I.
Call to Order
Following the welcome, Pledge of Allegiance and introductions, President Gayle C.
Manchin called the meeting of the West Virginia Board of Education (WVBE) to order at 10:15
a.m. on March 11, 2015, in the Capitol Room, Capitol Building 7, 1900 Kanawha Boulevard,
East, Charleston, West Virginia.
The following members were present: President Manchin, Vice President Michael I.
Green, Thomas W. Campbell, Lloyd G. Jackson II, Beverly E. Kingery, L. Wade Linger Jr., and
James S. Wilson and ex officios Michael J. Martirano, State Superintendent of Schools, Paul L.
Hill (joined meeting at 1:00 p.m.), Chancellor, West Virginia Higher Education Policy
Commission, and James L. Skidmore (joined meeting at 1:35 p.m.), Chancellor, West Virginia
Council for Community and Technical College Education. Members absent were: Tina H.
Combs and William M. White.
II.
Approval of Agenda
President Manchin called for a motion to approve the agenda. Mr. Linger moved that the
agenda be approved. Mr. Campbell seconded the motion and upon the call for the question the
motion was carried unanimously.
III.
WVBE Work Session
Cohesive Leadership Systems: Policies and Practices to
Support Instructional Leadership in Schools
Dr. Jacquelyn O. Wilson (distributed information), Director, Delaware Academy for
School Leadership, and Director, Graduate Programs, Southern Delaware, University of
Delaware, led the Board through activities and a discussion about the primary components of a
cohesive leadership system; components included standards, pre-service preparation/principal
pipeline, licensure and certification, coaching and mentoring programs, professional
development, and performance evaluation for school leaders. Superintendent Martirano departed
the meeting and Mr. Charles K. Heinlein, Deputy Superintendent of Schools, was seated.

IV.
Recess
President Manchin commended the West Virginia Department of Education (WVDE) and
WVBE staffs for the work that has taken place during the legislative session. President Manchin
recessed the meeting for lunch at 11:55 a.m.

President Manchin called the meeting back to order at 1:00 p.m.
VI.
Real World Learning
Mr. Green, assisted by Mr. Sterling Beane, Chief Officer, Division of Technology,
welcomed Union Elementary School, Upshur County (via live video stream). Dr. Sara Stankus,
Principal, staff and students provided information regarding the integration of technology in the
classroom and Digital Learning Day activities at Union Elementary School. Mr. Beane read a
Proclamation issued by Governor Earl Ray Tomblin declaring March 14, 2015, as Digital
Learning Day.
VII.
National Youth Science Foundation (NYSF)
The Honorable Ronald G. Pearson (distributed information), Chief Judge, U.S.
Bankruptcy Court for the Southern District of West Virginia, and Chairman, NYSF, and, Dr.
Andrews N. Blackwood, Executive Director, NYSF, provided information regarding NYSF's
proposal to acquire the facilities of the Canaan Valley Institute and transform them into the
STEM Education Center. (Copy appended to Official Minutes, Attachment L.)
VIII.
Delegations
Ms. Liza Cordeiro, Executive Director, WVDE Office of Communications, announced
that all individuals wishing to address the Board as a delegation would be given two minutes.
The following delegations addressed the Board regarding the Fayette County Comprehensive
Education Facilities Plan: Ms. Lindsey A. Tolley, Ms. Melissa Crane, Ms. Sandra Harkins
(distributed information), Mr. Jason Crouch, Mr. Bruce Hanshew, Mr. Scott Ingleton, Ms.
Carolyn Arritt (distributed information), Ms. Celi VanDyke, and Ms. Teri Harlan. (Copies

IX.
Update - WVBE Response to Governor's Education Agenda
Ms. Donna Hoylman Peduto (distributed information), WVBE Director of Operations,
assisted by President Manchin and Mr. Jackson, provided an update regarding progress toward
accomplishing the Governor's education agenda including the key provisions of the Governor's
request of the WVBE. (Copy appended to Official Minutes, Attachment Mc.)
WVBE Finance Committee. Mr. Campbell provided an update on behalf of the Finance
Committee regarding counties on the fund balance watch list and status of the current budget bill.
X.
Chancellor Reports
Chancellor Hill commented on the strong working relationship with the WVBE, WVDE
and Superintendent Martirano and provided information regarding joint research on student
performance and mediation efforts once a student enters college. Chancellor Skidmore provided
-3an update on the implementation plan for the Southern Regional Education Board pathways and
college transitioning initiatives.
XI.
WVBE Coordinator of Board Agencies Report
Mr. Jason L. Butcher, WVBE Coordinator of Board Agencies, provided an update
regarding his work in conjunction with WVBE agency protocols.
XII.
West Virginia Department of Education Office of Institutional
Education Programs (OIEP) Report
Mr. Jacob Green, Special Assistant, and Dr. Christi Chambers, Assistant Director,
WVDE OIEP, provided an update regarding improvements in the provision of OIEP services.

XIII.
WVBE Regional Education Service Agency (RESA) Liaison Report
Mr. Butcher provided a report on behalf of the RESAs.
XIV.
Capacity Building for Priority Schools and Intervention Counties
Ms. Michele Blatt, Chief Officer, Division of Accountability and Performance for School
Effectiveness, and Mr. Ted Mattern, System Support Liaison, Office of the State Superintendent,
provided information regarding support services provided to priority schools and intervention
counties. Dr. Lynn Boyer, Superintendent, West Virginia Schools for the Deaf and the Blind
(WVSDB), provided an update regarding legislation affecting the WVSDB.

President Manchin called for a break at 2:50 p.m. Chancellor Hill departed the meeting.

President Manchin called the meeting back to order at 2:55 p.m.
XVII.
Superintendent's Report
Deputy Superintendent Heinlein, assisted by WVDE staff as noted, provided updates
regarding secondlaunchWV (Mr. Beane); 2014 Advanced Placement cohort data (Mr. Clayton
Burch, Chief Officer, Division of Teaching and Learning - distributed information); status of
Senate Bill 537, school calendars (Mr. Burch and Ms. Heather Hutchens, General Counsel,
WVDE - distributed information); and legislative updates particularly House Bill 2005,
alternative teacher preparation programs (Ms. Hutchens); Senate Bill 14, creating Charter
Schools (Ms. Mary Catherine Funk, General Counsel to the WVBE). Ms. Hutchens provided
brief remarks regarding House Bill 2934, Common Core standards; Senate Bill 7, Cardio
Pulmonary Resuscitation and care for conscious choking instruction in public schools; Senate
-4Bill 238, limiting county board of education liability arising from unorganized recreation; and
House Bill 2669, relating to compulsory tuberculosis testing. (PowerPoint presentation and

Consent Agenda
Mr. Linger moved that the Consent Agenda be approved. Mr. Campbell seconded the
motion and upon the call for the question the motion was carried unanimously. (Copies

Approved minutes of February 12 and 27, 2015 (Attachment A)

Received WVDE personnel matters (Attachment B)

Approved a waiver request of Policy 2445.44, to utilize the Reasoning Mind
Algebra Readiness Program, as an instructional material for mathematics, grade
5, for Calhoun County Schools (Attachment C)

Received notification, per W. Va. Code §18A-4-7a(l)(3), Transfer of Person
Employed in a Professional Position after the Twentieth Day Prior to the
Beginning of the Instructional Term, from Ohio County Schools
(Attachment D)

Approved Policy 4350, Procedures for the Collection, Maintenance and
Disclosure of Student Data (Attachment E)

Approved Alderson-Broaddus University's new Teacher-in-Residence Program
(Attachment F)

Approved West Virginia Wesleyan College's new Teacher-in-Residence
Program (Attachment G).
Process for Submission of Waiver Requests of W. Va. Code §18-5-45
Ms. Hutchens presented a proposed process (Attachment O) for the submission of waiver
requests of W. Va. Code §18-5-45 for the Board's consideration; the process is proposed should
Senate Bill 537 not be passed during this current legislative session. Superintendent Martirano
returned to the meeting.
Mr. Green moved that the process for the submission of waiver requests of W. Va. Code
§18-5-45 be approved and used in the event Senate Bill 537 is not passed. Mr. Campbell
seconded the motion and upon the call for the question the motion was carried with six members
voting yes and one member, Mr. Linger, voting no. Chancellor Skidmore departed the meeting.

WVBE Personnel Matters inclusive of: 1) Update and Discussion with Counsel
regarding Pending Legal Matters including Marple v. West Virginia
Board of Education and White v. Randolph County, et al., and 2) Student Specific
Waiver Request from a West Virginia County Board of Education
Executive Session
President Manchin called for a motion to move into executive session as provided in
W. Va. Code §6-9A-4(b)(2)(A) [personnel exception] and/or §6-9A-4 [matters involving
attorney-client privilege per Peters v. County Commission, 205 W. Va. 481 (1999)]; and W. Va.
Code §6-9A-4(b)(6) [student specific personal circumstances].
Mr. Green moved, in accordance with W. Va. Code §6-9A-4(b)(2)(A) [personnel
exception] and/or §6-9A-4 [matters involving attorney-client privilege per Peters v. County
Commission, 205 W. Va. 481 (1999)]; and W. Va. Code §6-9A-4(b)(6) [student specific personal
circumstances] that the Board move into executive session. Mr. Campbell seconded the motion
and upon the call for the question the motion was carried unanimously. The Board moved into
executive session at 4:06 p.m.
XXI.
Return from Executive Session
Ms. Funk reported that Mr. Campbell moved that the Board return from executive session
and that Mr. Jackson seconded the motion. President Manchin, in open session, called for a
motion to return from executive session. Mr. Campbell moved, and Dr. Wilson, seconded that
the Board return from executive session. The Board returned from executive session at 5:40 p.m.
Mr. Linger moved that the student specific waiver request be approved. Mr. Jackson
seconded the motion and upon the call for the question the motion was carried unanimously.
Ms. Kingery moved that the Board's personnel attachment be approved. Mr. Linger
seconded the motion and upon the call for the question the motion was carried unanimously.

XXII.
Office of Education Performance Audits (OEPA)
Director’s Information
Ms. Susan O'Brien, Director, Office of Education Performance Audits, provided
information regarding RESA 6 and RESA 7 data trends. Mr. Jackson departed the meeting.
XXIII.
Initial On-Site Reviews for Schools Located in RESA 6
Ms. O'Brien presented initial on-site reviews for schools located in RESA 6 for the
Board's consideration. The Legislature amended and reenacted W. Va. Code §18-2E-5, by Senate
Bill 359, which led to the WVBE repeal and replacement of Policy 2320, A Process for
Improving Education: Performance Based Accreditation System. The primary focus of the new
accreditation process is providing feedback on practices and processes that correlate with high
student success and improvement and continuous improvement of all schools. Policy and Code
-6compliance are also monitored. In response to Policy 2320 (effective July 1, 2014) and the
direction of the WVBE, the OEPA instituted Initial On-Site Reviews of the High Quality Process
Standards in all West Virginia public schools during the 2014-2015 and 2015-2016 school
years. Beginning with school year 2016-2017, the OEPA will conduct on-site reviews of each
school in the state once every four years.
Ms. O'Brien reported that all public schools in the five school systems located in RESA 6
(Brooke, Hancock, Marshall, Ohio and Wetzel counties) participated in on-site reviews during
November and December 2014 (http://oepa.state.wv.us/documents/RESA6/sobrienRptsRESA6.pdf).
Mr. Campbell moved that the individual school reports be approved and any school in
which a function rating was lowered to emerging or unsatisfactory or policy or Code was found
non-compliance be required to revise the strategic plan within 30 days and begin corrective
action. Dr. Wilson seconded the motion and upon the call for the question the motion was

XXIV.
Items for Future Consideration
It was requested that members notify the Board's secretary of items for placement on the
April meeting agenda. (Copy appended to Official Minutes, Attachment J.)
XXV.
Future Meetings
President Manchin stated that the next regular meeting of the WVBE will be held April 8,
2015, in Charleston, West Virginia. The meeting will continue on April 9, 2015, if the agenda is
not completed on April 8, 2015.
XXVI.
Adjournment
Mr. Campbell moved that the meeting be adjourned. Mr. Green seconded the motion and
upon the call for the question the motion was carried unanimously. The meeting was adjourned
at 5:53 p.m.
