September 2013 Edition Message from your new President Welcome another great program year for the Chapter! Your leadership team has been working over the summer break planning the programs and events for the upcoming year. A few highlights are: Location: We are pleased to announce that we have signed our contracts with the Hilton Garden Inn located at the intersection of I-40 and Miami Boulevard (complete address in the meeting notice below) in Research Triangle Park. We found that this more central location enabled more of our members to attend the meetings. They have a great bar for networking before and after meetings. Schedule: We are keeping the meeting night (second Thursday of the month) and schedule (5:30 to 7:30 PM) the same in order to allow members to come directly from work to network, attend the meeting/workshop, and be home by the 8:00 family hour. Meeting fees also remain unchanged. Geographic Expansion: In addition, we will be hosting two evening meetings outside of the Raleigh/Durham area. On October 10th, a meeting will be held in Greensboro and on April 10th a meeting in Wilmington. Being the ONLY Chapter in the State, we hope that servicing our members in these two areas will help to make those members feel connected and provide for an educational and networking opportunity in those areas. The meetings are timed to avoid inclement weather in Greensboro and hopefully attract beautiful weather in Wilmington so those who are able can make it a long weekend. Education: We have on the docket an educational seminar on May 8, 2013 in Raleigh/Durham. We will be discussing the subject in more detail and will again submit a grant to National NCMA to help sponsor the event. Scholarships: We have increased the number and dollar value of the scholarships available to Chapter members (see the Scholarship’s Chair Report). Communication: Our Facebook and LinkedIn pages are available and we encourage postings. The Chapter’s website will provide updated information on events, announcements, job opportunities, and various important links. The BizNews will continue to be our monthly meeting announcement so be sure that your watch your emails for future editions. And looking back, we submitted the Chapter’s Annual Report mid-August to qualify for a Graalman Award. We hope to attract more active members and continue to grow our organization to serve its membership. Nina Next Meeting – September 12 th "Contract claims Management – Notices, Change Orders and Disputes" We, as contracts professionals, often feel confident in our abilities to draft, negotiate and execute large and complex contracts. We strive to create a set of contract documents that reduces or shifts our company’s exposure to risks. But it’s impossible to foresee all of the events that can affect the work and schedule of a project prior to contract execution. To compound the problem even further, most contracts are never truly complete at contract execution. It is inevitable that during a contract’s performance (1) external events will change the contract’s scope of work, and/or (2) the possibility of an event was contemplated during contract negotiations, but the effect or size was not considered. It is important to understand what to do when changes occur, what your contractual obligations are and the processes that you, as a contracts professional, should follow. This session will provide you with an overview of those processes. About our Speaker: Dondi M. Day is the Contracts and Claims Manager for Siemens Energy, Inc. in Cary, North Carolina. He has over 10 years of experience, specializing in contracts management and construction claims. He has extensive experience drafting and negotiating contracts and subcontracts. Mr. Day holds a Masters in Business degree from Central Michigan University and undergraduate degrees from Appalachian State University and Mount Olive Page 2 of 10 College. He also holds a certificate in Contracts Management from University of California, Irvine, and has completed additional post graduate work in business. Mr. Day currently holds both the CPCM and CCCM certifications from the National Contracts Management Association (NCMA), and serves as President-Elect on the NCMA’s Raleigh-Durham Chapter. Mr. Day is a certified Project Management Professional (PMP) and licensed boat Captain. Mr. Day has taught courses in Captains Pre-licensing, Boating Safety and Search and Rescue at Cape Fear Community College, and has taught specialized courses in export compliance (ITAR and EAR), contract terms and conditions, contract claims management and contract administration. Timing: 5:30 pm Registration Desk opens; Networking in Lounge area until 6:00 pm. Business meeting starts at 6:00 pm; workshop at 6:15 pm; and adjourn by 7:30 pm. Page 3 of 10 National/Chapter Highlights: The Chapter was represented by, Art Brigida, Dondi Day, Cathy Etheredge-Brigida, and Nina Cannon, at the 2013 Leadership Summit held the afternoon prior to the start of the World Congress. Several hours of intense information was presented by various Association Leaders such as Michael Fischetti, NCMA Executive Director. Over 1400 individuals attended the World Congress in Nashville, TN. The three day educational event was a success by all accounts. Attendees from the Chapter were: Art Brigida, Nina Cannon, Dondi Day, and Cathy Etheredge-Brigida. Cathy was also a presenter and Art was a volunteer. The RTP Chapter had on display three proclamations of Contract Management Week 2012 from the State of NC and the cities of Raleigh and Durham. Page 4 of 10 Tom G. Reid, JD, CPCM, Fellow, of Certified Contracting Solutions, LLC, and Cathy EtheredgeBrigida, CPCM, CFCM, Fellow, former Chapter President, and Director of Contracts, KEMRON Environmental Services, Inc. won the Charles J. Delaney Memorial Award for their article, “The Oxymoron of the 1099 Employee.” The article was published in the August 2012 edition of Contract Management magazine. The award was presented to Tom and Cathy at World Congress and they led a session based on their article as part of the Business & Proposal Development Track at World Congress. Treasurer’s Report The current total balance as of August 19 in our Chapter accounts (Bank of America + PayPal) is $11,626.60. This total includes the Chapter's contribution of $250 to the Contract Management Leadership Development Program (CMLDP) on July 28th. Welcome our new and transfer members: Emily Davis Solutions-IES, Incorporated Page 5 of 10 Robert Edwards Tyra Winston Raymond Strother Industries of the Blind, Incorporated Transfer from Mid-Florida Chapter Education Report On August 13th, Darryl Hammill attended an “Association Night” at Meredith College consisting of members from local and some statewide Paralegal Associations, the NC State Bar, and the State Bar Association. NCMA membership information was distributed prior to the class meeting as well as providing an opportunity for each representative to speak during the class meeting. The Chapter’s scholarship program for Students ($150) was mentioned along with reduced meeting fee of $5. On August 14th, Darryl Hammill attended the Graduate Panel discussion with new students discussing representing an “alternative” profession for graduates; the contract management profession. Two of the questions submitted by the students gave him the opportunity to speak regarding the benefits of membership in NCMA as well as discuss the certification program with another question providing a great opportunity to speak about contract management as a profession. The Director of the Paralegal Program has been very supportive of the Chapter’s involvement in introducing the students to a career path other than that of a legal career. A total of 56 students are in the program this semester. As with previous semesters, a NCMA “welcome letter” and brochures will be distributed and placed in the student’s mail box. Scholarship Report A check for the Chapter’s Student Scholarship ($25) was presented by Lembe Tayilo to Delilah Jones at the Chapter’s June 13th meeting. Darryl Hammill and Cathy Etheredge-Brigida at the NC Bar Association Career Fair Darryl Hammill and Cathy Etheredge-Brigida, CPCM/CFCM represented the Chapter at the NC Bar Association’s annual Career Fair Day on June 14th. The intent of the Chapter’s participation was to inform current and future graduates of the Paralegal Program from various local colleges about the contract management profession as an alternative to working in a law office as a paralegal. Over 75 individuals stopped by to speak to Darryl and to pick up membership information about NCMA from the Chapter’s information table. Darryl will be meeting with the director of the Meredith Paralegal program on August 13 th for a preliminary planning meeting regarding the Contracts/Negotiation Short Course (4 weeks) that they will be co-teaching in the Spring 2014 semester at Meredith College. Thank you! Professional Update Former Pentagon Official Wants to End Use-it-or-Lose-it Spend Policy July 22, 2013. Former Pentagon policy chief Michele Flournoy says the Pentagon should instill a more cost-conscious culture by taking away the incentive for program managers to hurry up and spend at end of the fiscal year. “Today's system essentially penalizes anyone who does not spend every last dime of their budget by the end of the fiscal year,” Flournoy told attendees at the National Contract Management Association conference here on Monday Page 8 of 10 Official: Rotate Contracting Officers Between Government, Private Sector July 23, 2013. Joseph Jordan, the White House’s top contracting policy chief, floated the idea Tuesday of having contracting professionals rotate between government and the private sector. “Is there a way where we can have people kind of bounce back and forth ... between industry and agencies?” Jordan said in remarks here at the National Contract Management Association conference.
