Before you begin
Description
EPA DEFINITION OF EMPTY [OF HAZARDOUS WASTE]: 40 CFR 261.7
ALL WASTES HAVE BEEN REMOVED THAT CAN BE REMOVED
USING THE PRACTICES COMMONLY EMPLOYED TO REMOVE
MATERIALS FROM THAT TYPE OF CONTAINER, (SUCH AS POURING,
PUMPING, AND ASPIRATING), AND:
1. No more than 1 inch (2.5 centimeters) of residue remain on the bottom
of the container, or
2. No more than 3 percent by weight of the total capacity of the container
remains in the container if the container is less than or equal to 110
gallons in size, or
3. No more than 0.3 percent by weight of the total capacity of the
container remains in the container if the container is greater than to
110 gallons in size.
Note : 3% is equal to 1 inch on the bottom only for a 55 gallon drum:

DOT DEFINITION OF EMPTY: 49 CFR 173.29
PACKAGING CONTAINING ONLY THE RESIDUE OF A HAZARDOUS
MATERIAL SHALL BE OFFERED FOR TRANSPORTATION AND
TRANSPORTED IN THE SAME MANNER AS WHEN IT PREVIOUSLY
CONTAINED A GREATER QUANTITY OF THAT HAZARDOUS
MATERIAL UNLESS :
The hazardous material shipping name and identification number marking, and
any hazardous warning labels are removed, obliterated, or securely covered in
transportation, and
The packaging is sufficiently cleaned of residue and purged of vapors to remove
any potential hazard.
Category
Excluded from hazardous waste management requirements when properly
emptied as per EPA definition.

Accumulation
Check drums/ containers to verity they are empty.
Waste
Reduction
 Return to manufacturer for reconditioning and reuse, or
 Recycle empty drums/containers as scrap metal.
Disposal
 Return to manufacturer for reconditioning and reuse.
 Recycle empty drums/containers as scrap metal. In this case go to the
“Scrap Metal” section.




If drums contain residual product, each drum must be returned to its
original manufacturer. A separate Shipping Manifest [Section I or Section
II] must be prepared for each chemical supplier (See example).
If crushed, complete entry as scrap metal in General Cargo Section
[Section II] of the Apache Shipping Manifest.

Shipping Instructions: DRUMS
1.
Call or FAX Dock/Base to schedule shipment.
2.
Package Drums as follows:
a.
Freight bins
b.
Cargo Baskets
c.
Drum rack
d.
If completely empty, cleaned, and purged, drums may be crushed.
e.
If crushed, place crushed drum in scrap metal basket.
Note:
All drum caps, lids, bungs, and/or covers must be in place, except on crushed
drums. After a drum is crushed bungs do not need to be in place. If possible,
place bung in crushed drum.
3.
Mark Package:
a.
If drums contain residue of original material, marking for shipment of original contents
is required.
b.
If properly emptied and crushed, no markings required.
c.
Stencil Container-”Apache” and the generator’s location (i.e. Eugene Island 158).
4.
Label Package:
a.
If drums contain residue, label as original shipment.
5.
Prepare shipping papers:
a.
If drums contain residual product, each drum must be returned to its original
manufacturer. A separate Shipping Manifest [Section I or Section II] must be
prepared for each chemical supplier (See example).
b.
If crushed, complete entry in the General Cargo Section [Section II] of the Apache
Shipping Manifest.
6.
