ACKNOWLEDGEMENT OF CONDITIONS OF FINANCIAL ASSISTANCE
FINANCIAL ASSISTANCE FOR:

By accepting financial assistance from the Australian Government, you should be aware of
the following conditions which may affect the validity of your Australian travel document:
a)
The travel document may be cancelled if you do not repay the loan in full by the due
date and if alternative repayment arrangements are not in place. This cancellation
may occur while you are outside Australia.
b) The travel document may be cancelled upon your return to Australia.
c) If cancelled, travel documents will no longer be valid for travel and cannot be
reinstated.
d) An application for a replacement travel document may be refused until the debt is
repaid in full.
e) You will need to pay the standard passport application fees when replacing a
cancelled passport.
f) The travel document may be demanded for surrender upon your return to Australia.
Failure to surrender an Australian travel document on demand by an authorised
officer may be a criminal offence.
Section 48 of the Australian Passports Act 2005 provides for a right of review for decisions
including when a travel document is cancelled or demanded for surrender. The Freedom of
Information Act 1982 provides you with a right to apply for access to documents about this
decision. Further information regarding the department’s Freedom of Information policy is
available at http://dfat.gov.au/foi/.

NOTICE OF RIGHTS OF REVIEW
1. You may apply in writing for an internal review of the decision in accordance with
section 49 of the Australian Passports Act 2005 (the Act). The Act requires the
Department of Foreign Affairs and Trade (DFAT) to undertake an internal review of a
decision before you can apply for review by the Administrative Appeals Tribunal.
2. You are not required to pay any fees for an internal review of the decision.
3. The Minister for Foreign Affairs has delegated power to review decisions of this kind
to the Corporate Counsel, Corporate Legal Branch, DFAT. This officer has had no
part in the original decision and has the power to affirm, vary or set aside and
substitute a new decision for the original decision.
4. Your application for review must be made within 28 days after you receive this notice
and must set out your reasons for making the application. Applications should be sent

5. To review the decision, the internal reviewer will have access to all documents related
to the original passport decision. Under the Freedom of Information Act 1982, you
also have a right to apply for access to these documents should you wish. Applying
under Freedom of Information is a separate process which will not affect the outcome
of the internal review. Note that the information you can obtain under Freedom of
Information is limited. In particular, if you are seeking to access information
provided to DFAT by someone other than you, we are required to consult with that
person before releasing their information to you.

provide sufficient information to allow DFAT to identify the documents sought and
include a telephone number and an address (or email address) to which notifications
