Use Form R-10 7700-41, Road Use Permit (see 24 - Exhibit 01), in Southeast Alaska where appropriate. This form includes references to Federal Land Policy and Management Act (FLPMA) authorities. Use a letter of authorization where the use is minor or the costs associated with the permit would be greater than the amount collected. Use Form R-10 7700-41 to authorize non-Federal commercial use of a National Forest System Road in Alaska. Work with the applicant to assure they understand all the information needed in Form FS-770040, Application for Road Use Permit. Use Road Management Objectives for the road(s) being permitted to guide the identification of the construction, rehabilitation, operation, and maintenance work that can be done and possible work schedules. Form R-10 7700-41, is available electronically on the R10 Sharepoint site http://fsteams.fs.fed.us/sites/r06-eng-cd/tra/opsmaint/SitePages/Region%2010%20Operations%20and%20Maintenance.aspx 24.11 – Instructions for Certain Clauses. The road use permit may be approved by Forest Officers other than the Forest Supervisor, depending on delegations of authority. See the Regional Road Order for maximum vehicle limits. The State of Alaska does have an Industrial Use Road designation with 179,000 GVW load limits on several state highways. Do not impose lower load limits on permits than are in place on connected state highways, unless needed for protection of the National Forest System road. 24.22 - Long-term Permits. A user may request the use of a Forest Service road for continuous commodity hauling in the Alaska Region, subject to the Regional Road Order, or such other road orders in place. Access by contractors doing silvicultural work after timber harvest will be considered as a noncommercial activity for access purposes. Access only by foot, pickups, and similar light vehicles is intended. Permit by letter or agreement is appropriate for this use. The market rate for long-term access across another's property of $5,000 per year for the roads in a single geographic area has been set by Sealaska Corporation. This fee is intended to be a road maintenance reimbursement cost, reimbursing for the expected costs of maintaining a road system in a condition for use by cars and trucks during periods when commercial hauling is not taking place, and the road would normally be in a closed condition. The administrative access fees are not charged during periods (years) when the permittees commercial hauling activity is taking place. COMPLIANCE WITH LAWS AND REGULATIONS. USE NONEXCLUSIVE. The privileges granted in this permit to use this road are not exclusive. The Forest Service may use this road and authorize others to use it at any and all times. The permittee shall use said road in such manner as will not unreasonably or unnecessarily interfere with the use thereof by other authorized persons, including Forest Service. 7. RULES GOVERNING USE. The permittee, its agents, employees, contractors or employees of contractors, shall comply with all reasonable rules prescribed by the Forest Service for control and safety in the use of this road and to avoid undue damage to the road. Such rules will include: (1) Closing the road or restricting its use when, due to weather conditions or the making of alterations or repairs, unrestricted use would in Forest Service judgement, cause excessive damage, or create hazardous conditions; (2) Closing the road during periods when, in Forest Service judgement, there is extraordinary fire danger; (3) Traffic controls, which in Forest Service judgement, are required for safe and effective use of the road by authorized users thereof; (4) Prohibiting the loading of logs on trucks while such trucks are standing on the roadway surface, except to recover lost logs; and (5) Prohibiting the operation on this road of any vehicles or equipment having cleats or other tracks which will injure the surface thereof; (6) Prohibiting the operation of log-hauling vehicles (of a width in excess of and a gross weight of vehicles and load in excess of )* (not in excess of limits established by Regional Road Order or lower limits established by Forest Supervisor's Road Order) (7) Regulating the number of vehicles so as to prevent undue congestion of this road. (9) Other - Specify (Optional) 8. INSURANCE. Permittee or his contractors and assigns shall be required to carry public liability and property damage insurance for the operation of vehicles in the amounts established by applicable state laws, cooperative agreements, or easements issued on the subject road or roads. In any event, the permittee must carry liability insurance and property damage insurance of not less than $250,000 for injury or death to one person, $500,000 for injury or death to two or more persons, and $250,000 for damage to property. The permittee itself shall be responsible for furnishing to the proof of satisfactory insurance when said insurance is to be furnished by other than the permittee. Proof of satisfactory insurance may be required by the prior to hauling over the road(s) and will be for the duration of the permit and such insurance policy shall bear an endorsement requiring the issuing company to give 10 days prior written notice to the , of cancellation or material change. 9. MAINTENANCE. The permittee shall bear the expense of maintenance proportionate to his use. Maintenance shall be performed in accordance with Forest Service specifications or requirements for maintenance as hereinafter listed, or as may be mutually agreed upon from time to time and shall consist of (1) current maintenance as necessary to preserve, repair, and protect the roadbed, surface and all structures and appurtenances, and (2) resurfacing equivalent in extent to the wear and loss of surfacing caused by operations authorized by this permit. 9a. MAINTENANCE AND RESURFACING REQUIREMENTS AND SPECIFICATIONS. (Specify) 10. PERFORMANCE BOND. In the event the permittee is to perform its proportionate share of road maintenance, road resurfacing, or betterment, as determined and within time periods established by the Forest Supervisor, the Forest Service may require as a further guarantee of the faithful performance of such work that the permittee furnish and maintain a surety bond satisfactory to the Forest Service in the sum of dollars ($ ), or in lieu of a surety bond , deposit into a Federal depository, as directed by the Forest Service, and maintain therein cash in the sum of dollars ($ ), or negotiable securities of the United States having market value at time of deposit of not less than ($ ). As soon as security for the performance of road maintenance (and betterment) requirements or the settlement of claims incident thereto is completed, unencumbered cash guarantees or negotiable securities deposited in lieu of surety bond will be returned to the permittee. The permittee shall take all reasonable precautions to prevent and suppress Forest fires. No material shall be disposed of by burning in open fires during the closed season established by law or regulation without a permit from the Forest Service. 12. DAMAGES. The permittee shall exercise diligence in protecting from damage the land and property of the United States covered by and used in connection with this permit, and promptly upon demand shall pay the United Sates for any damage resulting from negligence, or from violation of the terms of this permit or of any law or regulation applicable to the National Forests, by the permittee, or by his agents, contractors, or employees of the permitee acting within the scope of their agency, contract, or employment. 13. OFFICIALS NOT TO BENEFIT. No Member of or Delegate to Congress or Resident Commissioner shall be admitted to any share or part of this agreement or to any benefit that may arise herefrom unless it is made with a corporation for its general benefit. 14. OUTSTANDING RIGHTS. This permit is subject to all outstanding rights. 15. SUSPENSION. Upon the failure of the permittee, its agents, employees or contractors to comply with any of the requirements of this permit, the officer issuing the permit may suspend operations in pursuance of this permit. 16. TERMINATION. This permit shall terminate on unless extended in writing by the Forest Service. It may be terminated upon breach of any conditions herein. 17. CLAUSE CONTROL. In the event of any conflict between any of the preceding printed clauses or any provision thereof and any of the following clauses or any provisions thereof, the following clauses will control. 18. SAFETY. Unless otherwise agreed in writing, when Permittee's Operations are in progress adjacent to or on Forest Service controlled roads and trails open to public travel, Permittee shall provide the use with adequate warning of hazardous or potentially hazardous conditions associated with Permittee's Operation. A specific traffic control plan for each individual project shall be agreed to by Permittee and Forest Service prior to commencing operations. Devices shall be appropriate to current conditions and shall be covered or removed when not needed. Except as otherwise agreed, flager and devices shall be as specified in the "Manual on Uniform Traffic Control Devices for Streets and Highways" (MUTCD), and in specifications attached hereto. 19. DRIVER'S COPY. Drivers of all vehicles hauling logs shall have a copy of page 1 of this agreement in their possession. This copy will be presented, on request, to any Forest Officer. 20. LOAD MARKING. Unless stated otherwise in writing by the District Ranger, all wood products shall be painted with a blue letter "P" on each log across the top layer on the front and back of the load. Snow removal shall be done in a manner to preserve and protect the roads, to the extent necessary to ensure safe and efficient transportation of materials, and to prevent excessive erosion damage to roads, streams, and adjacent lands. Permittee shall: (1) Remove snow from the entire road surface width including turnouts. (2) Remove snow slides, earth slides, fallen timber, and boulders that obstruct normal road surface width. (3) Remove snow, ice, and debris from culverts so that the drainage system will function efficiently at all times. (4) Perform all items of snow removal currently to ensure safe, efficient transportation. Work shall be done in accordance with the following minimum standards of performance: (5) Deposit all debris, except snow and ice, removed from the road surface and ditches at agreed locations and away from stream channels. (6) Not undercut roadbanks nor remove gravel or other selected surfacing material off the roadway surface. (7) Assure that ditches and culverts are kept functional during and following roadway use. (8) Not leave snow berms on the road surface. Berms on the shoulder of road shall be removed and/or drainage holes shall be opened and maintained. Drainage holes shall be spaced as required to obtain satisfactory surface drainage without discharge on erodible fills. (9) Not use dozers to plow snow on system roads without written approval of the Forest Service. (10) Leave a minimum of 2-inches of snow depth to protect the roadway. (11) Restore any damage resulting from the snow removal in a timely manner. Doc_Name Page 10 of 13 FSH 7709.59 – ROAD SYSTEM OPERATIONS AND MAINTENANCE HANDBOOK CHAPTER 20 - TRAFFIC MANAGEMENT 24 – Exhibit 02 CALCULATION OF ROAD AND RELATED FACILITY USE RATES for Use with Alaska Region R10 FS Form 7700-41 Road Use Permit (6/94) R10-FS 7700-41 - Clause 1 - Road and Related Facility Use Permit Fees. Use these rates unless local market rates for similar road uses can be demonstrated to be different. These rates will be adjusted for inflation every five years using actual costs or the consumer price index for the future five years and may be subject to recalculation by the Forest Service if economic conditions warrant a. When roads are in a condition for commercial haul. When roads to be used currently meet Commercial Haul Standards or have been restored to such standards, the current replacement value for roads shall be $230,000 per mile. The road permit rate shall be calculated according to the following formula: Road Permit Rate/MBF/Mile = 0.0075* X $230 = $1.725/MBF/Mile * The road permit rate is based on a formula established and used by the State of Washington, Department of Natural Resources (WDNR). The WDNR rate is 3/4 of a percent of the current replacement value of the road in thousands of dollars. b. When related facilities are in a condition for commercial haul. When related facilities such as sortyards, log transfer facilities (LTF) or marine access facilities (MAF) which currently meet Commercial Haul Standards or have been restored to such standards the following facility use fees as follows: Use of a sortyard: $0.75/MBF plus allocated maintenance costs. Use of LTF/MAF: $3.25/MBF, plus allocated maintenance costs. An annual fee of $10,000 per calendar year shall be assessed and paid by the timber sale purchaser when the timber sale purchaser makes commercial use of a related facility. The annual fee is not required for the intermittent loading and unloading of equipment or such other uses as may be agreed upon in advance. The annual fee includes the ownership costs associated with LTF/MAF monitoring and permit requirements. The NFS will maintain for all related facilities permits, leases, licenses, monitoring dives, reports and any other processes associated with governmental authorization required by law with respect to those related facilities. When roads or related facilities to be used are not in a condition for commercial haul. (1) If the roads or facilities are not in a condition suitable for commercial haul, and the permitee will improve the roads or facilities as a part of the permit process, include the description of the work to be performed in section 2-1. Use the same formulas as shown above but use the current replacement value of the roads or facilites in current condition (value of road in commercial haul condition less the cost of work to bring the road to commercial haul condition). (2) If the roads have been closed and need only maintenance or pre-haul maintenance work to open them up for use (no improvement will be made to the road), the permittee will be expected to perform the maintenance work to open and reclose the road. d. Other conditions for permitted use and fees. The term of a road use permit should not normally be longer than that of a single timber offering/sale. Balance the cost of permit processing with the expected use. Road use permits should not exceed a period of 10 years without re-examination of all the terms in the permit. Annual review and renewal of permits may also be done. (1) When the period of use will be longer than 5 years, recalculate the fees at least every 5 years. (2) Calculate current replacement value on construction rates without allowances for overhead costs, or use the values in a. of this section. (3) Costs associated with pre-engineering, contract administration, and other overhead costs will be excluded from replacement value calculations. e. Use of log transfer facilities or marine access facilities for commercial use other than log transfer. Log transfer facilities (LTF) or Marine Access Facilities (MAF) are sometimes used for loading or unloading equipment and materials. Some uses include loading barges with rock, loading/unloading scrap iron and junk vehicles, loading and unloading construction equipment. Use the formula in 1.a of this section, to calculate rates based on estimated construction costs for the portion of the facility used. Use the equivalency of 16,500 pounds gross vehicle weight (gvw) per thousand board feet in calculations. Example: A hauler is moving 80,000 gvw vehicles across an LTF or MAF and loading a barge. The construction cost estimate for the portion of the site used is $150,000. The equivalent mbf for the truck is 80,000/16,500 = 4.85. Note that the costs for NFS road use are not included in the $5.46 rate. If the uses do not involve placing material into the water, the provisions of the Section 402 permit for monitoring dives does not come into effect. Require monitoring for oil sheens as a part of the permit. R10-FS 7700-41 - Clause 2-1 - Work Required to Accommodate Permitted Use. The work required is normally based on those tasks needed to put the road into condition for commercial haul use. Improvements required to meet Best Management Practices (BMPs, R-10 FSH 2509.22) on National Forest land should be included. a. Costs of work to restore the road to commercial haul conditions and meet BMPs are credited against the road use permit fees calculated and included in Clause 1, unless the work is pre-haul maintenance such as associated with opening closed roads. b. The road user will be responsible for costs of the work required to accommodate permitted use in excess of the amounts of road use permit fees creditable. c. Inclusion of items of major construction, such as bridge repair, should be avoided if possible. The permittee's use of transportable bridges (modular or similar) should be planned for in most road use permit situations. R10 Form 7700-41 - Clause 8 - Insurance. Normally, the values to enter should not be more than $500,000/$1,000,000 for injury and $500,000 for property damage in Alaska. R10 Form 7700-41 - Clause 9a - Maintenance and Resurfacing Requirements and Specifications. There are two types of road maintenance needs for which collections may be made. They are traffic-generated maintenance (the direct result of a user's traffic--examples are surface blading and dust abatement) and nontraffic-generated (examples are brushing, logging out blown down trees, and removing landslides). There are also two time frames for maintenance. Some activities are done concurrent with road use (again, surface blading and dust abatement are examples). Others are done once every few years (replacing rock surfacing, seal coating paved roads, and brushing for sight distance are examples). Commercial users bear the entire cost of traffic-generated maintenance that they cause. They bear their "share" of nontraffic-generated maintenance as calculated based on the distribution of commercial versus non-commercial traffic on the road. There are some types of work that are better handled through collections because of expense and complexity. Examples include pavement maintenance and bridge maintenance. Often collections are made for long-term cyclical items such as brushing and surface rock replacement because of economies of scale. Take collections for the entire maintenance obligation of very small commercial operations. It is not economical to move in a piece of equipment to do $500.00 worth of maintenance obligation incurred by hauling 20 loads of logs. Specifically for FS timber sales, there is a maintenance allowance computed as part of the appraisal process. The allowance includes all maintenance, whether traffic related, nontraffic related, done by the purchaser, or done by collections into CWFS. Road maintenance and surface rock replacement rates are typically calculated on a per thousand board foot (MBF) or hundred cubic feet (CCF) basis. Rates for products other than logs will be calculated based on a conversion factor of 16,000 pounds per thousand board feet (MBF). Use the following for Surface Rock Replacement (SRR) for crushed gravel surfaced roads: Surface Rock Replacement = $0.31/MBF/Mile Use standard specifications for road maintenance or pre-haul maintenance where practical. The pre-haul maintenance specifications are identified as "T" specifications. Use T-845 Maintenance, Operation, and Monitoring of Log Transfer Facilities when LTF are included in the permit. When the permitted use includes LTF, MAF or log sort yards, the permittee will be responsible for maintenance commensurate with use for the LTF/MAF as well as any damage to the facility. Compliance with Corps of Engineers and EPA issued permit requirements, pollution prevention plans, and operator monitoring requirements by the permittee are also a condition of the use of the facilities. R10 Form 7700-41 - Clause 10 - Performance Bond. Use this clause only if the permittee is performing work on the road. Base the value of the performance bond on the amount of credit at risk to the Government, and not less than $5000 per mile of road for the Alaska Region. Waive the performance bond requirement if the permittee is a cost share cooperator within the Region, or has entered into an agreement with the Forest Service for reciprocal access.
