Item 9.1 - Is on the governing body of Aspin Park School ITEM 3 – KTC Public Speaking Session i) Resident re item 9.1 The resident outlined his concerns to members about speeding traffic on Wetherby Road in the vicinity of Aspin Park School. He explained to members that he had written to NYCC Highways last year, and had received a response to the effect that County Council will only act if there is a considered risk of collision and that speed limits are the jurisdiction of the police, not NYCC. The Mayor moved to item 9.1 and it was RESOLVED: 1) That KTC strongly support a 20 mph limit outside Aspin Park School. RESOLVED: 2) Look at the possibility of a flashing VAZ sign (Unanimous) 43 Council (Planning) 19 May 2014 RESOLVED: 3) That KTC write to North Yorkshire County Council informing them that hedges on Wetherby Road are overhanging, causing an obstruction for children accessing the school, and asking them to take urgent action. (Unanimous) ii) Resident re planning The Mayor moved to item 6 - (6.100.2911) and it was RESOLVED: KTC strongly objects to this proposal as the benefit of just nine houses is far outweighed by the adverse effects on public amenity and the Knaresborough Conservation Area. It is likely that the Harrogate District will have to provide a large number of houses per year, and Knaresborough may to accommodate it’s over all share. This will inevitably require building out into farmland, and the benefit from nine houses proposed here is almost insignificant. Abbey Road, in the Knaresborough Conservation Area, contributes greatly to public amenity. Abbey Road is used principally as a leisure route for walking and cycling, as well as being the only vehicular access to a small number of houses. A Traffic Regulation Order forbids motor vehicle access, except for access to premises. The road is divided by a barrier, restricting vehicular access from each end - no through traffic is allowed. Five public footpaths and one public bridleway terminate on Abbey Road, such that pedestrian traffic is directed onto Abbey Road. The river Nidd is close to the road at many points and glimpses of the river and countryside beyond are possible at various points along the road. There are no separate pavements anywhere along Abbey Road. The public amenity value of this leisure walking route is enjoyed by many residents and by visitors to the town. The open field proposed for houses presently provides a pleasant open space buffer between the walking route of Abbey Road and the existing housing beyond. Abbey Road is a mixture of various individual houses, interspersed with various green open spaces. Any proposal for housing along Abbey Road would lead to increased vehicular traffic along the pedestrian route, and would lead to a loss of this green open space. Both of these changes would have a serious adverse effect on the public enjoyment of this area. The proposal is contrary to policy HD3 of the Harrogate District local plan, Feb 2001. KTC Comments KTC objects to this landscaping application on the following planning grounds: Loss of public visual amenity caused by erection of fences along York Rd. The scale of this proposed fencing will give the development undue prominence in the streetscene. The plans as approved show a hedge with no fences along York Rd.This Council’s preferred option is for a hedge with no fences at any new development at entry to our town. The landscaping plan now shows fences alongside York Rd at heights of 1000/1200 mm and 1800mm. No reasons are given for exceeding the permitted development height of 1000mm; therefore the application for any roadside fence above 1000mm should be refused. (Unanimous) KTC neither objects nor supports this application but would comment that we are concerned about the proximity of the garage’s foundations to adjacent trees and the risk of damage to the roots. See above 14/085 * Item to be determined by Harrogate Borough Council Head of Planning or Chair of Planning Committee ** Item to be determined by HBC’s Planning Committee P14/089 ITEM 7 – Planning Correspondence 7.1 Planning Enforcements - None 7.2 Outcome of Investigation Case no: 4/00178/BRPC 04/06331/FUL - Scriven WI, Park Ave The outcome of the investigation is as follows: The householder had concerns regarding safety due to the garden being at a lower level than the adjacent land. Therefore a section of hedgerow was removed on the rear boundary of the property to allow works to take place to build a retaining wall and fence. The householder was unaware of the planning condition attached to the planning approval and therefore carried out the work without seeking permission. The matter has been discussed with the Council’s Landscape Architect and it is considered that whilst technically there is a breach of planning control the removal of the hedge to the rear of the property does not result in significant planning harm that would warrant further action RESOLVED: To receive and note (Unanimous) 7.3 Tree Preservation Order - 24/2014 - Castle Mills RESOLVED: That KTC neither object nor support this TPO but would comment we are concerned Harrogate Borough Council is trying to preserve trees which are becoming far too large for the area in which they are growing 46 Council (Planning) 19 May 2014 and sometimes would look for a replacement strategy. (Unanimous) P14/090 ITEM 8 – To note the date of HBC Planning Committee – Thursday, 29 May 2014, 2pm at Crescent Gardens, Harrogate at which the following applications for Knaresborough are to be discussed: None yet for Knaresborough P14/091 ITEM 9 – To consider the following correspondence: 9.1 Email from Mr M Willis regarding speed limit on Wetherby Road in the vicinity of Aspin Park School. RESOLVED: See P14/085 above. 9.2 To consider letter from Arboricultural Manager, Parks & Environmental Services, HBC concerning Knaresborough Castle Trees. RESOLVED: We should look at tree canopy reduction and of the three options presented, would support pollarding. (Unanimous) 9.3 To consider letter from Senior Project Engineer NYCC re 2014 urban grass cutting. RESOLVED: That KTC write to NYCC saying we do not think that use of volunteers is a sensible suggestion, due to the different bits of grass and boundaries. It is likely to cause the areas concerned to deteriorate through overgrowth and accumulation of rubbish. KTC would also remind NYCC that the residents of Knaresborough, along with other places, do pay their taxes for this service. (Unanimous) 9.4 To consider and authorise release of funds for project - email from Secretary of Knaresborough Cricket Club re commuted sums. RESOLVED: That KTC recognise that Knaresborough Cricket Club be granted £485 from commuted sums to do improvement works on their nets. (Unanimous) 9.5 To consider email from Area 6 Senior Project Engineer - License for Mother Shipton statue. Councillor Batt explained to members that KTC require a license from NYCC for the Mother Shipton statue to be seated in the Market Place and must confirm it is willing to take full responsibility for the statue’s maintenance and keeping in good order. NYCC has also pointed out that there is currently no license in place for the Blind Jack statue. Council (Planning) 19 May 2014 47 RESOLVED: That the Clerk checks the insurance position for both fixtures (Blind Jack and Mother Shipton) and if the extra cost is under £50 then the Clerk proceed with applying for a retrospective license for Blind Jack. He asked for the Clerk to write on behalf of KTC and thank them for an extremely good job done in terms of keeping the area clean and tidy, no dust etc. 2) Councillor Wright informed members that he is investigating the possibility of a national insurance plan which would embrace all areas in terms of insuring parish councils. 3) Councillor Handley informed members that three empty shops in the High Street are now being taken over. He also mentioned that Harvey Nichols may be considering a public shop in Knaresborough over the period 5/6 July and serving drinks and strawberries in the castle grounds. 4) Councillor Reid commented on the distribution of T-shirts to schools - she and Lori Handley had looked at hundreds - all will be erected in the castle and market place. Councillor Reid went on to thank everyone for making her last meeting a very pleasant one. 5) The Clerk informed members that she had received a positive response from Sayell Roth architects who had indicated they very much want to continue their involvement in the performance pavilion project.
