CONTRACT FOR WEDDING PHOTOGRAPHY SERVICES
This agreement is between the Bride and Groom and Keith Bath of K R
Photography.

ENTIRE AGREEMENT: This agreement contains the entire understanding
between Keith Bath of K R Photography hereafter “K R Photography” and the
Bride and Groom.
CONFIRMATION: A signed “CONTRACT FOR WEDDING PHOTOGRAPHY
SERVICES” and payment of the booking fee are necessary to confirm the
stated wedding services from K R Photography.
PRE-WEDDING CONSULTATION: This will normally take place at the time of
booking. The Bride and Groom will outline broadly what is required. K R
Photography will advise on planning, logistics and timings where needed. The
Bride and Groom are welcome to contact us for an additional chat closer to
the time of the wedding (about 2 weeks before) to iron out any remaining
details. We will contact you by phone a few days before the wedding to
ensure that there have been no last minute changes.
CO-OPERATION: The Bride and Groom and the K R Photography consent to
happily co-operate and communicate with each other to achieve the best
possible result within the understanding of this contract. We recommend that
we are provided with a helper (usually the best man or an usher) who will
point out key individuals to be photographed. We may also require the
assistance of the best man or usher in organizing family groups. The bride
and groom also agree to give us sufficient warning of key events at the
wedding to give us time to prepare e.g. bouquet throwing, cutting the cake,
speeches etc. Please note that not all of your guests at the wedding will like
having their photo taken. In such cases the wedding photographer(s) will use
his/their discretion but cannot be held responsible for a lack of photos of these
people.
EXCLUSIVITY: It is understood that K R Photography are retained as the
official exclusive Photographer for the above Wedding and no other person is
permitted to shoot images for sale or as gifts unless agreed in writing before
the day. This includes guests (except for their own personal non-commercial
use). Breach of this condition shall be deemed cancellation of the contract by
the clients. K R Photography will undertake no alternative Wedding Services
on the date of the above Wedding.
Coverage may be cancelled at the discretion of the photographer if the
photographer feels threatened or has reason to believe that photographic
equipment may be damaged.

THE SCHEDULE: Our shooting schedule and style of working are designed
to achieve a great set of wedding photos for the Bride and Groom,
accomplished with good humour and enjoyed by all concerned. Both the Bride
and Groom and K R Photography therefore agree that punctuality and
cheerful co-operation are essential. In cases where the wedding does not run
on time (for example, extreme lateness by the bride arriving to the church) we
cannot guarantee to take our normal set of photos although in such
circumstances we will do our absolute best to compensate.
WEDDING GUESTS: Your guests will have their own cameras and will want
to photograph the Bride and Groom. In the spirit of cheerful co-operation the
Bride and Groom agree to give the K R Photography precedence over their
guests in order to take the photographs required for the wedding services
described above. We cannot be held liable for a lack of wedding photos if
guests taking their own photos of the Bride and Groom have continually
interrupted the photographer’s work.
UK COPYRIGHT: The Copyright, Designs and Patents Act 1988 assigns
copyright to K R Photography. You may not copy the photographs taken
under this contract, or allow copies to be made photographically,
electronically, or by any other means, unless agreed with K R Photography
beforehand.

MODEL RELEASE: The Bride and Groom grant K R Photography and its
legal representatives, heirs and assigns, the irrevocable and unlimited
consent to use the photographs of the bride and groom for editorial,
competition, advertising and any other purpose and in any manner, to alter
the photographs without restriction; and to copyright the images. The Bride
and Groom hereby release K R Photography and its legal representatives,
heirs and assigns from all liability and claims in connection with the images.
LIMIT OF LIABILITY: In extenuating circumstances e.g. death, personal
injury or sickness to the photographer (this list is not exhaustive), K R
Photography reserves the right to seek to find a replacement photographer to
undertake the contract. If a replacement photographer cannot be found then
liability is limited to a refund of any payments received.
K R Photography cannot be held responsible for breach of this contract due to
circumstances beyond their control. These circumstances include but are not
limited to: lack of access to the venue, church / reception venue becoming
unavailable, weather conditions preventing travelling etc.
There is the unlikely possibility that images may be lost, stolen or destroyed
for reasons in or beyond our control. In these circumstances liability is limited
to the return of fees paid for the service or part thereof according to the
percentage of images supplied.
BOOKING FEE: A 10% booking fee is payable in order to secure our
photographic services on the wedding date. This is payable upon signing this
contract. This contract will only come into effect when the booking fee has
been paid. K R Photography reserves the right to annul the agreement without
further correspondence if the fee is not received within one week of signing
this contract. The balance may be paid in full upon booking if preferred.
In the event of cancellation for whatever reason by the client, the booking fee
is non refundable.
PAYMENTS: Any remaining balance for agreed services must be paid no
later than 6 weeks prior to the Wedding Date. FAILURE TO MAKE
PAYMENTS BY THE DUE DATES MAY RESULT IN CANCELLATION OF
THIS WEDDING AGREEMENT.
FEE VARIATIONS: Prices quoted for Wedding Services at the time of
booking and as printed in the Studio Literature will be held up to the Wedding
date. Additional album and print orders will be subject to the Studio pricing
structure in force at the time of ordering
CANCELLATION / TERMINATION: The Client may terminate this Contract at
any time by giving written notice to K R Photography. Cancellations of any
wedding within 26 weeks of the wedding date will result in the client being
liable to pay 50% of the package fee booked. Cancellation of any wedding
within 12 weeks of the wedding date will result in the client being liable to pay
the full amount of the package fee booked. The said sum is payable as
compensation of lost bookings and other losses K R Photography may suffer.
This contract will also terminate on A: completion of the supply of the album or
prints or images on disk by the K R Photography to the Client or B: 120 days
after the Wedding Date if the Client fails to instruct the K R Photography to
place a print order, disk order or album design into production. In either case
no monies previously paid to the K R Photography will be refundable.
Products and services ordered after this date will be subject to a new
agreement and pricing.
CREATIVE LICENCE: K R Photography shall be granted creative and artistic
license in relation to the choice of locations and poses used. Keith’s judgment
on locations, photographic style and the number of photographs taken shall
be deemed correct.
K R Photography will not be held responsible for lack of images due to
inclement weather, limitations imposed by the Venue (including Churches),
misdirection by the Client or uncooperative guests. Keith will do his best to
honour requested photographs but does not undertake to guarantee any
specific picture nor incorporate any specific background, location or group
arrangement.
STYLE: Photographic style is open to interpretation, and the Client should be
fully aware of what they are asking for to avoid misunderstandings in their
wedding coverage. A guide to the photographic style offered by the K R
Photography is provided on the website www.krphotos.co.uk and is
available by e-mail or in writing upon request.
HOUSE RULES: K R Photography will sometimes be limited by rules imposed
by registrars, ministers and venue management as to what can and cannot be
done.
Every effort will be made to capture photographs of your wedding service, but
this at the discretion of the authorised individual performing the ceremony. For
example some ministers insist that flash photography is not allowed, whilst
others will insist that the photographer shoots from a specific location. In such
circumstances the Bride and Groom agree to accept the technical limitations
that may be imposed on the equipment used. We advise the Bride and Groom
to make themselves aware of the rules of the venue concerned and if
necessary negotiate with the personnel concerned. Therefore, photographs of
the service cannot be guaranteed but will be captured if circumstances allow.
SIZES: All image and album sizes are nominal. K R Photography will provide
a pleasing colour balance but cannot guarantee exact colour matching.
ARCHIVING: K R Photography will endeavour to retain the images on file for
a minimum of one year following the Wedding Date, but no guarantees are
given in respect of image retrieval or reproduction from the original files.
It is understood that any and all proofs, sample prints and data files remain
the property of the K R Photography.
We have understood the contents of this contract and agree to the terms
therein.
