This form includes references to Federal Land Policy and Management Act authorities. Use a simple letter of authorization when the use is minor or the costs associated with the permit would be greater that the amount collected. If a letter is used to authorize use, include clauses 5, 6, 7, and 8 from the form in the letter. 24.1 - Road Use Permits. Use Form R6-FS-7700-41 (available electronically) to authorize non-Federal commercial use of a forest development road. Work with the applicant to ensure they understand all the information needed in the form. Use road management objectives for the road(s) being permitted to ensure appropriate construction, rehabilitation, operation, and maintenance work is included. Identify the work to be performed by the permittee and include it in the permit. 24.11 - Road Use Permit Clauses. The road use permit may be approved by a forest officer, other than the Forest Supervisor, depending on delegation of authority. Change the title block on page 1 of the permit form to match the delegations of authority for the forest officer approving the permit. 24.11a - Special Instruction for Certain Clauses. 1. Investment Sharing Rates, Clause 1. Fees for road use permits (license for use) are set according to market rates. The regional market rates are based on a formula established and used in the past by the State of Washington, Department of Natural Resources, and various private companies. The rate per 1,000 board feet per mile for commercial haul roads is 3/4 percent of the current replacement value of the road in thousands of dollars. Forests may group like roads into general groupings of similar replacement value. Groupings could be selected on the basis of such things as functional classification, terrain, or difficulty of construction. The replacement value of some roads will be higher than the replacement value of a road adequate to carry the commercial traffic for the route. In that case, the replacement value for a road adequate to carry the commercial traffic should be used to calculate the fees. Normally this road standard would be single lane with turnouts, traffic service level C, with surfacing that would be considered adequate for the conditions. It should include some allowance for structures. Again, repetitious calculations can be avoided by computing one value for each grouping. The rate for other products can be prorated by using a weight ratio. Use these rates unless local market rates for similar road uses can be demonstrated to be different. When the nominal replacement value of a road is estimated at $60,000 per mile, then the fee is .0075 X 60 = $0.45/mbf/mile. b. When roads to be used are not in condition for commercial haul. (1) When the roads are not in a condition suitable for commercial haul, and the permittee will be improving the roads as part of the permit process, include the description of the work to be performed in Section 2-1. Use the same formula as shown above, but use the current replacement value of the roads(s) in current condition (value of road in commercial haul condition less the cost of work to bring the road to commercial haul condition). (2) When the roads have been closed and need only maintenance or prehaul maintenance work to open them up for use, and no improvement will be made to the road, the permittee will be expected to perform the maintenance work to open and close the road. c. Other conditions for permitted use and fees. The term of a road use permit should not normally be longer than that of a single timber offering/sale or other activity. Balance the cost of permit processing with the expected use, but road use permits should not exceed a period of 10 years without re-examination of all the terms in the permit. Annual review and renewal of permits may also be done. (1) When the period of use will be longer than 5 years, recalculate the fees at least every 5 years. (2) costs associated with pre-engineering, contract administration, and other overhead costs will be excluded from replacement value calculations.
