Date: July 3, 2014
Secretary Appointment:
A motion was made by Ron Engel to appoint Tim Schaumberg as the secretary. This motion was
seconded by Denise Meyer.
Roll Call:
Meeting was called to order at 7:00 P.M. by Chairperson Dustin Westphal. Board of Appeals members
present were Ron Engel, Denise Meyer, Gerry Schmitz, Keith Peters and Tim Schaumberg.
Open Meeting Notice:
Chairperson Dustin Westphal confirmed that this meeting was posted in the Fond du Lac Reporter as
well as the three posting sites in the township as required.
Overview of the Application:
o Eden Stone is requesting a conditional use permit for non-metallic mining
o Legal description of property as follows: W4520 Lime Road located SW1/4, SW1/4,
Section 11, T14N, R17E, Town of Byron, Fond du Lac County, WI
o Marty Biller of Eden Stone showed the boundaries of the proposed quarry site. They
would like to start in the northwest corner of property and work out from there because
this is where they would like a retention pond on the property
Public Comments on Application:
There were no public comments on the application.
Discussion and Deliberation by the Board:
o Chairperson Dustin Westphal advised the Board that Halquist Stone submitted a letter
in opposition to the proposed quarry. He also told the Board to not consider what
happened in the Town of Brotherton
o It was noted by Chairperson Dustin Westphal that Eden Stone has not submitted a
reclamation plan. Wendy Giese, County Non-metallic Mining Reclamation Specialist,
confirmed that the County did not receive a reclamation plan.
o Gerry Schmitz noted that the location was good based on the proposed quarry
bordering existing quarries
o Gerry Schmitz noted that a deposit for area wells be obtained
o Tim Hackbarth pointed out the need for the road to be watched for damage and that if
damaged would be fixed by Eden Stone
Decision of Board of Appeals:
Ron Engel made a motion to table the application of the new Eden Stone quarry until a reclamation plan
is submitted. The motion was seconded by Tim Schaumberg.
