Acquisition Contract
Acquisition of medical-historical items for the Collections/Library of the
Medical University of Vienna

1. The owners consign the media, archives and other objects to the Collections/Library of the
Medical University of Vienna (please delete as appropriate) in accordance with the enclosed
documentation sheet and transfer all rights. Upon consignment of the media, archives and
objects, these shall become the property of the Medical University of Vienna through donation
and must be handled and kept with appropriate care.
2. The media/archives/objects shall be recorded in the inventory of the University Library or the
Collections and included in the relevant catalogues in accordance with the ALEPH (books and
other information sources) and AUGIAS (archives) cataloguing system guidelines. The Medical
University of Vienna reserves the right to treat the media/archives/objects in a manner
commensurate with its installation and storage criteria and to discard or destroy individual
objects/archives/media that do not correspond with the collection guidelines.
3. The acquired media/archives/objects shall be subject to the Library of the Medical University of
Vienna's terms of use.
The appropriate regulations of archive, data protection and copyright legislation shall apply for
biographically relevant and not yet published material (archives, photos, autographs, etc.).
4. The Consigner confirms that the transferred items do not come from Nazi loot and have been
obtained in a manner that does not contravene the UNESCO guidelines for the protection of
cultural and natural heritage.
5. The Collections/the University Library shall be exclusively liable for damages caused to the
consigned items by neglect of mandatory duties of care.
6. Duration of the acquisition contract: the acquisition contract is concluded for an indefinite
period of time.
7. Place of jurisdiction for all legal disputes arising from this contract shall be exclusively the
competent court in the location of the registered office of the Medical University of Vienna in
Vienna. Austrian law shall apply, excluding the principles of conflict of laws.
