSEY BREWERY SITE, ANN STREET, ST HELIER P/2009/0655 Jersey Brewery Site, Ann Street, St Helier Part demolish existing brewery buildings. Provide pedestrian access to car park. The Parish has no objection to the above submission. 90/09 - JOINERY WORKSHOP, JANVRIN ROAD, ST HELIER P/2009/0659 Joinery Workshop, Janvrin Road, St Helier Demolish joinery workshop. Construct 2 No dwellings. The Roads Committee has examined plans for the above submission and comment as follows:Whilst support is given for the provision of one parking space for each unit it is felt imperative that all vehicles reverse into the access lane so as to facilitate a forward motion on exiting. The Parish cannot accept vehicles reversing onto the public highway. The visibility lines shown on the plan are not dimensioned. The origination point of the vision lines can be taken 2 metres back from the kerb edge, not 2.40 metres as shown and should provide a minimum of 25 metres vision to the centre of the oncoming traffic lane. Any obstructions within this line should be removed to a height of 900mm maximum above footpath level. The drawing should also show how pedestrian visibility lines can be achieved as per the guidelines on the Transport & Technical Services document entitled ‘Roads Serving Small Housing Developments’. The applicant has not shown what facilities will be provided for the storage and collection of refuse which should be adjacent to the public highway. 91/09 - 4 WHARF STREET, ST HELIER RW/2009/0833 4 Wharf Street, St Helier Replacement windows and door. The Roads Committee has examined plans for the above submission and gives approval provided:That any windows bordering the Public Road or Footpath shall be of a type whose opening lights do not open beyond the face of the building. 92/09 - 10 – 12 ROSEVILLE STREET, ST HELIER P/2009/0883 10 – 12 Roseville Street, St Helier Construct 3 storey extension to the rear. The Roads Committee has examined plans for the above submission and gives approval provided:The applicant can include a suitable scheme for the storage and disposal of refuse to the satisfaction of the Parish Refuse Department. 93/09 - 94 HALKETT PLACE & 19 JAMES STREET, ST HELIER P/2009/0860 94 Halkett Place & 19 James Street, St Helier Demolish existing commercial and warehouse premises. Construct new building to Halkett Place comprising of ground floor offices and 4 No 2 bed and 4 No 1 bed flats on first, second and third floors. Construct 6 No 3 bed townhouses to James Street with garage parking to ground floor and rooftop amenity space. The Roads Committee has examined plans for the above submission and comment as follows:- NEXT MEETING The proposed refuse facilities, size and location are acceptable. The car parking proposals for the six town houses are acceptable, although before the Parish can give formal approval the applicant should show appropriate pedestrian and vehicular visibility lines. Concern is expressed that the four 2 bed and four 1 bed flats on the Halkett Place elevation have no off street car parking provision therefore support for these units cannot be given. No part of the building fabric, including windows, doors and foundations can encroach over the public highway. The kerb and footpath must be lowered by the Parish of St Helier at the expense of the applicant. That a line of 50mm wide split blocks shall be laid flush at the junction between the private land and the rear of the public footpath for the width of the site. The Parish wish to take opportunity to improve pedestrian access in front of the site, possibly by increasing footpath width on Halkett Place and would welcome a meeting with the applicant to discuss how this might be taken forward. The next meeting will take place on Wednesday 10 June 2009 at 2.00pm in the Committee Room, Town Hall.
