SERVICE AGREEMENT FOR INTERPRETERS

The terms and conditions set out in this document constitute a contract for interpreting services between Pearl Linguistics Ltd and the Interpreter upon being signed by the Interpreter and they govern each and every assignment undertaken by the Interpreter with a client. Please note that Pearl Linguistics is unable to use your interpreting services unless this agreement is signed

and posted/faxed/e-mailed to our office along with your Application Form.

The Role of the Interpreter

1.

The role of the Interpreter is to undertake interpreting assignments on behalf of Pearl Linguistics Ltd. His/her job is to bridge the linguistics gap between the two parties to the standard required and to the best of his/her ability. The Interpreter must interpret accurately, fluently and appropriately between both languages using the correct interpreting techniques.

2.

The Interpreter shall refuse to undertake work from Pearl Linguistics Ltd that he/she knows to be beyond his/her competence because of lack of specialised knowledge or linguistic skills.

3.

The Interpreter shall at all times promote the best interests and reputation of Pearl Linguistics Ltd to all third parties. The Interpreter shall not do anything which could in the opinion of Pearl Linguistics Ltd adversely prejudice the reputation and interests of Pearl Linguistics Ltd.

4.

The Interpreter is expected to maintain good working relations with clients and with staff at Pearl Linguistics Ltd.

5.

The Interpreter is under no obligation to accept a particular assignment.

6.

The Interpreter must not sub-contract any project assigned to him/her by Pearl Linguistics Ltd to any third party without Pearl’s knowledge and permission in writing.

Professional and Ethical Issues

7.

The Interpreter must respect confidentiality at all times and not seek to take advantage of any information disclosed during his/her work.

8.

The Interpreter must act in an impartial and professional manner.

9.

The Interpreter should not discriminate against parties, either directly or indirectly, on grounds of race, colour, ethnic origin, age, nationality, religion, gender, sexuality or disability (in accordance with Pearl’s Equal

Opportunities Policy).

10.

The Interpreter must be sensitive to requirements of Pearl’s clients, and be as flexible as possible in approach. In the event that a dispute arises between the Interpreter and a client, the Interpreter is expected to act in a professional and tactful manner before bringing it to our attention at the earliest possible opportunity.

Payments

11.

Pearl Linguistics Ltd shall pay the Interpreter fees calculated at a minimum hourly rate, these rates vary and will be notified at the commencement of each assignment. Travel time will be paid where applicable.

12.

Payment will be made by cheque against the Interpreter’s invoice at the end of the month following the month in which his/her invoice is dated.

Unless otherwise agreed prices are sterling. To ensure prompt payment, the Interpreter must return his/her invoices within 48 hours after completion of each assignment. Pearl reserves the right to hold the payment if this requirement is not met. Pearl Linguistics Ltd is not entitled to do any payment to the Interpreter without the signed time sheet of that particular job. The Interpreter is required to use the invoice template provided him/her by Pearl Linguistics Ltd. The invoice date should be the date on which the invoice is sent.

13.

Under the terms of this Service Agreement, the Interpreter is not an employee of Pearl Linguistics Ltd. He/she is considered as selfemployed and therefore liable to pay their own tax and national insurance contributions.

14.

The Interpreter is not entitled to payment from Pearl Linguistics Ltd or its clients for time not spent on an assignment whether in respect of holidays, illness or absence for any other reason.

Travel and Expenses

15.

Pearl Linguistics Ltd shall pay the Interpreter’s reasonable travel expenses. The Interpreter is expected to use public transport wherever

possible. We do not pay for taxis unless arrange with Pearl Linguistics beforehand.

16.

If incurring above average travel costs, Pearl Linguistics Ltd must be consulted for authorisation beforehand.

17.

If the Interpreter is utilising his/her own transport, Pearl Linguistics Ltd shall pay a rate of 30 pence per mile. Pearl Linguistics Ltd will not be liable for other expenses i.e. parking tickets, Congestion Charge, any other expense that may occur as a result of using private transport.

18.

Pearl Linguistics Ltd shall not be liable for sustenance expenses.

Delays and Cancellations

19.

Pearl Linguistics Ltd accepts no liability to the Interpreter for the cancellation of bookings by client, arising from the Interpreter’s late arrival regardless of contributing circumstances.

20.

Pearl Linguistics Ltd accepts no liability to the Interpreter for the cancellation of bookings by client if given more than 24 hours notice. If the cancellation is made earlier same day it is due to take place, we will pay you a minimum interpreting time of one hour. No travel time and expenses will be paid.

Restrictions

21.

The Interpreter agrees that for a period of 12 months following any introduction of the Interpreter by Pearl Linguistics Ltd to any other company, business or organisation or for a period of 12 months following the completion of any work arising from such an introduction not to undertake or accept any work for that company, business or organisation whether it be contract permanent or temporary without the prior agreement of Pearl Linguistics Ltd. Any breach of this clause may render the Interpreter liable for loss of revenue or other damages incurred by

Pearl Linguistics Ltd. The Interpreter shall also inform Pearl Linguistics

Ltd of any offer of employment made by such parties.

Terminations

22.

Pearl Linguistics Ltd shall be entitled to terminate this agreement with immediate effect if the Interpreter commits a material breach of the terms in this Service Agreement. In the event of terminations of this

Service Agreement, Pearl Linguistics Ltd shall only be liable to the

Interpreter in respect of any outstanding fees accrued in accordance with the terms of this Service Agreement up to the date of termination.

23.

It is hereby agreed between the parties that the Interpreter shall not be entitled to receive any payment from Pearl Linguistics Ltd by way of compensation for loss on termination of this agreement howsoever arising.
