The Otsego County Board of Representatives met for its organizational
meeting on Wednesday, January 7, 2015, at the Representatives’ Chambers,
Otsego County Office Building in the Village of Cooperstown, New York.
The Clerk of the Board, Carol D. McGovern, called the meeting to order.
The roll was called and the following Representatives were found to be

Temporary Chair. Representative Lindberg immediately assumed the duties of
the office.

Under Privilege of the Floor, Maria Ajello, concerned tax payer and
County Employee, asked that the County vacate the sale of her property from
the recent property tax auction and allow her to pay her back taxes, penalties
and fees.
Russell Ahrens, concerned tax payer and County Employee, stated that
unlike surrounding counties, Maria Ajello was not allowed to pay her back taxes
51 days prior to the auction, and asked that the County allow her to redeem her
home.
David Petri, County Highway 59 Cooperstown, NY, stated that he is
concerned that the Highway Department is plowing and salting roads when not
always necessary, which causes increases in fuel and salt costs and the
potential for falling trees due to the overuse of salt, and asked that this be
addressed.
The minutes of December 3, 2014 and December 15, 2014 were
approved.

Representative Lindberg moved for an executive session regarding
negotiations with the Deputy Sheriff’s Police Benevolent Association unit.

Representative Powers moved for an executive session to discuss matters
leading to the appointment, employment, promotion, demotion, discipline,
suspension, dismissal or removal of a particular person. Seconded, Koutnik.

Board Chair Clark asked if any representative wished to remove a

Board Chair Clark called for action on the consent agenda, excluding

RESOLUTION NO. 1-20150107
RESOLUTION - APPROVING EXECUTION OF CONTRACT
FOR THE PROVISION OF ALCOHOLISM SERVICES IN
OTSEGO COUNTY
LINDBERG, QUACKENBUSH, ROWINSKI
WHEREAS, funds are available through the New York State Office of
Alcoholism and Substance Abuse Services to Otsego County for purposes of
providing educational services, information and referral services for residents of
Otsego County suffering from the diseases of alcoholism and other addictions;
and
WHEREAS, in addition, Task Force on Integrated Projects (TFIP) 100% funds
are available under the auspices of the New York State Office of Alcoholism and
Substance Abuse Services; these TFIP funds will be administered under the
Division of Alcoholism and Alcohol Abuse (DAAA); and
WHEREAS, the amount of the funding for the Information and Referral
Services and the Task Force on Integrated Projects totals $412,348; and
WHEREAS, the Leatherstocking Education on Alcoholism/Addictions
Foundation, Inc. (LEAF, Inc.) has expressed a willingness and desire to continue
to act as an agency to the County for purposes of providing these alcoholism
and other addictions educational services; and
WHEREAS, it appears to be in the best interests of the residents of the
County of Otsego to provide these services; now, therefore, be it
RESOLVED, that upon receipt of the $412,348 in funds from the State of
New York as above set forth, the Chair of the Board of Representatives and the
Director of the Community Services are authorized to execute an
alcoholism/addictions services contract, on behalf of the County of Otsego,
with LEAF for the contract period January 1, 2015 through December 31, 2015;

and be it further
RESOLVED, that said contract shall contain such terms and provisions as
are in the best interests of the County of Otsego and are complying with all
federal, state and local statutes, rules and regulations which would enable LEAF
to continue to utilize designated funds to operate a program of
alcoholism/addictions informational and educational services in the County of
Otsego; and be it further
RESOLVED, that upon the expiration of the term of the aforementioned
contract, a subsequent resolution must be adopted by this Board to authorize
the extension of additional terms of said contract; and be it further
RESOLVED, that the funds for this contract are included in the 2015 Contr
Chem Dependency Program Budget (4323-A) at line 4698 LEAF and consist of
100% state funds.
RESOLUTION NO. 2-20150107
RESOLUTION - AUTHORIZING CHAIR TO EXECUTE
CONTRACT FOR RECOVERY SUPPORT SERVICES FOR
THE CHEMICAL DEPENDENCIES CLINIC
LINDBERG, QUACKENBUSH, ROWINSKI
WHEREAS, there is a need for recovery support services at the Otsego
County Chemical Dependencies Clinic; and
WHEREAS, Friends of Recovery of Delaware and Otsego (FOR-DO), 22 Elm
Street, Oneonta, New York 13820 has agreed to provide such services as set
forth below; now, therefore, be it
RESOLVED, that contingent upon Otsego County’s receipt of funding from
New York State, the Chair of this Board be and hereby is authorized to execute
a contract with FOR-DO for recovery support services for the Chemical
Dependencies Clinic, commencing January 1, 2015 through December 31, 2015,
not to exceed $151,500 for the term of the contract; and be it further
RESOLVED, that said contract shall contain such other terms and provisions
as are in the best interests of the County of Otsego; and be it further
RESOLVED, that the funds for this contract are included in the 2015 Turning
Point Budget (4327-A) at line 4800 and consist of 100% reimbursement from state

funds.
RESOLUTION NO. 3-20150107
RESOLUTION – AUTHORIZING THE CHAIR TO
EXECUTE AN AGREEMENT WITH CATHOLIC CHARITIES
OF DELAWARE AND OTSEGO COUNTIES FOR
OPERATION OF THE ALTERNATIVES TO
INCARCERATION PROGRAM
POWERS, MCCARTY, QUACKENBUSH, GELBSMAN, LENTZ
WHEREAS, in order to assist Otsego County Courts and Law Enforcement
agencies in promoting appropriate and effective Alternatives to Incarceration
experiences for eligible participants, Catholic Charities of Delaware and Otsego
Counties has submitted a proposal to the County for the operation of the
Otsego County Alternatives to Incarceration Program (ATI); and
WHEREAS, the Public Safety and Legal Affairs Committee and the
Administration Committee of this Board have approved this proposal and
consider it to be in the best interests of the County; now, therefore, be it
RESOLVED, that the Chair of this Board is authorized to execute an
agreement with Catholic Charities of Delaware and Otsego Counties, with
offices located at 176 Main Street, Oneonta, New York 13820, for the operation
of the Otsego County Alternatives to Incarceration Program for the year 2015, at
a total cost of $29,004, payable in twelve (12) monthly installments of $2,417 per
month; and be it further
RESOLVED, that the agreement shall contain such other terms and
provisions as are in the best interest of the County of Otsego; and be it further
RESOLVED, that the funding for this contract is included in the 2015
Alternatives to Incarceration Budget (3157-A) at line 4900 Contracts.

RESOLUTION - AUTHORIZING THE CHAIR OF THE BOARD
TO EXECUTE AGREEMENTS WITH VARIOUS HEALTH CARE
FACILITIES FOR SEXUALLY TRANSMITTED DISEASE CLINIC
SERVICES

WHEREAS, Section 2304(1) of the Public Health Law requires that each
Board of Health of a Health District provide facilities for free diagnosis and
treatment of persons suspected of being infected or who are infected with a
sexually transmitted disease; and
WHEREAS, Family Planning of South Central NY and A.O. Fox Hospital are
willing to provide these services for the County; and
WHEREAS, it is in the best interest of the County to enter into agreements
with the aforementioned medical facilities for the provision of such services;
now, therefore, be it
RESOLVED, that the Chair of this Board be and hereby is authorized to
execute agreements with Family Planning of South Central NY, Oneonta, New
York; and A.O. Fox Hospital, Oneonta, New York, to provide to the County the
professional services necessary and required by Section 2304(1) of the Public
Health Law regarding the diagnosis and treatment of persons suspected of
being infected or actually infected with a sexually transmitted disease, for a
period of one (1) year commencing January 1, 2015 and terminating December
31, 2015; and be it further
RESOLVED, that said contracts shall contain such other terms and
conditions as are in the best interest of the County of Otsego; and be it further
RESOLVED, that the funding for these contracts is included in the 2015
Biologicals Budget (4074-A) at lines 4895 Medical Expenses and 4900 Contracts
and is 100% state reimbursable.
RESOLUTION NO. 5-20150107
RESOLUTION - AUTHORIZING THE CHAIR OF THE BOARD
TO EXECUTE AGREEMENTS WITH VARIOUS HEALTH CARE
FACILITIES FOR HIV COUNSELING AND TESTING

WHEREAS, Section 2304(1) of the Public Health Law requires that each
Board of Health of a Health District provide facilities for free counseling and
testing of persons suspected of being infected or who are infected with HIV; and
WHEREAS, Family Planning of South Central NY and A.O. Fox Hospital are

willing to provide these services for the County; and
WHEREAS, it is in the best interest of the County to enter into agreements
with the aforementioned medical facilities for the provision of such services;
now, therefore, be it
RESOLVED, that the Chair of this Board be and hereby is authorized to
execute agreements with Family Planning of South Central NY, Oneonta, New
York, and A.O. Fox Hospital, Oneonta, New York, to provide to the County the

FOR THE DEPARTMENT OF HEALTH’S EARLY INTERVENTION PROGRAM
AND PRESCHOOL PROGRAM CONTRACTED SERVICES

RESOLVED, that the Chair of the Board be and hereby is authorized
to execute agreements with certain individuals and/or organizations to provide
the following Department of Health’s Early Intervention Program and Preschool
Program Contracted Services for the year 2015 at 2015 state approved contract

Administration Budget (4060-A). Reimbursement includes Medicaid, third party
insurance, then 49% from the NYS Department of Health (EI) or 59.5% from the
NYS Department of Education for direct service.

RESOLUTION - AUTHORIZING CHAIR OF THE BOARD TO ENTER
INTO AGREEMENTS FOR PROFESSIONAL ENGINEERING SERVICES
FOR VARIOUS COUNTY ROADS AND BRIDGES FOR THE YEAR
2015
MCCARTY, FRAZIER, ROSENTHAL, KOUTNIK
WHEREAS, certain engineering firms propose to render professional
engineering services to the Otsego County Highway Department in connection
with various County roads and bridges for the year 2015; and
WHEREAS, it appears to be in the best interests of the County to contract

with these engineering firms for these professional engineering services; said
services being professional in nature and not requiring public bidding; now,
therefore, be it
RESOLVED, that the Chair of this Board be and hereby is authorized to

CONTRACT FOR PURCHASE OF CERTAIN SERVICES
(REPLACEMENT OF BIN #3353930)
MCCARTY, FRAZIER, ROSENTHAL, KOUTNIK
WHEREAS, Resolution No. 322-20130904 authorized the Otsego County
Superintendent of Highways to enter into a contract with New Century
Construction, LLC, for the construction of bridge BIN #3353930, located on County
Route 11C over the Susquehanna River, in the Towns of Hartwick/Middlefield,
Otsego County, New York, at a cost not to exceed $1,654,400; and
WHEREAS, there is a need to amend Resolution No. 322-2013 for an
additional cost not to exceed $41,088; now, therefore, be it

RESOLVED, that the Otsego County Superintendent of Highways be and
hereby is authorized to amend a contract with New Century Construction, LLC, 11
Arch Street, Watervliet, New York 12189-1805, for the construction of bridge BIN
#3353930, located on County Route 11C over the Susquehanna River, in the
Towns of Hartwick/Middlefield, Otsego County, New York, for an additional cost
not to exceed $41,088 for construction; and be it further

RESOLUTION - AUTHORIZING CHAIR TO EXECUTE
CONTRACT WITH PSYCHIATRIC CONSULTANT FOR
SERVICES AT THE OTSEGO COUNTY COMMUNITY
SERVICES CLINIC
LINDBERG, QUACKENBUSH, ROWINSKI
WHEREAS, there is a need for the services of a Psychiatric Consultant at
the Otsego County Community Services Clinic; and
WHEREAS, Samuel Press, M.D. has expressed a willingness to provide his
services approximately every other week to said clinic to work with children;
now, therefore, be it
RESOLVED, that the Chair of this Board be and hereby is authorized to
execute a contract with Samuel Press, M.D., 303 Kinderhook Lane, Nassau, New
York 12133, for the aforesaid services, commencing January 1, 2015 through
December 31, 2015, at the rate of $160.00 per hour, not to exceed 700 hours per
year, at a cost not to exceed $112,000.00 for the term of the contract; and be it
further
RESOLVED, that the services provided by Dr. Press are to be arranged by
the Clinic Director; and be it further
RESOLVED, that Dr. Press agrees to maintain malpractice/professional
liability insurance during the term of the contract; and be it further

as are in the best interests of the County of Otsego; and be it further
RESOLVED, that the funds for this contract are included in the 2015 Mental

RESOLUTION - AUTHORIZING CHAIR TO EXECUTE CONTRACT
WITH KATE BOLGER, NPP, APRN, FOR PSYCHIATRIC NURSE
PRACTITIONER SERVICES AT THE
OTSEGO COUNTY COMMUNITY SERVICES CLINICS

WHEREAS, there is a need for the services of a Psychiatric Nurse
Practitioner at the Otsego County Community Services Clinics; and
WHEREAS, Kate Bolger, NPP, APRN, has expressed a willingness to provide
such services; now, therefore, be it
RESOLVED, that the Chair of this Board be and hereby is authorized to
execute a contract with Kate Bolger, NPP, APRN, 2410 Walley Road, Franklin,
New York 13775, for the services of a Psychiatric Nurse Practitioner at the Otsego
County Community Services Clinics, for the period January 1, 2015 through
December 31, 2015, for up to 624 hours of such services at $85.00 per hour, at a
cost not to exceed $53,040 for the term of the contract; and be it further
RESOLVED, that said contract shall contain such other terms and
provisions as are in the best interests of the County of Otsego; and be it further
RESOLVED, that the funds for this contract are included in the 2015 Mental
Health Budget (4310-A) at line 4880 Mental Health Consultant and in the 2015

RESOLUTION – AUTHORIZING CHAIR TO EXECUTE
CONTRACT WITH LISA CASLER, PMHNP, NPP,

FOR PSYCHIATRIC NURSE PRACTITIONER SERVICES FOR
OTSEGO COUNTY COMMUNITY SERVICES

WHEREAS, there is a need for psychiatric nurse practitioner services at the
Otsego County Community Services Clinic; and
WHEREAS, Lisa Casler, PMHNP, NPP, has expressed a willingness to provide
such services; now, therefore, be it
RESOLVED, that the Chair of this Board be and hereby is authorized to
execute a contract with Lisa Casler, PMHNP, NPP, 32 Hartford Terrace, New
Hartford, New York 13413, for psychiatric nurse practitioner services for the
Otsego County Community Services Clinic, for the period January 1, 2015
through December 31, 2015, at the rate of $80.00 per hour, for up to 800 hours,
not to exceed $64,000 for the term of the contract; and be it further
RESOLVED, that said contract shall contain such other terms and provisions
as are in the best interest of the County of Otsego; and be it further
RESOLVED, that the funds for this contract are included in the 2015 Mental
Health Budget (4310-A) at line 4880 Mental Health Consultant and consist of
100% reimbursement from fees, state and federal aid/reimbursement.
RESOLUTION NO. 12-20150107
RESOLUTION - AUTHORIZING THE CHAIR OF THE
BOARD TO EXECUTE CONTRACT WITH THE OTSEGO
COUNTY CHAPTER OF NYS ARC, INC. FOR SHELTERED
EMPLOYMENT
LINDBERG, QUACKENBUSH, ROWINSKI
WHEREAS, the Otsego County Chapter of NYS ARC, Inc. provides
sheltered employment to the developmentally disabled population of Otsego
County; and
WHEREAS, the Otsego County Board of Representatives agrees that there
is a need for these services and wishes to support them via pass-through state
aid funds and a local government contribution; now, therefore, be it
RESOLVED, that the Chair of the Board of Representatives be and hereby

is authorized to enter into a contract with the Otsego County Chapter of NYS
ARC, Inc. for the above services, for the period January 1, 2015 through
December 31, 2015, with total financial support for these services at $263,120,
consisting of the following:

RESOLUTION NO. 13-20150107
RESOLUTION – AUTHORIZING CHAIR OF THE BOARD
TO CONTRACT WITH THE MENTAL HEALTH ASSOCIATION
IN ULSTER COUNTY, INC.

WHEREAS, the State of New York has provided a grant in the amount of
$197,032 through the Community Reinvestment Act, for services of a Psychiatric
Nurse Practitioner or other qualified medical provider, to operate Adolescent
Outreach and Intensive Prevention Services; and
WHEREAS, the County, through the Otsego County Community Services

completion of an assessment, care plan and an individual budget approved by

WHEREAS, Otsego County, under a partnership with ARC Otsego, entered
into an agreement in March of 2010 for the coordination and expansion of the
County Public Transportation System (Otsego Express)to open ARC Otsego’s
current bus route, referred to as Route 6, Hartwick, Oneonta, to Sidney, for
public use; and
WHEREAS, in 2011, Otsego County entered into a second agreement with
ARC Otsego to include the expansion of the Public Transportation System
(Otsego Express) to open ARC Otsego’s current bus route referred to as Route 9,

Hartwick, New Lisbon, Garrattsville, Morris, Otego to Oneonta, for public use;
and
WHEREAS, ARC Otsego expressed an interest to continue the agreements
for 2015 and to coordinate the two routes with Otsego County and continue to
open the routes to the general public in order to service this area of the county;
now, therefore, be it
RESOLVED, that the Chair of this Board is authorized to extend an
agreement with ARC Otsego for the year 2015 to offer public transportation
service Monday through Friday along a fixed Route #6 and Route #9, Monday
through Fridays, with a cost share to Otsego County calculated at:

$ 1,630 per month ($19,560 per year) based on a 60% (ARC based
clients) and 40% (general public) relationship of anticipated ridership

therewith dated January 2000, prepared by Lyle Jones, Otsego County
Emergency Services Coordinator, and the Otsego County Self-Insurance
(Workers Compensation) Plan; and
WHEREAS, the New York Center for Agricultural Medicine and Health
Program (hereinafter referred to as NYCAMH) has provided such required
firefighters/EMS physicals in the past; and
WHEREAS, the COUNTY and NYCAMH desire to renew the contract for the

(STOP-DWI) and annually it is necessary to prepare, review and approve the final
plan for the operation of such program for the ensuing year; and

RESOLUTION – REQUESTING THE STATE OF NEW YORK TO AMEND
THE TAX LAW TO EXTEND OTSEGO COUNTY’S LOCAL SALES TAX
OF 4%
FRAZIER, LINDBERG, SCHWERD, HULSE
WHEREAS, Otsego County, and most all of New York State’s counties, are
beset by increasing costs in providing county municipal services, and Otsego
County does not believe it fair to raise the ad valorum tax upon the property
owners in this County to pay these increased costs; rather a sales tax increase
appears to be a fair means considering particularly the potential payers of such
a sales tax; and
WHEREAS, the State of New York has heretofore enacted enabling
legislation allowing Otsego County to levy and collect, under the Tax Law of the
State of New York, a local combined sales and compensating use tax of 4% with
an expiration date of November 30, 2015; and
WHEREAS, the County of Otsego now requests the New York State
Legislature to amend Article 29, and particularly Section 1210 of the Tax Law, to
permit Otsego County to continue the local combined sales and compensating
use tax for Otsego County to 4% beyond the November 30, 2015 expiration
date; now, therefore, be it
RESOLVED, pursuant to Section 40 of the Municipal Home Rule Law,
Otsego County requests the New York State Legislature and Governor to amend
Section 1210 of the New York State Tax Law to enable this County to continue to
levy and collect, as a combined sales and compensating use tax, a local tax of
4%.

RESOLUTION - AUTHORIZING THE CHAIR TO ENTER INTO A POWER
PURCHASE AGREEMENT WITH SOLAR CITY CORPORATION

WHEREAS, New York State Energy Research and Development Authority
(“NYSERDA”) has announced the award of funding to Solar City Corporation
(“the Seller”) for the development of a 2,325.60 kW solar photovoltaic system
(“the Project”) at the site of property owned and/or leased by Otsego County,
to be determined, through the NY-SUN Competitive Program; and
WHEREAS, Otsego County (“the County”) previously submitted a nonbinding letter of intent to NYSERDA indicating mutual intent between the Seller
and the County to develop the project and to enter into a power purchase
agreement (“PPA”); and
WHEREAS, the Project will be designed, installed, and maintained at no
cost to the County and would provide a reduced cost of electricity during the
project’s 20 year life beginning on the Commercial Operation Date, with up to
two (2) additional terms of five (5) years each; and
WHEREAS, the County will pay to the Seller a fixed contract price of
$0.0690/kWh for power produced by the Project; and
WHEREAS, pursuant to a Performance Guarantee, the Seller will guarantee
that during the term of the PPA, the system will generate the guaranteed
kilowatt-hours (kWh) of energy as set forth below:

WHEREAS, at the end of each successive sixty (60) month anniversary of

guaranteed kWh and the cumulative actual kWh multiplied by the guaranteed
energy price per kWh as defined above, within 30 days after the end of the
relevant calendar year; and
WHEREAS, at the end of the successive sixty (60) month anniversary of the
Commercial Operations date the actual kWh is greater than the guaranteed
kWh during any sixty (60) month period, this surplus will be carried over and will
be used to offset any deficits that may occur in the next true up period; and
WHEREAS, all figures as presented in the PPA and Performance Guarantee
are subject to the final site determination, installation and design of the system;
and
WHEREAS, the County wishes to pursue this partnership and seeks to enter
into a PPA and a Performance Guarantee with the Seller for the purchase of
electricity to be utilized at county properties owned and/or leased by the
County; now, therefore, be it
RESOLVED, that the County Chair of the Board of Representatives is
hereby authorized to enter into a Power Purchase Agreement and a
Performance Guarantee with Solar City Corporation for the project containing
the terms and conditions stated herein, said agreement to contain such
additional terms and conditions as are in the best interest of Otsego County and
subject to approval by the County Attorney’s office.

PBA which covered the period of January 1, 2010 through December 31, 2016
(“2010 – 2016 Agreement”); and
WHEREAS, this Board has been notified that the PBA’s members have
voted in favor of ratification of the successor agreement; and
WHEREAS, this Board has reviewed the terms of said agreement; now,
therefore, be it
RESOLVED, that this Board hereby ratifies the terms of the successor
agreement, a copy of which is on file with the Clerk of the Board, to which
reference is made as if the terms were fully set forth in this Resolution, and
authorizes the Board’s Chair to execute the successor agreement on behalf of
