On joint motion of all Councilmembers present, the following resolution was offered: RESOLUTION NO. A resolution authorizing the Chairman of the Jefferson Parish Council, or in his absence the Vice-Chairman, to execute an agreement with the State of Louisiana, Department of Transportation and Development, for Jefferson Parish Traffic Damage from Katrina (Federal Aid Local Routes), State Project No. 737-26-0013, Federal Aid Project No. ER-ERE1(116). (Parishwide) WHEREAS, Hurricane Katrina made landfall in the State of Louisiana on Monday, August 29, 2005, leaving destruction of the State’s infrastructure in its path; and WHEREAS, Governor Kathleen Babineaux Blanco issued a formal proclamation and President George W. Bush issued a formal declaration of disaster; and WHEREAS, in accordance with Federal Highway Administration (FHWA) rules and regulations, the Louisiana Department of Transportation and Development (DOTD) and Jefferson Parish completed a Detailed Damage Inspection Report (DIR) Number K051-LA-Signals-Local, on form FHWA-1547, Rev. 4-98, on October 20, 2005, assessing damage and costs for Emergency Repairs and Permanent Restoration of transportation facilities and structures damaged by Hurricane Katrina, which identifies, among other things, the damages that form the basis of the Agreement; and WHEREAS, the emergency repairs associated with the damages identified on DIR K-051-LA-Signals-Local have been completed by Jefferson Parish and its Contractors; and WHEREAS, Jefferson Parish now seeks reimbursement from the FHWA Hurricane Katrina Relief Program, through the DOTD, for the costs of the emergency repairs made by Jefferson Parish and its Contractors, and DOTD is agreeable to administer these funds for reimbursement under the terms and conditions set forth in the Agreement; and WHEREAS, the emergency repairs for which Jefferson Parish seeks reimbursement were incurred at a cost in the amount of $385,736.15 and consists of repairs to traffic signal systems in Jefferson Parish, along with the costs of temporary traffic control devices deployed until traffic signal system damages could be repaired. NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council, the governing authority of said Parish: SECTION 1. That the Jefferson Parish Council does hereby authorize the execution of a Parish/State Agreement between the State of Louisiana and Jefferson Parish for Jefferson Parish Traffic Damage from Katrina (Federal Aid Local Routes), State Project No. 737-26-0013, Federal Aid Project No. ER-ERE1(116) which provides for reimbursement of Jefferson Parish costs in the amount of $385,736.15 from the FHWA Hurricane Katrina Relief Program, through the DOTD, for emergency repairs associated with the damages identified on DIR K-051-LA-Signals-Local. SECTION 2. That Jefferson Parish has submitted documentation of actual costs incurred to date by Jefferson Parish for the emergency repairs and all such documentation shall be subject to verification, adjustment, and settlement by the DOTD Audit Officer. SECTION 3. That Jefferson Parish has provided DOTD with a statement signed by the Director of the Engineering Department explaining circumstances by which Contractors’ services were procured, and the parties agree that Jefferson Parish’s actions during the Extreme Emergency were wholly consistent with the requirements of LSA-R.S. 38:2211, et. seq. SECTION 4. That Jefferson Parish shall reimburse DOTD any and all reimbursed amounts which may be cited by the FHWA or DOTD due to noncompliance with Federal or State laws and regulations. SECTION 5. That the Chairman of the Jefferson Parish Council, or in his absence the Vice Chairman, be and is authorized to execute any and all documents necessary to give full force and effect to this resolution.
