Background and Justification 1.1 Background The legislative environment for child protection in Papua New Guinea is strong. In addition to ratifying the Convention on the Rights of the Child and some of its optional protocols, Government has also enacted a number of laws, guidelines and policies addressing child protection issues. The safety and wellbeing of citizens including children is reflected in Vision 2050 and in PNG Development Strategic Plan 2010-2030. These broader national development policies combined with the Child Protection Bill (2015)-Lukautim Pikinini Act (LPA)- which is currently on its way to parliament; the Family Protection Act (2013); the Juvenile Justice Act (2014); the Village Court Act (2014), the Juvenile Court Act (1991) and the Civil Registration Act (2014) all provide a sound base for establishing comprehensive national child protection system to effectively prevent and respond to violence, abuse and exploitation of children and improving access to justice for children. Despite this rather progressive legal framework, there are evident deficiencies in implementation. The child protection sector suffers from a number of systemic barriers and bottlenecks including weak leadership capacity; lack of coordination mechanism; poor financial and human resources capacity; limited availability and poor quality of services; low utilization of the few available services; weak case management system and dysfunctional knowledge management and accountability mechanism. UNICEF is supporting government to address these systemic barriers and bottlenecks through a combine upstream policy support, training and capacity building and targeted program interventions. More recently, policy level support have resulted in improved legal protection for children following the finalization of the review of the Child Protection Bill (LPA) (2015), which is currently on its way to parliament for consideration and endorsement. The new Child Protection Act (2015) sets the foundation for addressing these key systemic barriers and bottlenecks by establishing independent Office of Child and Family Services; creating national and sub-national Child and Family Services Council to coordinate implementation of the Act; establishing Family Court Services and calling for establishment of child protection register. 05 May 2015 1 The Child Protection Policy (Lukautim Pikinini Policy-LPP) which is currently in draft forms aims to address this systemic barriers and bottlenecks. It calls for improved financial and human resources capacity; increasing scope and access to preventive and responsive services; establishing early detection, referral and case management system and building evidence base on child protection. This consultancy aim to provide high level technical support to the Department of Community Development to strengthen Child Protection Systems in PNG to accelerate implementation of existing legal and policy framework particularly the Lukautim Pikinini Act (2015) and the National Child Protection Policy (2015) there by improving the care and protection of children. 2. Objective and Scope of Work This consultancy is in response to the request from the Department of Community Development (DfCD) to have a technical advisor who can help in strengthening national child protection systems, particularly in accelerated implementation of the Lukautim Pikinini Act (2015) and the National Child Protection Policy (2015). The consultancy will also contribute to implementation of output one of the child protection component of the United Nations Assistance Framework for PNG (UNDAF), which aims to strengthen the capacity of the Office of Child and Family Services to lead, roll out and monitor implementation of Lukautim Pikinini Act (LPA) at national and sub-national level by December 2017. 2.1 Objective of the consultancy The following are specific objectives of the consultancy Strengthen DfCD capacity to effectively coordinate, lead and facilitate the implementation of the Lukautim Pikinin Act (2015) and the National Child Protection Policy (2015) 2.2 Scope of work The consultant will work very closely with the Director of the Office of Child Protection and the Secretary for Community Development and support the realization of the following outputs Objective: Strengthen DfCD capacity to effectively coordinate, lead and facilitate the implementation of the Lukautim Pikinin Act (2015) and the National Child Protection Policy (2015) a) Support the development of costed five year whole of government plan, including monitoring and evaluation framework, for child protection to support of the implementation of Lukautim Pikinin Act (2015) and the National Child Protection Policy (2015) b) Work with government counterpart and develop a concept note for modelling of comprehensive child protection system in selected provinces to support accelerated implementation of Lukautim Pikinin Act (2015). c) Work with UNICEF regional team and organize training and capacity building of national counterparts, particularly DfCD in child protection planning, costing as well as budget and expenditure analysis. d) Provide technical support to the Department for development of out of home care guidelines 05 May 2015 2 e) Support the development of child protection sector financing and workforce development strategy f) Support DfCD in advocacy for integration of whole of government or interagency child protection plan in governments mid-term plan and expenditure framework g) Support the establishment of Independent Child and Family Services Office h) Support establishment of National Child and Family Service Council i) Build the capacity of DfCD child protection team in systems based approach to child protection, in case management and other key competencies as found appropriate 3. Expected Deliverables Report on assessment of child protection sector capacity Five year costed whole of government plan for child protection including M&E framework Concept note for modelling of comprehensive child protection system Child protection sector financing and workforce development strategy Out of home care guidelines Progress report on establishment of Child and Family Service Council Progress on establishment of Independent Office of Child and Family Services 4. Duration of Contract The total contract duration for this assignment is six month. The contract will be implemented in two phases. The first phase of the contract starts on 1st September 2015 and ends on 30 November 2015. The second phase starts on 1st February 2016 to 31 May 2016. 5. Official Travel Involved The consultant will travel to PNG and work from the Office of the Department of Community Development. The consultant may occasionally travel to the field to participate on workshops related to the specific objectives of the consultancy. UNICEF will cover two return tickets (one for each phase of the contract) 6. Payment Schedule Payment will be effected on submission of progress report on deliverables as identified in section 3 of this TOR 7. Type of Supervision Required The consultant will work very closely with the Director for Office of Child Protection (Office of Lukautim Pikinini) and regularly brief the Secretary for Community Development along with the Director on progress of implementation of activities as identified in the TOR. Briefing session will be held before the assignment commences between the Consultant, the UNICEF Child Protection Team and the team from Department of Community Development to come to an understanding of the expectations from the consultancy including partnership arrangements. Regular bi-weekly meetings will be held between the consultant and supervisor to monitor progress, identify support requirements and make necessary adjustments. 05 May 2015 3 05 May 2015 4 9. Consultant Work Place The consultant will be based at the Office of the Secretary for Department of Community Development and work closely with Office of Child Protection in Port Moresby. The consultant will also participate in UNICEF regular child protection team meeting. 10.Penalty Clauses In case that the Consultant fails to submit the deliverables by the deadline, or should his/her performance not be of satisfactory quality, this office will reserve the right to withhold the payment until the deliverables meet the pre-established requirements. 11.Desired Background and Experience Advanced university degree in Social Work; psychology, international law or development studies At least 10 years’ experience at national and international level in systems building approach to child protection or social welfare system Solid experience in policy development and capacity building Experience in assessment, research and monitoring and evaluation Proven expertise and work record in working with national level government structures and coordinating different stakeholders. Excellent knowledge of English 12.Conditions The consultant will work from the office of DfCD in Port Moresby. The consultant may travel to the field to participate in activities related to the objectives of the consultancy.
