Terms of Reference Title: Consultancy to develop a Strategic Plan for the Independent Policing Oversight Authority (IPOA) of Kenya Organizational Section/Unit: UNODC Regional Office for Eastern Africa – “Promoting the Rule of Law and Human Security in Eastern Africa - The Police Reform Programme in Kenya – KENZ04 Duty station: Nairobi (Kenya) Proposed period: January to April 2014 (4 months) 1. Background of the assignment: UNODC assistance to Police reforms falls in line with its mandated activities which include upgrading crime prevention and criminal justice systems as well as promoting the Rule of Law. UNODC as the custodian of United Nations standards and norms in crime prevention and criminal justice holds a mandate to support Member States in building fair and effective criminal justice systems and developing crime prevention programmes. Over the past few years, Kenya has made significant strides in reforming the Police Sector. In August 2010, Kenyans adopted a new Constitution which establishes the National Police Service (NPS) consisting of the Kenya Police Service (KPS) and the Administration Police Service (APS). An InspectorGeneral (IG) is in charge of the NPS, with two Deputy Inspector-Generals (DIGs) being in charge of the KPS and APS respectively. In June 2011, the Government of Kenya (GoK) launched a Police Reform Programme entitled ‘Transforming the Police Force into an effective, efficient and trusted security agency for Kenyans’. The Police Reform Programme focuses on four key objectives which are to: a) Establish the legal and policy framework to govern policing in Kenya b) Establish effective, efficient and sustainable reform institutional structures c) Enhance professionalism, integrity and accountability of the NPS d) Strengthen operational preparedness and logical capacity and capability of the NPS. In November 2011, Parliament enacted the Independent Policing Oversight Authority (IPOA) Act to provide for civilian oversight over the work of the Police in Kenya. The Act stipulates the mandate of the Authority, which includes investigating all deaths and serious injuries caused by a member of the National Police Service (NPS) on duty or as a result of police action; receiving and investigating complaints from both members of the public as well as from police officers; investigating police misconduct on its own motion; making recommendations for disciplinary action or prosecution as well as recommendations to prevent future misconduct. The IPOA Board was officially sworn into office in June 2012. IPOA seeks to develop a comprehensive and integrated Strategic Plan (2014-2018) what is required for implementing the Police Reform Programme of the GoK. A publicized Strategic Plan and annual Work Plans, will set explicit marks for desired results and sharpen the IPOA’s institutional image. This is intended to focus public attention on the reform process and heighten the visibility of the IPOA’s leadership. Purpose of the assignment The purpose of the assignment is to IPOA in developing a comprehensive and integrated Strategic Plan (2014-2018) and the Annual Work Plan (2014-2015) to operationalize the mandate of IPOA and to support the transformation of the NPS into an effective, efficient and trusted security agency for Kenyans, in close consultation with relevant national and international stakeholders. 2. Specific tasks to be performed by the consultant: Under the overall supervision of the Representative in the UNODC Regional Office for Eastern Africa (ROEA) and the Head of the Criminal Justice Programme, and under the direct supervision of the Programme Coordinator (Police Reform) the incumbent will perform the following substantive duties and responsibilities: 3. Review and assess especially The Constitution 2010 of Kenya, Independent Policing Oversight Authority Act of 2011, National Police Service Act of 2011, The Police Reform Programme of the GOK, the Ransley Taskforce Report and other relevant documents such as the IPOA Baseline Survey of Policing Gaps and Standards; Assess recent and relevant strategies and policies in the Justice and Security Sector, international standards and norms, including a national and international stakeholder analyses, (such as from Civil Society Organizations, the NPS, National Police Service Commission (NPSC) and Development Partners); Assist and facilitate the IPOA Board and Staff to draft and finalize a Strategic Plan (2014-2018) and an Annual Work Plan (2014-2015), including an implementation plan, with an specific focus on Anti-Corruption, Gender and Human Rights mainstreaming and issues; Assist and facilitate the IPOA in the stakeholders’ consultation and validation process of the Strategic Plan (2014-2018), an Annual Work Plan (2014-2015) and facilitate relevant stakeholder consultations; Submit outcome-oriented interim reports (once a month and on UNODC’s or IPOA’s request) for the deliverable as per the agreed work plan and complete a comprehensive and outcome oriented final report no later than one (1) month after the end of the consultancy; and finally, Perform such other related tasks as required. Expected tangible and measurable output(s): A comprehensive assessment report with clear recommendations for the development and outlines for the implementation of the Strategic Plan (2014-2018) and an Annual Work Plan (2014-2015), including a comprehensive Action Plan for the development and implementation of this Strategy, in light of all relevant national legislative framework, policies and strategies and international standards and norms, considering the recommendation of various police reform documents; ToR Strategic Plan IPOA 2 Vienna International Centre │ PO Box 500 │ 1400 Vienna │ Austria Tel.: (+43-1) 26060-0 │ Fax: (+43-1) 26060-5886 A finalized and validated Strategic Plan (2014-2018) and an Annual Work Plan (2014-2015), including an implementation plan, with a specific focus on Anti-Corruption, Gender and Human Rights mainstreaming issues, developed in consultation with all relevant national and international stakeholders. Deliverables: A. B. C. 4. Work plan and a comprehensive assessment report with clear recommendations for the development and outlines for the implementation of the Strategic Plan (2013-2018), an Annual Work Plan (2014-2015) and a comprehensive Action Plan for the development and implementation of this Strategy, in light of all relevant national legislative framework, policies and strategies and international standards and norms, considering the recommendation of various police reform documents; A finalized and validated Strategic Plan (2014-2018) and an Annual Work Plan (2014-2015), including but not limited to: In light of all relevant national legislative framework, policies and strategies and international standards and norms, considering the recommendation of various police reform documents (e.g. Ransley-Report); With a specific focus on Anti-Corruption, Gender and Human Rights mainstreaming and issues; In consultation with all relevant national and international stakeholders, including but not limited to: Civil Society, NPS, NPSC and Development Partners; Formulation of the strategic objectives (long term and short term), results strategic indicators, activities, and timeframe that will lead to the expected scenario; Formulation of the organizational and managerial aspects of the Framework, namely the institutional responsibilities for the management and coordination of the implementation of the Strategic Plan 2014-2018, Plan of Action, and Work Plan 2013-2014 as well as the role and responsibilities of the institutions partaking; Formulation of resources – human, material and financial – necessary in order to implement the Framework’s activities. The Document should include a budget that relates inputs to outputs; A final and comprehensive and output oriented consultancy report not later than one (1) month after ending of the contract. Dates and details as to how the work must be delivered: The consultant will work under the overall supervision of the Regional Representative in the UNODC Regional Office for Eastern Africa (ROEA) and the direct supervision of the UNODC Police Reform Programme Coordinator. The consultancy is to be performed over a period six (6) months, starting in September 2013 ending in February 2014. 5. Interim reports and the comprehensive and impact oriented final report. Qualifications/expertise sought (required educational background, years of relevant work experience, other special skills or knowledge required): An advanced University Degree in Social Sciences, Police Studies, Law and/or such other relevant field; At least ten (10) years professional experience working with and/or providing technical assistance to governmental and/or international organizations on strategic planning in the police sector; At least 10 years’ experience in authoring scholarly papers and publishing in the relevant field of study; A thorough understanding of the area on police reforms in Kenya, through legislation, institutional set-up, administrative action and policy documents is a must; Previous experiences drafting strategic plans to security sector is a distinctive advantage; Excellent interpersonal and negotiation skills and ability to liaise and communicate effectively; Excellent English written and oral communication skills. 7.
