CITY OF SHAWNEE POLICY STATEMENT SUBJECT: Curb, Gutter, and Sidewalk Program POLICY CODE NO. PS-11 EFFECTIVE DATE 01/23/1981 REVISED DATE 06/23/2003 PAGE Page 1 of 2 BACKGROUND The City of Shawnee is responsible for the maintenance of the public street and sidewalk system. Over time, many sections of concrete curb and gutter and sidewalk will fail through surface deterioration and settlement. Recognizing that cracked, buckled or deteriorated sidewalks can create safety problems, the purpose of this policy is to provide for the improvement of sidewalks, which have been classified as hazardous or deteriorated within the City of Shawnee. POLICY Each year the City of Shawnee prepares a Curb and Sidewalk Repair Contract consisting of replacement of hazardous or deteriorated sections of curb and gutter and sidewalk. This policy shall apply to all public sidewalks and provides for a method by which the City-at-large will pay for the replacement of sidewalks considered hazardous or deteriorated, based on the availability of funds. However, in instances where it has been determined that a curb or sidewalk has been damaged or has deteriorated because of abuse, the City Council will determine whether the Cityat-large will replace the curb or sidewalk or assess the cost of the necessary repairs to the adjoining property owners. PROCEDURES Curb and gutter problems are inspected by City staff upon request and recommended for repair based upon the type and degree of failure of the existing curb and gutter. Sections of curb and gutter are replaced in five (5) foot minimum lengths. Longer lengths of curb and gutter are replaced if several failures are observed less than five (5) feet apart. If the section of curb and gutter needing replacement is less than 2’ from the nearest construction joint, then the 2’ section will be removed along with the deteriorated section and replaced in a monolithic piece. Sidewalks are inspected by City staff and panels are repaired or replaced based on settlement problems or severely deteriorated areas which create a tripping hazard. Typical sidewalk panels in the City of Shawnee are 4’ or 5’ sections. Curb and sidewalks are not replaced due to cracking, discoloration or for other minor aesthetic reasons. To determine which sections of curb and gutter and sidewalk should be included in the Annual Repair Contract, the Public Works Department prepares a list of curb and sidewalks derived from five categories of locations needing repair work maintained by the department. The five categories of curb and sidewalk locations needing repair work by priority ranking are: 1) 2) Sidewalk locations brought to our attention through citizen requests. Curb and gutter locations identified for replacement through citizen service requests. Staff recommendations made from observations over the past year on streets not included in the second priority. A proposed contract list of curb and gutter and sidewalk replacement locations is then created from the five categories by comparing the estimated repair cost to the available budget. Locations are removed from the contract list starting with the lowest priority locations until the estimated repair cost is below the available budget for the proposed contract list. The proposed contract list is presented to the City Council for approval prior to receiving bids and recommending award of the contract. IMPLEMENTATION This policy shall take effect immediately for use by the Public Works Department for preparing a list of curb and gutter and sidewalk replacement locations for the summer Curb and Sidewalk Repair Contract. This policy shall remain in force until officially changed by the majority of the voting council members in attendance of a regularly scheduled Council Meeting of the Governing Body duly elected to conduct the business affairs of the City.
