6. Tender form can be obtained from 15.10.2015 on any working days between 11.00 hrs. and 16.00 hrs. and latest
up to 12.00 hrs. in person on 28.10.2015 from any of the offices of (i) Pr. CE, N. F. Railway, Maligaon Guwahati781011, (ii) Office of the DRM(W)/RNY, N. F. Railway, Rangiya and (iii) Office of the ADEN/NBQ, N. F.
Railway/New Bongaigaon on cash payment. Tender documents will also be made available in Northeast Frontier
Railway’s web site www.nfr.indianrailways.gov.in from 15.10.2015 and the same can be downloaded and
used as tender documents for submitted the offer. However, the Demand Draft in favour of FA & CAO/N.F.
Railway/Maligaon will have to be submitted along with tender towards the cost of tender documents while
submitting the offer. Non submission of cost of tender documents will summarily to be rejected.
7. The request for tender forms in person will be entertained up to 12.00 Hrs. till 28.10.2015 and by Post seven days
prior to the last date of dropping of the tender. No responsibility will be taken by the Railways for delay/loss/non
receipt of tender documents sent by post.
8. Tender will be received by (i) Pr.CE/MLG’s office, N. F. Railway/Maligaon, (ii) DRM (W)/RNY, N. F.
Railway/Rangiya (iii) ADEN/NBQ, N. F. Railway/New Bangaigaon office up to 13.00 hrs. of 28.10.2015 and will
open at 15.00 hrs. at DRM (W)/RNY, N. F. Railway/Rangiya office on 29.10.2015. Tenderer can also sent their
paper by registered post indicating tender notice no so as to reach before closing on specified date and time but
Railway Administration shall not be responsible for any Postal delay. In case the above date happens to fall on
holiday/bund the tender will be received/opened on the next working day at the same time.
9.. MONEY ORDER, POSTAL ORDER OR CHEQUE WILL NOT BE ACCEPTED. The cost of tender form is not refundable.
Tenderer/s desiring Tender schedules by Registered Post or speed Post should Pay Rs.500/- respectively for each Tender
Document in addition to the amount mentioned for purchase of Tender documents. Railway will not be responsible for any
postal delay.
10. Tender (s) should submit proper documents i. e. credentials and proof of depositing requisite earnest money with their tender
papers. All tenderers are requested to deposit required earnest money in Cash with Divisional Cashier or Banker’s
Cheques/Demand Drafts drawn in favour of FA & CAO, N. F. Railway, Maligoan executed by SBI or any of the Nationalized
banks or by a scheduled Bank. A tender not accompanied by the requisite earnest money in proper form will be summarily
rejected
11. Eligibility Criteria (Above 50 lakh):
1. The tenderer must have completed at least one similar nature of single work for a minimum of value of
35% of advertised tender value of work in the last three financial years (i. e. current year and three previous
financial years in Govt./Semi Govt. Organisations /PSUs.

2. Total contract amount received during the last three financial years and in the current financial year should be
minimum of 150% of advertised tender value of work. The certificates produced by the tenderer(s) to this
effect should be attested certificates from the employer/client or audited balance sheet duly certified by
chartered account etc. For judging the technical eligibility and financial capability only those works which had
been executed for Govt/Semi Govt. Organization or PSUs shall be considered and the tenderer will submit
the certificate to this effect from concerned duly signed under the official seal. It should be noted that
credentials for the works executed for private organizations shall not be considered certificates (if not submitted in
original) should be duly attested by Gazetted officer.
Note:
(i) Similar nature of work physically completed within the qualifying period i. e. the last 3 financial years
and current financial year should only be considered in evaluating the eligibility criteria.
(ii) The total value of similar nature of work completed during the qualifying period and not the payments
received within the qualifying period alone would be considered. In case final bill of similar nature of work
has not been passed paid amount including statutory deduction is to be considered. If final measurement
has not been recorded or if final measurement has been recorded and work has been completed with
negative variation. However, If final measurement have been recorded and work has been completed
with positive variation but variation has not been sanctioned original value of work should be considered
for judging eligibility.
12. Eligibility Criteria For works tender in respect of partnership firm:
i. In case the tenderer is a partnership firm(s), the experience, solvency and turn over shall be in the name
and style of the firm only.
ii. If the tendrer is a partnership firm, the entire partner shall be jointly liable for successful completion of
the work and no request for change on the certificate of the firm shall be entertained.

iii. During the currency of contract, no partner of the firm ‘shall be permitted to withdraw from partnership
business and in such an event it shall be treated as breach of the trust and abandonment of the contract.
iv. The tenderer(s) whether sole proprietor, a limited company or a partnership firm he/they should submit
authentic proof in terms of partnership deed, proprietorship documents etc. along with the tender. If
he/they want to act through agent or individual partner(s) should submit a power of attorney duly
stamped and authenticated by Notary public or by Magistrate in favor of specific person whether
he/she/they are partner(s) of the firm or any other person specifically authorizing him/her/tem to submit
the tender, sign the agreement, receive money, witness measurements, sign measurement books,
compromise, settle, relinquish any claim(s) preferred by the firm and also sign “No claim certificate” and
refer any disputes to arbitration.
13.
The successful bidder shall have to submit a Performance Guarantee (PG) within 30 days from the date of
issue of Letter of Acceptance (LOA). Extension of time for submission of PG beyond 30 (thirty) days and up
to 60 days from the date of issue of LOA may be given by the Authority who is competent to sign the contract
agreement. However, a penal interest of 15% per annum shall be charged for the delay beyond 30 (thirty)
days, i.e. from 31st day after the date of issue of LOA. In case the contractor fails to submit the requisite PG
even after 60 days from the date of issue of LOA, the contract shall be terminated duly forfeiting EMD and
other dues, if any payable against that contract. The failed contractor shall be debarred from participating in
re-tender for that work.
Special note:.
1. In case of identical rate, the work will be awarded to the contractor who is having better past credentials.
Even in cases where both of them may have adequate credentials but the work will be awarded to the firm
who is having better past track record and the same will be judged as per Annual confidential report of the
contractor.
2. The tenderer for carrying out any construction work in Assam must be themselves registered from the
Registering Officer under Section-7 of the Building and Other Construction Workers Act, 1996 and rules
made there to by the Assam Govt. and submit certificate of registration issued from the Registering Office
of the Assam Govt. (Labour Department). For enactment of this Act. the tenderer shall be required to pay
cess @ 1% of cost of construction work to be deducted from each bill. Cost of material shall be out side
the purview of cess, when supplied under a separate Schedule item.

arrange to carry the same from their respective offices to RNY after receiving of tenders
as per the time schedule as mentioned above.
