CONSIGNMENT AGREEMENT
Thanks for choosing to consign at our Best of the Rest Consignment Sales Event!
By signing below, you confirm that you have carefully read all of the published guidelines and procedures for a
‘Best of the Rest’ Consignment Sale Event by The White Elephant, Inc.; and, you agree to the terms for
consignment at the event as follows:
1. The Consignor is the owner of all goods consigned to The White Elephant, Inc. and has the legal right to enter
into this Consignment Agreement.
2. A Consignor Fee of $10 is prepaid at the time of registration to sell and covers the cost of event marketing and
publicity.
2. The White Elephant, Inc. retains the right to accept or decline any item for consignment and display items
accepted at their sole discretion. Pre-approval of furniture (if being accepted at the sale – see Acceptance
Guidelines for sale you are participating in) is required before drop off at the sale. If furniture that has been
provisionally approved by photo arrives with defects such as odors, pet hair or other damage not
visible/detectable in the photos The White Elephant, Inc. reserves the right to refuse consignment of those items
at drop off.
3. All items must be presented clean, complete and free of defects. All clothing must be presented, clean, wellpressed or dry-cleaned, on a hanger, in ready-to-wear condition; in season, free of defects and of the brands we
carry as stated in published Acceptance Guidelines for each sale and procedures.
4. Consignors must wait for our staff to perform a quality screening of their items and take back any No Thank You
(NTY) items. If the Consignor chooses not to wait, any NTY items will be disposed of or donated at our discretion
without further notice and Consignors will have no claim or recourse for NTY items The White Elephant, Inc. did
not accept.
5. The Consignor is responsible for registering, entering, printing tags, tagging, preparing and pricing their items
according to the published guidelines and procedures for the consignment sale event if the computerized system is
being used at the sale you are participating in.
6. The White Elephant, Inc. collects a commission on all goods sold equal to thirty percent (30%) of the list price of
hard goods and furniture and forty percent (40%) of the list price of clothing and accessory items. Not all sales will
accept all of these items. Please check the Acceptance Guidelines for the sale in which you participating.
7. A 1% credit/debit card processing fee will be deducted from Consignor net total sales after commission is
calculated to split the credit card fee between Consignor and The White Elephant, Inc. Credit card usage fees are
actually over 2%. A small buyer’s fee may be added to the sales price you set. Please note that the buyer’s fee will
not affect your consignor percentage.
8. All consignments must be dropped off during the specified drop off dates and times. Any consignments dropped
off outside the venue doors and/or after drop off hours will be disposed of with no recourse by Consignor.
9. Checks will be mailed within 10 days of the final day of the sale in the self-addressed, stamped envelope
provided by Consignor at the time of consignment drop off.
10. Retrieving Consignors must pick up unsold during the specified pick up date and times. If you do not pick up
your unsold items, they will become the property of The White Elephant, Inc. and will wither be donated to charity
or disposed of at our discretion.
11. The White Elephant, Inc., staff, any volunteers of a charity managing the sales floor, insurer and venue owner
where the event is held are released from any and all liability; and I waive and all claims for personal injury that
may result from participation in the event, for all cause, whether foreseen or unforeseen.
12. The White Elephant, Inc., staff, insurer and venue owner are held harmless from any and all claims, damages,
actions, liabilities and expense in connection with loss or damage by fire, theft, missing, lost or illegible tags or
other causes whatsoever. Insurance coverage remains the sole responsibility of the Consignor.
