OFFICIAL MINUTES OF CITY OF GRETNA Gretna, LA Special Meeting - Promulgation for Timberlane Annexation Monday, July 21, 2008 The Mayor and City Council of the City of Gretna met this day Monday, July 21, 2008 at 5:30 p.m. in special session with the following members present: Mayor Ronnie C. Harris, Council Members Raylyn R. Beevers, Jonathan C. Bolar, Belinda C. Constant and Vincent E. Cox III. Absent: Councilman Wayne A. Rau Notice of the Special Meeting of the Mayor and Council of the City of Gretna for the Timberlane Annexation, scheduled for Monday, July 21, 2008 was duly posted on the Gretna City Hall Bulletin Board since May 5, 2008 to date. Mayor Harris stated the purpose of this meeting was to promulgate the July 19, 2008 election results for the Timberlane Annexation propositions. On motion by Councilman Cox and seconded by Councilwoman Constant, the following resolution was read and adopted section by section and then as a whole by the following vote: Yeas: Council Members Beevers, Bolar, Constant and Cox Nays: None Absent: Councilman Wayne A. Rau RESOLUTION NO. 2008-077 A resolution providing for canvassing the returns and declaring the result of the Special Election held in Jefferson Parish Precinct 233 and Part of Jefferson Parish Precinct 235, State of Louisiana, on Saturday, July 19, 2008, to annex into and make a part of the City of Gretna certain areas known as the Timberlane Subdivision; and providing for other matters in connection therewith. BE IT RESOLVED by the Mayor and City Council of the City of Gretna, State of Louisiana (the “Governing Authority”), acting as the governing authority of the City of Gretna, State of Louisiana (“the City”), that: SECTION 1: Canvass. This Governing Authority does now proceed in open and public session, conducted within forty-eight hours of the closing of the polls, to examine the official tabulations of votes cast at the Special Election held in the City of Gretna, on Saturday, July 19, 2008, to authorize annexation into and making a part of the City of Gretna certain areas of Jefferson Parish known as Timberlane Subdivision and providing for other matters in connection therewith, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the Special Election. SECTION 2: Results of Canvass. After due and diligent canvass, the Governing Authority does find that the results of the said canvass of votes are fully and accurately set forth in the Process Verbal attached hereto. SECTION 3: Process Verbal. A Process Verbal of the canvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Jefferson, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority. SECTION 4: Transcription in Public Records. The returns of the election shall be transcribed in the public record-book wherein the ordinances or official proceedings of the City of Gretna are usually recorded. SECTION 5: Boundary Description to City Clerk and Clerk of District Court. Within 10 days, a description of the entire boundary of the City of Gretna as changed and the effective date and time of change shall be filed with the City Clerk of the City of Gretna and with the Clerk of the Twenty-Fourth Judicial District Court, Parish of Jefferson. A copy of all municipal ordinances annexing the new territory, a map, and a written description of all the newly annexed territory shall be furnished to the Registrar of Voters for the Parish of Jefferson. SECTION 7: Public Promulgation of Election Result. The result of said election shall be publicly promulgated by publication within ten days in the manner provided by law. PROCESS VERBAL PROCESS VERBAL AND PROMULGATION OF THE CANVASS OF THE VOTES CAST AT THE SPECIAL ELECTION HELD IN PRECINCTS 233 AND 235 (PART) OF THE PARISH OF JEFFERSON, STATE OF LOUISIANA, ON SATURDAY, JULY 21, 2008. BE IT KNOWN AND REMEMBERED, that on Monday, the 21st day of July 2008, at 5:30 p.m., in the Council Chambers at Gretna City Hall, Second Street and Huey P. Long Avenue, Gretna, Louisiana, the Mayor and City Council of the City of Gretna, State of Louisiana, acting as the governing authority (the “Governing Authority”) for the City of Gretna, State of Louisiana (the “City”), and being the authority ordering the special election held therein on Saturday, July 19, 2008, with the following members present: Council Members: Beevers, Bolar, Constant and Cox Absent: Councilman Wayne A. Rau Did, in open and public session, examine the official certified tabulations of votes cast at the said election, and did examine and canvass the returns of the said election, there having been submitted at said election the following two propositions, to wit: PROPOSITION 1 SUMMARY: TO ANNEX INTO AND MAKE A PART OF THE INCORPORATED AREA OF THE CITY OF GRETNA AT MIDNIGHT ON DECEMBER 31, 2008, THAT AREA KNOWN AS TIMBERLANE SUBDIVISION THAT IS SITUATED NORTH OF LAPALCO BOULEVARD. PROPOSITION 1: Shall the following area be annexed into and be made part of the incorporated area of the City of Gretna: Property bounded to the north by Belle Chasse Highway, to the east by Timberlane Drive, to the west by the Verret Canal, and to the south by Lapalco Boulevard, with such annexation to be effective at 12 o’clock midnight on December 31, 2008. and PROPOSITION 2 SUMMARY: TO ANNEX INTO AND MAKE A PART OF THE INCORPORATED AREA OF THE CITY OF GRETNA AT MIDNIGHT ON DECEMBER 31, 2008, THAT AREA KNOWN AS TIMBERLANE SUBDIVISION THAT IS SITUATED SOUTH OF LAPALCO BOULEVARD. PROPOSITION 2: Shall the following area be annexed into and be made part of the incorporated area of the City of Gretna: Property bounded to the north by Lapalco Boulevard, to the east by the rear lot lines of the properties located on the east side of Marlene Drive, to the west by the Verret Canal, and to the south by Bayou Fatma, terminating at municipal address 820 Fairfield Avenue, with such annexation to be effective at 12 o’clock midnight on December 31, 2008. With respect to Proposition 1, there was found by said count and canvass that the following votes had been cast at the said special election IN FAVOR OF and AGAINST, respectively, Proposition 1 as herein above set forth at the following polling places, to wit: Page 2 of 4 OFFICIAL MINUTES OF CITY OF GRETNA Gretna, LA Special Meeting - Promulgation for Timberlane Annexation Monday, July 21, 2008 Precinct 233 VOTE TABULATION FOR AGAINST 301 85 POLLING PLACES Location Timberlane Country Club GRAND TOTAL MAJORITY FOR 301 85 301 The polling place above specified being the only polling place designated at which to hold the said election on Proposition 1, it was therefore shown that there was a total of 301 votes cast IN FAVOR OF Proposition 1 and a total of 85 votes cast AGAINST Proposition 1, as herein above set forth, and that a majority of the 386 total votes on Proposition 1 were cast were IN FAVOR OF Proposition 1 as herein above set forth. THEREFORE, the Governing Authority did declare and proclaim and does hereby declare and proclaim in an open public session that Proposition 1 as herein above set forth was duly CARRIED by a majority of the votes cast by the qualified electors voting at the said special election held in Precinct 233 of the Parish of Jefferson on Saturday, July 19, 2008. With respect to Proposition 2, there was found by said count and canvass that the following votes had been cast at the said special election IN FAVOR OF and AGAINST, respectively, Proposition 2 as herein above set forth at the following polling places, to wit: Precinct 235 (part) VOTE TABULATION FOR AGAINST 182 89 POLLING PLACES Location Timberlane Country Club GRAND TOTAL MAJORITY FOR 182 89 182 The polling place above specified being the only polling place designated at which to hold the said election on Proposition 2, it was therefore shown that there was a total of 182 votes cast IN FAVOR OF Proposition 2 and a total of 89 votes cast AGAINST Proposition 2, as herein above set forth, and that a majority of the 271 total votes on Proposition 2 were cast were IN FAVOR OF Proposition 2 as herein above set forth. THEREFORE, the Governing Authority did declare and proclaim and does hereby declare and proclaim in an open public session that Proposition 2 as herein above set forth was duly CARRIED by a majority of the votes cast by the qualified electors voting at the said special election held in Precinct 235 (part) of the Parish of Jefferson on Saturday, July 19, 2008. HARRIS MAYOR CITY OF GRETNA STATE OF LOUISIANA On motion by Councilman Cox seconded by Councilwoman Constant, IT WAS RESOLVED to retain the services of John Wildgen, Demographer along with the assistance of the Honorable Jon A. Gegenheimer to redraw district lines to include the Timberlane Subdivision, and the same were unanimously approved. Councilman Cox suggested that a committee be formulated composed of city officials to discuss the redistricting lines regarding the Timberlane Subdivision. Mayor Harris advised that he would begin communications with Jefferson Parish to develop the required cooperative endeavor agreements between the city and parish regarding those services that the parish would provide to the Timberlane Subdivision.
