There are no specific regulations in Section 504 of the Rehabilitation Act of 1973 or the American with Disabilities Act that pertain to ESY. b. However, the Office for Civil Rights staff in the United States Department of Education interpreted those two civil rights statutes to impose such a requirement. c. If that group of individuals knowledgeable about the child, evaluation data, and placement option determines that the student requires ESY as part of FAPE and places ESY in the Section 504 Service Agreement, the LEA must provide those services. 7. North Carolina Letter and 60 days – this letter does not impact PA because we have language addressing breaks in school. NC did not, so summer break counts towards 60 day timeline for evals and re-evals. 8. Section VII on the IEP a. Those four bulleted area in the box must be discussed at the IEP team meeting b. There is no requirement that each of the areas must have a written response. If the LEA wishes to provide a written response for each bulleted area, that is up to the LEA. c. As we discussed, there are two statements at the bottom of the page that must have a written response. The LEA must provide a written response for the statement “… Explanation of the extent, if any, to which the student will not participate with students without disabilities in the regular education class….” -There must be a written statement placed in the box. -This is where-the educational environment. d. The LEA must provide a written response for the statement “…Explanation of the extent, if any, to which the student will not participate with student without disabilities in the general education curriculum….” -There must be a written statement placed in the box. -This deals with content-what is taught. 9. Equitable Participation – if a nonpublic school parent declines special ed services, does the student have to be re-evaluated every 3 or 2 years? - Yes. The district is obligated to conduct re-evals to establish the child is eligible for EP services. You may fulfill this obligation with a waiver. If the child returns to the public school, an subsequent evaluations would be a reeval. - If the IU conducted the initial eval and the district has not been involved, the IU may be responsible for conducting the reevals. 10. Emancipated minors and IEPs: Question: If an 18 year old student receiving special education services marries a 17 year old receiving special education services - who can sign documents? Answer: 22 Pa Code 11.11 (a)(1) states “…a minor living with a spouse is deemed emancipated”. The 17 year old student may sign his/her own documents. 11. Gifted – Amy Garvey 12.
