Proposal for On-Call Pavement Engineering Services
Tom,
In regards to our recent discussion, please find my (MSK) proposed fee to provide on-call consultation services for
the Colorado Asphalt Pavement Association (CAPA). Services may include; pavement engineering consultation and
technical services, marketing support, industry involvement and new business development as requested by CAPA.
These services will be provided on a unit rate basis as follows:
Senior Pavement Engineer
$120/hr. (includes travel expenses for Front Range services)
Sub consultant (as needed)
cost +15%
In providing opinions of probable costs, LCCA or schedule, it is recognized that neither CAPA nor MSK has control
over the costs of labor, equipment or materials, or over contractors/producers methods of determining prices or
time. The opinions of probable cost, LCCA or project duration are based on CAPA’s and MSK’s reasonable
professional judgment and experience and do not constitute a warranty, express or implied, that the Contractor’s
bids, project schedules, or the neglected price of work or schedule will not vary from CAPA’s opinion of probable
cost, LCCA or project schedule prepared by MSK. Exact costs and times will be determined only when bids have
been received for Project.
CAPA releases MSK from any liability and agrees to defend, indemnify and hold MSK harmless from any and all
claims, damages, losses, and/or expenses, direct or indirect, or consequential damages, including but not limited
to attorney’s fees and charges and court and arbitration costs, arising out of, or claimed to arise out of, the
performance of the Services, excepting liability arising from the negligence or willful misconduct of MSK.
Work to date will be invoiced monthly with a total contract amount not to exceed $12,000. Please sign a copy of
this agreement and return for my records.
