A bill to be entitled
An act relating to labor organizations; amending s.
447.307, F.S.; requiring certain certified bargaining
agents to recertify as an employee organization by a
specified date; providing application; providing an
effective date.
Be It Enacted by the Legislature of the State of Florida:
Section 1. Subsection (5) is added to section 447.307,
Florida Statutes, to read:
447.307 Certification of employee organization.(5) A certified bargaining agent that represents less than
50 percent of the employees eligible for representation as
employee organization members must recertify the employee
organization as the exclusive collective bargaining
representative of all employees in the unit, pursuant to this
section, by July 1, 2011, or the certification of the employee
organization as the exclusive bargaining agent for the employees
in the bargaining unit is revoked. This subsection does not
apply to an employee organization, however organized or
constituted, that represents, or seeks to represent, employees
who are law enforcement officers, as defined in s. 943.10(1), or
firefighters, as defined in s. 633.30(1).
Section 2. This act shall take effect upon becoming a law.
