Athlete Release, Waiver of Liability, and covenant not to sue
I hereby acknowledge that my participation in physical training with CES Performance, LLC (CES Performance, LLC d/b/a Competitive
Edge Sports is hereinafter referred to as CES) may expose me to risks of property damage and bodily or personal injury, including, but
not limited to, sickness, broken bones, sprains, concussions, injury from balls, bats, weight lifting equipment and other athletic
equipment, drowning, heart attack, inclement weather, other injuries and/or death. I also fully understand the safety parameters
advised by CES and realize that without my complete cooperation to wear the proper athletic equipment, I increase my risks of property
damage, bodily or personal injury and/or death. I am fully aware and further understand that I may be exposed to other risks, which
may not be foreseeable, and I am assuming those risks and releasing CES. I acknowledge that training for which I am registering is a
strenuous activity which is beyond the capability of some people, and may cause minor, severe, and/or permanent injuries or death to
those people that are not in sufficiently physically conditioned, trained and/or experienced. I have made my own determination as to
whether or not I am able to safely participate in such training and I have consulted doctors and/or medical professionals of my
choosing to clear me for such training. I hereby elect to voluntarily participate in physical training with CES with full knowledge that such
activity may be hazardous to me. I HEREBY VOLUNTARILY ASSUME RESPONSIBILITY FOR ANY AND ALL SUCH RISKS, WHETHER
CAUSED BY THE NEGLIGENCE OF CES OR OTHERWISE.
In sole consideration of CES’s knowledge, expertise, and efforts expended on my behalf, I HEREBY AGREE TO AND DO HEREBY RELEASE
AND FOREVER DISCHARGE CES, ITS MEMBERS INDIVIDUALLY, AND ITS OFFICERS, AGENTS AND EMPLOYEES FROM ANY AND ALL
LIABILITY, CLAIMS, DEMANDS, ACTIONS AND CAUSES OF ACTION WHATSOEVER ARISING OUT OF OR RELATED TO ANY LOSS,
INJURY, INCLUDING DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR THE CONSEQUENCES THEREOF, THAT MAY BE
SUSTAINED BY ME, RESULTING FROM OR IN ANY WAY CONNECTED WITH MY PARTICIPATION IN TRAINING WITH CES, WHETHER
CAUSED BY THE NEGLIGENCE OF CES, ITS OFFICERS, MEMBERS, AGENTS OR EMPLOYEES, OR OTHERWISE.
As partial consideration for the services provided by CES to me under this agreement, I hereby grant CES a limited license to use my
name, image, voice, likeness, attributes and biography for and in connection with the advertising, publicizing, promotion of CES and
related businesses. This includes, but is not limited to, the development, distribution, and monetization of television programs or other
video content featuring video footage of me over broadcast television stations, the internet and/or any other media.
I agree that this RELEASE, WAIVER OF LIABILITY AND COVENANT NOT TO SUE is to be construed under the laws of the State of Texas
and that if any portion is held invalid or unenforceable, the remainder shall, notwithstanding, continue in full legal force and effect.
I further agree that for the consideration stated above, I will not sue CES, its members individually, its officers, agents and employees
from any claim for damages resulting from or in any way connected with my participation in training with CES.
It is my express intent that this RELEASE, WAIVER OF LIABILITY AND COVENANT NOT TO SUE shall bind both me and my family
members, if I am alive, and my heirs, assigns, personal representatives and administrators, if I am deceased, and shall be deemed as a
RELEASE, WAIVER OF LIABILITY AND COVENANT NOT TO SUE CES, ITS MEMBERS, OFFICERS, AGENTS OR EMPLOYEES.
By signing this document below, I hereby certify, acknowledge and represent that I have read this entire RELEASE, WAIVER OF LIABILITY
AND COVENANT NOT TO SUE, that I understand its terms, that I am giving up legal rights that I might otherwise have, and that I have
signed it knowingly and voluntarily as my own free act and deed. No oral representations, statements, or inducements, other than the
foregoing written Release, Waiver of Liability, and Covenant Not to Sue, have been made. I am at least eighteen (18) years of age and
am fully competent to execute this RELEASE, WAIVER OF LIABILITY AND COVENANT NOT TO SUE. I execute this RELEASE, WAIVER OF
LIABILITY AND COVENANT NOT TO SUE for fully, adequate, and complete consideration and fully intend to be bound by the same.
I agree that any action, suit or proceeding relating to, arising out of or in connection with the terms, conditions and covenants of this
agreement may be brought only in Lubbock County, Texas. I hereby waive any objection to jurisdiction or venue in any proceeding filed
within the above referenced County in relation to this agreement.
I have read and understand the effects of this agreement and execute the same at my own free will and accord for the purposes and
consideration set forth herein.
I AGREE I HAVE BEEN INFORMED OF MY RIGHT TO CONSULT WITH AND RETAIN AN ATTORNEY FOR THIS MATTER. I FURTHER
AGREE I HAVE BEEN INFORMED THAT I AM NOT REQUIRED TO AGREE TO OR EXECUTE ANY DOCUMENT WITHOUT THE ADVICE
OF AN ATTORNEY.
