MINUTES WEST VIRGINIA BOARD OF EDUCATION Capitol Building 6, Room 353 1900 Kanawha Boulevard, East Charleston, West Virginia August 12, 2015 I. Call to Order Following the welcome, Pledge of Allegiance and introductions, President Michael I. Green called the meeting of the West Virginia Board of Education (WVBE) to order at 10:08 a.m. on August 12, 2015, in Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia. The following members were present: President Green, Vice President Lloyd G. Jackson II, Secretary Tina H. Combs, Thomas W. Campbell (via telephone), Beverly E. Kingery, L. Wade Linger Jr., Gayle C. Manchin, and James S. Wilson, and ex officios Michael J. Martirano, State Superintendent of Schools, Paul L. Hill, Chancellor, West Virginia Higher Education Policy Commission, and Sarah Armstrong Tucker, Interim Chancellor, West Virginia Council for Community and Technical College Education. Member absent was William M. White. II. Approval of Agenda President Green requested that New Business item A. WVBE Personnel Matters inclusive of the Personnel Attachment, Interview of Candidate(s) for the Position of Superintendent of the West Virginia Schools for the Deaf and the Blind, and Fayette County Schools' Possible Purchase of Real Property be amended to remove "Fayette County Schools' Possible Purchase of Real Property" and called for a motion to approve the agenda as amended. Mr. Jackson moved that the agenda be approved. Mrs. Manchin seconded the motion and upon the call for the question the motion was carried unanimously. President Green addressed the assembly regarding his leadership style and the Board's commitment fight for West Virginia's children, teachers, and support personnel that deserve the best educational ecosystem the Board can give them. III. Introduction of West Virginia Japanese Outreach Initiative (JOI) Coordinator Ms. Michele Blatt, Chief Officer, Division of School Effectiveness, introduced West Virginia's JOI Coordinator, Megumi Homma. West Virginia was selected as one of only four sites nationally to host a JOI Coordinator. Through a collaborative endeavor, the West Virginia Department of Education (WVDE), the International Division of the West Virginia Development Office, the West Virginia Higher Education Policy Commission, and the Education Alliance will support the establishment of a Charleston-based JOI Program over the next two years. Through funding from the Japanese Foundation, Megumi Homma, the assigned West Virginia JOI Coordinator, will serve the greater West Virginia community by facilitating opportunities for K-12 schools, higher education, and business to gain a unique perspective and enhanced understanding of Japanese language and culture. The JOI Program will provide students and local educators an opportunity to participate in a variety of targeted educational activities focused on language and culture for the purpose of increasing learner global competence. Mr. -2Jackson spoke regarding his recent trip to Japan with Governor Tomblin and the honor bestowed on West Virginia to be selected to host a JOI Program. IV. Delegations Ms. Kristin Anderson, Executive Director, WVDE Office of Communications and Partnerships, announced that delegations would be provided two minutes. Mr. Randall Patterson, Ms. Shawna Sparks (distributed information), Ms. Amanda Skaggs, and Ms. Carolyn Arritt (distributed information), regarding Fayette County Schools. (Copies appended to Official Minutes, Attachment Q.) V. Consent Agenda President Green requested a motion to approve the Consent Agenda. Mrs. Manchin moved that the Consent Agenda be approved. Approved minutes of July 8, 2015 (Attachment A) Received WVDE personnel matters (Attachment B) Approved the West Virginia School for the Deaf's request for a first time waiver and South Charleston High School's request for a continuation waiver of WVBE policies (Attachment C) Approved 2015 summer school programs (Attachment D) Approved Davis & Elkins' Reading Education/Elementary (K-6) Program. Statewide Master Plan for Professional Learning 2015-2016 Mrs. Manchin and Mr. Jackson presented the Statewide Master Plan for Professional Learning 2015-2016 for the Board's consideration. W. Va. Code §18-2I-3 requires the WVBE to establish an annual master plan for professional development in the public schools of the state. Upon approval of the plan, the WVBE shall submit the master plan to the WVDE, the Center for Professional Development, the regional educational service agencies, the Higher Education Policy Commission and the Legislative Oversight Commission on Education Accountability. Mr. Jackson moved that the Statewide Master Plan for Professional Learning 2015-2016 be approved. New Student Data Collection Element Ms. Blatt presented a new student data collection element for the Board's consideration. Following a review of legal requirements per the Elementary and Secondary Education Act (ESEA), the WVDE Office of Federal Programs (OFP) determined that current information within the student data system was insufficient to accurately determine students’ immigrant -3status. The OFP proposes including one additional item in the basic information collected about students at enrollment: an indicator of student country of birth. The information will ensure that WVDE is able to appropriately distribute funds to serve the needs of students in districts with immigrant populations. Mr. Linger moved that the new student data collection element be placed on public comment for 60 days. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment G.) VIII. Policy 2422.7, Standards for Basic and Specialized Health Care Procedures Ms. Blatt presented Policy 2422.7 for the Board's consideration. Policy 2422.7 and the accompanying Procedure Manual received two comments during the 30 day comment period. No changes were made as a result of comments. The policy and manual outline the safe and standard of care for performing, delegating and assigning health care procedures during curricular and co-curricular activities. The chief authority of this policy is W. Va. Code §18-522 (school nurses) and W. Va. Code §30-7-1 (Registered Professional Nurses), along with the designated review and revision of school health care procedures by the West Virginia Council of School Nurses. The policy and manual outline standards of care for specific medical provider ordered specialized healthcare procedures provided under the auspices of the certified school nurse RN to ensure that safe and quality healthcare is provided to students in West Virginia public schools. Mr. Jackson moved that Policy 2422.7 be approved. Dr. Wilson seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment H.) IX. Policy 2423, Health Promotion and Disease Prevention Ms. Blatt presented Policy 2423 for the Board's consideration. Policy 2423 was placed on public comment as a result of legislative changes during the 2015 session related to House Bill 2669-TB Testing in Schools, Senate Bill 286-Immunizations for School Entry and Progression, and expansion of Governor's KidsFirst Initiative for health promotion through proof of well child screenings (WV HealthCheck) at grades 2, 7, and 12 with a phase-in plan over the next five years. Three comments were received during the public comment resulting in appropriate editorial changes and additional language for county boards of education to consider providing community service time for high schools students who show proof of their annual flu vaccination. Ms. Kingery moved that Policy 2423 be approved as amended. Dr. Wilson seconded the motion and upon the call for the question the motion was carried unanimously. WVBE Personnel Matters inclusive of the Personnel Attachment, Interview of Candidate(s) for the Position of Superintendent of the West Virginia Schools for the Deaf and the Blind, President Green called for a motion to move into executive session as provided in W. Va. Code §6-9A-4(b)(2)(A) [personnel exception] and/or §6-9A-4 [matters involving attorney-client -4privilege per Peters v. County Commission, 205 W. Va. 481 (1999)], and W. Va. Code §6-9A-4(b)(9), To consider matters involving or affecting the purchase, sale or lease of property, advance construction planning, the investment of public funds. Mr. Jackson moved that the Board enter into executive session. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. The Board moved into executive session at 11:00 a.m. President Green informed the assembly that the Board would remain in executive session through lunch with an expected return time of 1:00 p.m. Chancellor Tucker departed the meeting. XI. Return from Executive Session President Green called for a motion to return from executive session. Mr. Linger moved that the Board return from executive session. Dr. Wilson seconded the motion and upon the call for the question the motion was carried unanimously. The Board returned from executive session at 1:25 p.m. President Green called for a motion to approve the Board's personnel items found in the attachment. Mr. Jackson moved that the personnel items be approved. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. Chancellor Hill joined the meeting. Policy 2520.5, Next Generation Health Education 5-12 Content Standards and Objectives for West Virginia Schools Mr. Clayton Burch, Chief Officer, Division of Teaching and Learning presented Policy 2520.5 for the Board's consideration. Senate Bill 7, W. Va. Code §18-2-9 (b) states, "After July 1, 2015, the required instruction in cardiopulmonary resuscitation (CPR) shall include at least thirty minutes of instruction for each student prior to graduation on the proper administration of CPR and the psychomotor skills necessary to perform CPR"; Policy 2520.5 has been revised to require all high school students to receive CPR training. One comment was received during the comment period and did not pertain to the policy. Mrs. Manchin moved that Policy 2520.5 be approved. Ms. Kingery seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment J.) XIII. Policy 2520.16, Next Generation Alternate Academic Achievement Standards for Science in West Virginia Schools Mr. Burch, assisted by Ms. Annette Carey, Coordinator, WVDE Office of Special Programs, presented Policy 2520.16 for the Board's consideration. Policy 2520.16 is being repealed and replaced with the Next Generation Alternate Academic Achievement Standards for Science in West Virginia Schools. This action will ensure alignment of West Virginia's alternate academic achievement standards with the Next Generation Content Standards and Objectives and the alternate assessment in the area of science consistent with ESEA requirements and the ESEA Flexibility Request. Policy 2520.16 defines the alternate academic achievement standards in science for elementary, middle, and high school students with the most significant cognitive disabilities. -5Mr. Linger moved that Policy 2520.16 be placed on public comment for 30 days. Policy 2525, West Virginia Universal Access to Early Education System Mr. Burch, assisted by Ms. Janet Bock-Hager, Coordinator, WVDE Office of Early Learning, presented Policy 2525 for the Board's consideration. Several changes in requirements related to WV Universal Pre-K necessitate updates to Policy 2525 to ensure continued alignment to related WVBE policies, Head Start Federal requirements, and evolving continuous quality improvement strategies in WV Universal Pre-K Programs. Policy 2525 changes include provisions to ensure collaboration with existing programs as required by W. Va. Code §18-5-44. Updates reflect health enrollment requirements from Policy 2423, Health Promotion and Dental Prevention, specifically related to dental examinations. Policy changes reflect the title change of the Universal Pre-K Formative Assessment System to align with other grades. Revisions reflect changes to W. Va. Code §18-5-18 addressing changes to Early Childhood Classroom Assistant Teachers eligible for retirement by 2020. Changes to Policy 2525 also include updates to WV Universal Pre-K Program Assessment and Continuous Quality Improvements to address current needs and collaborative requirements in health and safety assurance. Adjusted definitions reflect policy changes. Revisions to Policy 2525 meet W. Va. Code changes, align with federal collaborative requirements, and provide a continued focus on healthy and safe high-quality educational programs to all eligible pre-k students. Mrs. Manchin moved that Policy 2525 be placed on public comment for 30 days. Mr. Linger seconded the motion and upon the call for the question the motion was carried unanimously. Superintendent Reports Assessment Update - Superintendent Martirano addressed the assembly regarding assessment and assisted by Dr. Vaughn Rhudy (distributed information), Executive Director, WVDE Office of Assessment and Research, and provided current preliminary statewide assessment results. Chancellor Hill and Dr. Corley Dennison (PowerPoint presentation), Vice Chancellor for Academic Affairs, West Virginia Higher Education Policy Commission (HEPC), provided information regarding revisions to HEPC Series 21 to accept level 3 or 4 on the grade 11 assessment for ELA and math as an indicator of college readiness. Mr. Burch (distributed information) provided information regarding the Academic Spotlight website and specifically the family page. Data Privacy - Ms. Heather Hutchens, WVDE general counsel, provided information regarding data privacy. Truancy Diversion - Ms. Sarah Stewart, Executive Director, WVDE Office of Policy and Government Relations, provided information regarding truancy diversion and applications for funding. Academic Spotlight Update - Ms. Stewart provided an academic spotlight update; the location of Town Hall meetings will be placed on the website once confirmed. Capacity Building for Priority Schools and Intervention Counties Ms. Blatt provided a brief update regarding support services provided to priority schools. Policy 3233, Establishment and Operation of Regional Education Service Agencies Ms. Mary Catherine Tuckwiller, WVBE general counsel, presented Policy 3233 for the Board's consideration. Changes to Policy 3233 will align code revisions from the 2015 legislative session to update technology terminology and confirm the responsibilities of each regional council. Mrs. Manchin moved that Policy 3233 be placed on public comment for 30 days. Mrs. Combs seconded the motion and upon the call for the question the motion was carried unanimously. Appointments to WVBE Statutory Units/Liaisons/Presidential Committees 2015-2016 President Green, assisted by Ms. Donna Hoylman Peduto (distributed information), WVBE Director of Operations, presented appointments to WVBE statutory units/liaisons/Presidential committees 2015-2016 for the Board's consideration. Mr. Jackson moved that the appointments to WVBE statutory units/liaisons/Presidential committees 2015-2016 be approved. Office of Education Performance Audits (OEPA) Director's Information Ms. Susan O'Brien, Director, Office of Education Performance Audits, reported that the OEPA has presented at a conference or provided professional development for the following: CT Conference July 27, 2015; RESA 8 Administrators Conference July 31, 2015; Hampshire County Administrators Conference August 3, 2015, and; McDowell County Administrators Conference August 6, 2015. Additionally, the staff attended the Student Success Summit in Morgantown and a legal update presentation by Howard Seufer Jr. at the RESA 7 Administrators Forum. Professional development with our county systems encourages and supports deeper understanding of the audit process and protocols and allows our staff to receive constructive feedback as part of OEPA's continuous improvement. The potential for positive student impacts is heightened by this greater awareness and learning at all levels of the bureaucracy. XX. Facilities Checklist Ms. O'Brien presented a facilities checklist for the Board's consideration. The OEPA utilizes the facilities checklist as part of the on-site review process. The checklist has been streamlined and revised to meet current, applicable policies and is in alignment with all legal decisions. The revised facilities checklist will provide accurate and pertinent information regarding student safety and well-being as part of the on-site review process. Update - WVBE Actions for Improved Outcomes Ms. Peduto (distributed information) and Board members provided an update regarding actions taken by the Board to improve educational outcomes and support to county boards of education. Ms. Peduto called on Mr. Burch to provide an update regarding the reading initiative. WVBE Finance Committee - Mr. Campbell provided an update on behalf of the Finance Committee regarding appropriations from the general revenue fund for the past five years (last year was the lowest), a review of Fayette County finances show they are in line with other counties, an update regarding the watch list for deficit counties and, assisted by Mr. Joe Panetta (distributed information), Chief Officer, WVDE Division of Finance and Administration, provided information regarding the WVDE's FY2017 appropriate request/improvement package requests. Chancellor Report Chancellor Hill, assisted by Dr. Chris Treadway, Post-Doctoral Research and Policy Analyst, West Virginia Higher Education Policy Commission, provided highlights (via PowerPoint presentation) from the HEPC's 2014 High School Senior Opinions Survey. (PowerPoint presentation attached to Official Minutes, Attachment U.) Chancellor Hill departed the meeting. XXIII. WVBE Coordinator of Board Agencies Report/ WVBE Regional Education Service Agency (RESA) Liaison Report Mr. Jason L. Butcher, WVBE Coordinator of Board Agencies, provided an update regarding his work in conjunction with WVBE agencies inclusive of the West Virginia Schools for the Deaf and the Blind, Office of Education Performance Audits, WVDE Office of Institutional Education Programs, and RESAs. Mr. David Warvel, Executive Director, RESA 4, provided a report on behalf of the RESAs and specifically RESA 4. XXIV. Items for Future Consideration President Green requested that items for consideration for placement on a future agenda be provided to Ms. Peduto as soon as possible. Future Meetings West Virginia Board of Education members will participate in general discussions in a planned educational and training setting on August 13, 2015, in Roanoke, West Virginia; no business will be conducted and no minutes will be produced [W. Va. Code §6-9A-2(5)(D)-(E)]. The next regular meeting of the WVBE will be held September 9, 2015, in Charleston, West Virginia. The meeting will continue on September 10, 2015, if the agenda is not completed on September 9, 2015. The meeting schedule for September 2015 through August 2016 is found in the attachment.
