DECISION
On issuing the Regulation on Organization and Operation
of Department of Science and Technology for Economic-Technical Branches
MINISTER
OF SCIENCE AND TECHNOLOGY
Pursuant to Decree No. 20/2013/ND-CP dated February 26, 2013 by the
Government on defining the functions, tasks, powers and organizational structure of the
Ministry of Science and Technology;
At the proposal of the Director of the Department of Organization and Personnel,
DECIDES:
Article 1: Issued enclosed herewith this Decision:
1. The Regulation on Organization and Operation of the Department of Science
and Technology for Economic-Technical Branches under the Ministry of Science and
Technology;
2. List of S&T planning focal points assigned under the management of the
Department of Science and Technology for Economic-Technical Branches;
Article 2: This Decision will be put into effect as of signing and will replace
Decision No. 2835/QĐ-BKHCN dated December 10, 2004 by the Minister of Science
and Technology on issuing the Regulation on Organization and Operation of the
Department of Science and Technology for Economic-Technical Branches;
Article 3: The Director of Department of Science and Technology for
Economic-Technical Branches, Director of Department of Organization and Personnel
and leaders of related agencies are responsible for implementing this Decision.

REGULATION
On Organization and Operation of
Department of Science and Technology for Economic-Technical Branches

CHAPTER I
FUNCTIONS, TASKS AND POWERS
Article 1. Position and Functions
The Department of Science and Technology for Economic-Technical Branches
(in short called CNN Department) is an agency under the Ministry of Science and
Technology, which fulfills State management functions in terms of scientific research
and technological development in fields of mechanics, metallurgy, electricity,
electronics, chemicals, consuming goods and foods industry, energy, petroleum, posts
and telecommunications, commercial tourism, materials, constructions, transportation,
irrigation, architecture, urban-rural planning, planting, husbandry, veterinary, forestry,
marine products, preservation and processing of agricultural, forestry and aqua-cultural
products, medicines, pharmacy, national defense, security and others assigned by the
Minister.
Article 2. Tasks and Powers
1. Within assigned scope of work, developing and submitting the Minister:
a) Legal and regulatory documents; guidelines, policies, measures on promoting
the S&T development; management mechanisms for scientific research and technology
development activities.
b) 5-year S&T development orientations, objectives, directions and tasks;
planning, plans on scientific research and technology development activities on the
annual and periodic basis.
2. Providing guidelines, implementing and checking the implementation of legal
and regulatory documents; guidelines, policies, measures, planning, 5-year and annual
plans; proposing directions for S&T development tasks at the State/national level within
the assigned scope after they are approved, discovering and coordinating with relevant
functional agencies to submit the Minister for handling violations as stipulated by laws.
3. Regarding management of scientific research and technology development
activities undertaken by Ministries, branches and localities in the assigned management
fields:
a) Coordinating with the Department of Planning and General Affairs to work
out S&T plans of the assigned Ministries and branches; chairing and coordinating with
the Department of Planning - General Affairs to examine the implementation of
scientific research and technology development activities undertaken by Ministries and
branches; coordinating the management of those scientific research and technology
development activities carried out by localities;
b) Chairing the monitoring, examination and supervision of the management and
implementation of S&T tasks of Ministries and branches as stipulated;
c) Providing guidelines, receiving orders of S&T tasks and products at the
State/national level;
d) Chairing the transfer of implementation results of S&T tasks at the
State/national level to Ministries and branches according to ordering proposals;
đ) Regularly on the annual basis or suddenly when requested consolidating
reports to the Minister on the status and results of scientific research and technology
development activities undertaken by undertaken by Ministries and branches.
4. Regarding management of scientific research and technology development
activities at the State/national level in the assigned management fields:
a) Chairing and providing guidelines for ordering proposals or ordering S&T
tasks and products; receiving, handling, consolidating ordering proposals; coordinating
with the Department of Planning – General Affairs to submit to the Ministry’s leaders
for deciding the List of S&T tasks and products which will be ordered from
organizations and individuals;
b) Chairing or coordinating the selection, review and assignment of tasks to
organizations and individuals; reviewing, appraising, checking, assessing before
acceptance of S&T results;
c) Organizing the transfer of S&T results to organizations and individuals for
using and implementing;
d) Supervising organizations and individuals which fulfill S&T tasks at the State
level to provide results of the tasks to the National Agency for Science and Technology
Information as stipulated;
5. Proposing directions and tasks of capital construction, equipment and human
resource development of Ministries and branches under the assigned management
fields;
6. Coordinating to establish economic - technical norms, standards and technical
specifications;
7. Coordinating the development of the databases on S&T experts and
organizations under in the assigned management fields;
8. Being a permanent member of the System Safety Council for hydroelectricity
works on Da river, tasks of genic sources and participating in other organizations when
assigned or delegated by the Minister.
9. Managing the organization, personnel, and assets and documents of the
Department according to the Ministry’s delegation of authority and existing regulations;
10. Carrying out other tasks assigned by the Minister.
CHAPTER II
ORGANIZATIONAL STRUCTURE AND WORKING MECHANISM
Article 3. Leaders of the Department
1. Leaders of the Department of Science and Technology for EconomicTechnical Branches consist of the Director and Deputy Directors.
2. The Director the Department of Science and Technology for EconomicTechnical Branches is appointed and dismissed by the Minister of Science and
Technology and responsible to the Minister and laws for the Department's entire
organization and operation.
3. Deputy Directors of the Department of Science and Technology for
Economic-Technical Branches assist the Director in general management of the
Department’s work; are entitled to decide on issues under their assigned scopes and
responsible to the Director for the assigned tasks; are appointed and dismissed by the
Minister of Science and Technology at the Director’s proposals.
4. In case the Director is absent, one Deputy Director is authorized to manage
and deal with the Department’s work.
Article 4. The organizational structure
1. General Division.
2. Division of Agricultural Science and Technology.
3. Division of Industrial Science and Technology.
The Director of the Department of Science and Technology for EconomicTechnical Branches in coordination with the Director of the Department of
Organization and Personnel specifically stipulate functions, tasks, powers and assigns
permanent officials, civil officers, staff and laborers who work in divisions/units
directly under the Department based on the assigned functions, tasks and number of
permanent staff.
The appointment, dismissal of head, deputy head levels of divisions/units
follows the Ministry’s regulation on authority and appointment.
Article 5. Working mechanism
1. The Department of Science and Technology for Economic-Technical
Branches organizes its work according to a mechanism in which the leadership
integrates with collective discussion.
2. The Department of Science and Technology for Economic-Technical
Branches follows regulations in which experts work directly with its leaders and link
with management roles of leaders of units under the Department. When it is necessary,
the Director can establish working groups or units depending on working requirements
and specify tasks and these working groups or units.
CHAPTER III
IMPLEMENTATION PROVISIONS
Article 6. The enforceability validity
1. This Regulation is put into effect as of date of signing.
2. The Director of Department of Science and Technology for EconomicTechnical Branches coordinates with the Director of Department of Organization and
Personnel to implement this Regulation.
Article 7. The amendment and supplementation of this Regulation
The amendment and supplementation of this Regulation is carried out by the
Director of the Director of Department of Science and Technology for EconomicTechnical Branches in coordination with the Director of Department of Organization
and Personnel to submit to the Minister of Science and Technology for review and
approval.
