Chair Clark declared Representative Frazier the Vice Chairman for 2015. 2 Under Privilege of the Floor, Maria Ajello, concerned tax payer and County Employee, asked that the County vacate the sale of her property from the recent property tax auction and allow her to pay her back taxes, penalties and fees. Russell Ahrens, concerned tax payer and County Employee, stated that unlike surrounding counties, Maria Ajello was not allowed to pay her back taxes 51 days prior to the auction, and asked that the County allow her to redeem her home. David Petri, County Highway 59 Cooperstown, NY, stated that he is concerned that the Highway Department is plowing and salting roads when not always necessary, which causes increases in fuel and salt costs and the potential for falling trees due to the overuse of salt, and asked that this be addressed. The minutes of December 3, 2014 and December 15, 2014 were approved. The reports of the Standing Committees were given and ordered filed. The reports of the Special Committees were given and ordered filed. RESOLUTION NO. 1-20150107 RESOLUTION - APPROVING EXECUTION OF CONTRACT FOR THE PROVISION OF ALCOHOLISM SERVICES IN OTSEGO COUNTY LINDBERG, QUACKENBUSH, ROWINSKI WHEREAS, funds are available through the New York State Office of Alcoholism and Substance Abuse Services to Otsego County for purposes of providing educational services, information and referral services for residents of Otsego County suffering from the diseases of alcoholism and other addictions; and WHEREAS, in addition, Task Force on Integrated Projects (TFIP) 100% funds are available under the auspices of the New York State Office of Alcoholism and Substance Abuse Services; these TFIP funds will be administered under the Division of Alcoholism and Alcohol Abuse (DAAA); and WHEREAS, the amount of the funding for the Information and Referral Services and the Task Force on Integrated Projects totals $412,348; and WHEREAS, the Leatherstocking Education on Alcoholism/Addictions Foundation, Inc. (LEAF, Inc.) has expressed a willingness and desire to continue to act as an agency to the County for purposes of providing these alcoholism and other addictions educational services; and WHEREAS, it appears to be in the best interests of the residents of the County of Otsego to provide these services; now, therefore, be it RESOLVED, that upon receipt of the $412,348 in funds from the State of New York as above set forth, the Chair of the Board of Representatives and the Director of the Community Services are authorized to execute an alcoholism/addictions services contract, on behalf of the County of Otsego, with LEAF for the contract period January 1, 2015 through December 31, 2015; 4 and be it further RESOLVED, that said contract shall contain such terms and provisions as are in the best interests of the County of Otsego and are complying with all federal, state and local statutes, rules and regulations which would enable LEAF to continue to utilize designated funds to operate a program of alcoholism/addictions informational and educational services in the County of Otsego; and be it further RESOLVED, that upon the expiration of the term of the aforementioned contract, a subsequent resolution must be adopted by this Board to authorize the extension of additional terms of said contract; and be it further RESOLVED, that the funds for this contract are included in the 2015 Contr Chem Dependency Program Budget (4323-A) at line 4698 LEAF and consist of 100% state funds. RESOLUTION NO. 2-20150107 RESOLUTION - AUTHORIZING CHAIR TO EXECUTE CONTRACT FOR RECOVERY SUPPORT SERVICES FOR THE CHEMICAL DEPENDENCIES CLINIC LINDBERG, QUACKENBUSH, ROWINSKI WHEREAS, there is a need for recovery support services at the Otsego County Chemical Dependencies Clinic; and WHEREAS, Friends of Recovery of Delaware and Otsego (FOR-DO), 22 Elm Street, Oneonta, New York 13820 has agreed to provide such services as set forth below; now, therefore, be it RESOLVED, that contingent upon Otsego County’s receipt of funding from New York State, the Chair of this Board be and hereby is authorized to execute a contract with FOR-DO for recovery support services for the Chemical Dependencies Clinic, commencing January 1, 2015 through December 31, 2015, not to exceed $151,500 for the term of the contract; and be it further RESOLVED, that said contract shall contain such other terms and provisions as are in the best interests of the County of Otsego; and be it further RESOLVED, that the funds for this contract are included in the 2015 Turning Point Budget (4327-A) at line 4800 and consist of 100% reimbursement from state 5 funds. RESOLUTION NO. 3-20150107 RESOLUTION – AUTHORIZING THE CHAIR TO EXECUTE AN AGREEMENT WITH CATHOLIC CHARITIES OF DELAWARE AND OTSEGO COUNTIES FOR OPERATION OF THE ALTERNATIVES TO INCARCERATION PROGRAM POWERS, MCCARTY, QUACKENBUSH, GELBSMAN, LENTZ WHEREAS, in order to assist Otsego County Courts and Law Enforcement agencies in promoting appropriate and effective Alternatives to Incarceration experiences for eligible participants, Catholic Charities of Delaware and Otsego Counties has submitted a proposal to the County for the operation of the Otsego County Alternatives to Incarceration Program (ATI); and WHEREAS, the Public Safety and Legal Affairs Committee and the Administration Committee of this Board have approved this proposal and consider it to be in the best interests of the County; now, therefore, be it RESOLVED, that the Chair of this Board is authorized to execute an agreement with Catholic Charities of Delaware and Otsego Counties, with offices located at 176 Main Street, Oneonta, New York 13820, for the operation of the Otsego County Alternatives to Incarceration Program for the year 2015, at a total cost of $29,004, payable in twelve (12) monthly installments of $2,417 per month; and be it further RESOLVED, that the agreement shall contain such other terms and provisions as are in the best interest of the County of Otsego; and be it further RESOLVED, that the funding for this contract is included in the 2015 Alternatives to Incarceration Budget (3157-A) at line 4900 Contracts. RESOLUTION NO. 4-20150107 RESOLUTION - AUTHORIZING THE CHAIR OF THE BOARD TO EXECUTE AGREEMENTS WITH VARIOUS HEALTH CARE FACILITIES FOR SEXUALLY TRANSMITTED DISEASE CLINIC SERVICES 6 LINDBERG, QUACKENBUSH, ROWINSKI WHEREAS, Section 2304(1) of the Public Health Law requires that each Board of Health of a Health District provide facilities for free diagnosis and treatment of persons suspected of being infected or who are infected with a sexually transmitted disease; and WHEREAS, Family Planning of South Central NY and A.O. Fox Hospital are willing to provide these services for the County; and WHEREAS, it is in the best interest of the County to enter into agreements with the aforementioned medical facilities for the provision of such services; now, therefore, be it RESOLVED, that the Chair of this Board be and hereby is authorized to execute agreements with Family Planning of South Central NY, Oneonta, New York; and A.O. Fox Hospital, Oneonta, New York, to provide to the County the professional services necessary and required by Section 2304(1) of the Public Health Law regarding the diagnosis and treatment of persons suspected of being infected or actually infected with a sexually transmitted disease, for a period of one (1) year commencing January 1, 2015 and terminating December 31, 2015; and be it further RESOLVED, that said contracts shall contain such other terms and conditions as are in the best interest of the County of Otsego; and be it further RESOLVED, that the funding for these contracts is included in the 2015 Biologicals Budget (4074-A) at lines 4895 Medical Expenses and 4900 Contracts and is 100% state reimbursable. RESOLUTION NO. 5-20150107 RESOLUTION - AUTHORIZING THE CHAIR OF THE BOARD TO EXECUTE AGREEMENTS WITH VARIOUS HEALTH CARE FACILITIES FOR HIV COUNSELING AND TESTING LINDBERG, QUACKENBUSH, ROWINSKI WHEREAS, Section 2304(1) of the Public Health Law requires that each Board of Health of a Health District provide facilities for free counseling and testing of persons suspected of being infected or who are infected with HIV; and WHEREAS, Family Planning of South Central NY and A.O. Fox Hospital are 7 willing to provide these services for the County; and WHEREAS, it is in the best interest of the County to enter into agreements with the aforementioned medical facilities for the provision of such services; now, therefore, be it RESOLVED, that the Chair of this Board be and hereby is authorized to execute agreements with Family Planning of South Central NY, Oneonta, New York, and A.O. RESOLUTION NO. 6-20150107 RESOLUTION - AUTHORIZING THE CHAIR OF THE BOARD TO CONTRACT FOR THE DEPARTMENT OF HEALTH’S EARLY INTERVENTION PROGRAM AND PRESCHOOL PROGRAM CONTRACTED SERVICES LINDBERG, QUACKENBUSH, ROWINSKI RESOLVED, that the Chair of the Board be and hereby is authorized to execute agreements with certain individuals and/or organizations to provide the following Department of Health’s Early Intervention Program and Preschool Program Contracted Services for the year 2015 at 2015 state approved contract rates: Services Under Preschool Education Related Services (Speech, Occupational Therapy, Physical Therapy, etc.) Psychological Evaluations Social History Non-Physician Evaluation 8 Physical Evaluations Itinerant Special Education Teacher Center Based Tuition 1:1 Aide w/in Center Based Child Assistant Transportation Parent Training Services Under Early Intervention Transportation Respite and be it further RESOLVED, that said agreements shall contain such other terms and provisions as are in the best interest of the County of Otsego; and be it further RESOLVED, that the funds for the above agreements/services are included in the 2015 Children with Special Needs – Education Budget (2960-A); Early Intervention Program Budget (4059-A), and the DOH – CWSN 3-5 Administration Budget (4060-A). Reimbursement includes Medicaid, third party insurance, then 49% from the NYS Department of Health (EI) or 59.5% from the NYS Department of Education for direct service. RESOLUTION NO. 7-20150107 RESOLUTION - AUTHORIZING CHAIR OF THE BOARD TO ENTER INTO AGREEMENTS FOR PROFESSIONAL ENGINEERING SERVICES FOR VARIOUS COUNTY ROADS AND BRIDGES FOR THE YEAR 2015 MCCARTY, FRAZIER, ROSENTHAL, KOUTNIK WHEREAS, certain engineering firms propose to render professional engineering services to the Otsego County Highway Department in connection with various County roads and bridges for the year 2015; and WHEREAS, it appears to be in the best interests of the County to contract 9 with these engineering firms for these professional engineering services; said services being professional in nature and not requiring public bidding; now, therefore, be it RESOLVED, that the Chair of this Board be and hereby is authorized to contract with the following engineering firms to render professional engineering services for various County roads and bridges during the year 2015, in accordance with the hourly rate schedules, which are on file in the Office of the Clerk of the Board; these services being professional in nature and not requiring public bidding by the County: 1. RESOLUTION NO. 8-20150107 RESOLUTION – AMENDING RESOLUTION NO. 322-20130904 AUTHORIZING SUPERINTENDENT OF HIGHWAYS TO CONTRACT FOR PURCHASE OF CERTAIN SERVICES (REPLACEMENT OF BIN #3353930) MCCARTY, FRAZIER, ROSENTHAL, KOUTNIK WHEREAS, Resolution No. 322-20130904 authorized the Otsego County Superintendent of Highways to enter into a contract with New Century Construction, LLC, for the construction of bridge BIN #3353930, located on County Route 11C over the Susquehanna River, in the Towns of Hartwick/Middlefield, Otsego County, New York, at a cost not to exceed $1,654,400; and WHEREAS, there is a need to amend Resolution No. 322-2013 for an additional cost not to exceed $41,088; now, therefore, be it 11 RESOLVED, that the Otsego County Superintendent of Highways be and hereby is authorized to amend a contract with New Century Construction, LLC, 11 Arch Street, Watervliet, New York 12189-1805, for the construction of bridge BIN #3353930, located on County Route 11C over the Susquehanna River, in the Towns of Hartwick/Middlefield, Otsego County, New York, for an additional cost not to exceed $41,088 for construction; and be it further RESOLVED, that said agreement shall contain such other terms and conditions as are in the best interest of the County of Otsego; and be it further RESOLVED, that the funds for this project are available in the 2013-14 Highway Budget under D5112.2020, D5113.2121 and D5113.2104. RESOLUTION NO. 9-20150107 RESOLUTION - AUTHORIZING CHAIR TO EXECUTE CONTRACT WITH PSYCHIATRIC CONSULTANT FOR SERVICES AT THE OTSEGO COUNTY COMMUNITY SERVICES CLINIC LINDBERG, QUACKENBUSH, ROWINSKI WHEREAS, there is a need for the services of a Psychiatric Consultant at the Otsego County Community Services Clinic; and WHEREAS, Samuel Press, M.D. has expressed a willingness to provide his services approximately every other week to said clinic to work with children; now, therefore, be it RESOLVED, that the Chair of this Board be and hereby is authorized to execute a contract with Samuel Press, M.D., 303 Kinderhook Lane, Nassau, New York 12133, for the aforesaid services, commencing January 1, 2015 through December 31, 2015, at the rate of $160.00 per hour, not to exceed 700 hours per year, at a cost not to exceed $112,000.00 for the term of the contract; and be it further RESOLVED, that the services provided by Dr. Press are to be arranged by the Clinic Director; and be it further RESOLVED, that Dr. Press agrees to maintain malpractice/professional liability insurance during the term of the contract; and be it further 12 RESOLVED, that said contract shall contain such other terms and provisions as are in the best interests of the County of Otsego; and be it further RESOLVED, that the funds for this contract are included in the 2015 Mental Health Budget (4310-A) at line 4880 Mental Health Consultant and from the 2015 Alcoholism Budget (4250-A) at line 4880 Consultants and consist of 100% reimbursement from fees, state and federal funds. RESOLUTION NO. 10-20150107 RESOLUTION - AUTHORIZING CHAIR TO EXECUTE CONTRACT WITH KATE BOLGER, NPP, APRN, FOR PSYCHIATRIC NURSE PRACTITIONER SERVICES AT THE OTSEGO COUNTY COMMUNITY SERVICES CLINICS LINDBERG, QUACKENBUSH, ROWINSKI WHEREAS, there is a need for the services of a Psychiatric Nurse Practitioner at the Otsego County Community Services Clinics; and WHEREAS, Kate Bolger, NPP, APRN, has expressed a willingness to provide such services; now, therefore, be it RESOLVED, that the Chair of this Board be and hereby is authorized to execute a contract with Kate Bolger, NPP, APRN, 2410 Walley Road, Franklin, New York 13775, for the services of a Psychiatric Nurse Practitioner at the Otsego County Community Services Clinics, for the period January 1, 2015 through December 31, 2015, for up to 624 hours of such services at $85.00 per hour, at a cost not to exceed $53,040 for the term of the contract; and be it further RESOLVED, that said contract shall contain such other terms and provisions as are in the best interests of the County of Otsego; and be it further RESOLVED, that the funds for this contract are included in the 2015 Mental Health Budget (4310-A) at line 4880 Mental Health Consultant and in the 2015 Alcoholism Budget (4250-A) at line 4880 Consultants and consist of 100% reimbursement from fees, state and federal funds. RESOLUTION NO. 11-20150107 RESOLUTION – AUTHORIZING CHAIR TO EXECUTE CONTRACT WITH LISA CASLER, PMHNP, NPP, 13 FOR PSYCHIATRIC NURSE PRACTITIONER SERVICES FOR OTSEGO COUNTY COMMUNITY SERVICES LINDBERG, QUACKENBUSH, ROWINSKI WHEREAS, there is a need for psychiatric nurse practitioner services at the Otsego County Community Services Clinic; and WHEREAS, Lisa Casler, PMHNP, NPP, has expressed a willingness to provide such services; now, therefore, be it RESOLVED, that the Chair of this Board be and hereby is authorized to execute a contract with Lisa Casler, PMHNP, NPP, 32 Hartford Terrace, New Hartford, New York 13413, for psychiatric nurse practitioner services for the Otsego County Community Services Clinic, for the period January 1, 2015 through December 31, 2015, at the rate of $80.00 per hour, for up to 800 hours, not to exceed $64,000 for the term of the contract; and be it further RESOLVED, that said contract shall contain such other terms and provisions as are in the best interest of the County of Otsego; and be it further RESOLVED, that the funds for this contract are included in the 2015 Mental Health Budget (4310-A) at line 4880 Mental Health Consultant and consist of 100% reimbursement from fees, state and federal aid/reimbursement. RESOLUTION NO. 12-20150107 RESOLUTION - AUTHORIZING THE CHAIR OF THE BOARD TO EXECUTE CONTRACT WITH THE OTSEGO COUNTY CHAPTER OF NYS ARC, INC. FOR SHELTERED EMPLOYMENT LINDBERG, QUACKENBUSH, ROWINSKI WHEREAS, the Otsego County Chapter of NYS ARC, Inc. provides sheltered employment to the developmentally disabled population of Otsego County; and WHEREAS, the Otsego County Board of Representatives agrees that there is a need for these services and wishes to support them via pass-through state aid funds and a local government contribution; now, therefore, be it RESOLVED, that the Chair of the Board of Representatives be and hereby 14 is authorized to enter into a contract with the Otsego County Chapter of NYS ARC, Inc. for the above services, for the period January 1, 2015 through December 31, 2015, with total financial support for these services at $263,120, consisting of the following: Office of People with Developmental Disabilities County Contribution TOTAL $229,370.00 33,750.00 $263,120.00 and be it further RESOLVED, that said contract shall contain such other terms and provisions as are in the best interests of the County of Otsego; and be it further RESOLVED, that the above contract is authorized in the 2015 Association for Retarded Citizens Budget (4330-A) at line 4695 ARC. RESOLUTION NO. 13-20150107 RESOLUTION – AUTHORIZING CHAIR OF THE BOARD TO CONTRACT WITH THE MENTAL HEALTH ASSOCIATION IN ULSTER COUNTY, INC. LINDBERG, QUACKENBUSH, ROWINSKI WHEREAS, the State of New York has provided a grant in the amount of $197,032 through the Community Reinvestment Act, for services of a Psychiatric Nurse Practitioner or other qualified medical provider, to operate Adolescent Outreach and Intensive Prevention Services; and WHEREAS, the County, through the Otsego County Community Services Board, desires to contract with the Mental Health Association in Ulster County, Inc., 221 Tuytenbridge Road, Lake Katrine, New York 12449, to effectuate these services for the year 2015; the same to be without cost to the County other than this state grant; now, therefore, be it RESOLVED, that the Chair of this Board is authorized to execute a contract for the year 2015 with the Mental Health Association in Ulster County, Inc. for the services of a Psychiatric Nurse Practitioner or other qualified medical provider, to operate Adolescent Outreach and Intensive Preventive Services for children and adolescents aged 5-21 years, utilizing 100% Community Reinvestment Act funding in the amount not to exceed $197,032, contingent upon the availability of on-going state funding; and be it further 15 RESOLVED, that said contract shall contain such other terms and obligations as shall be in the best interest of the County of Otsego; and be it further RESOLVED, that funding for this contract is included in the 2015 Harbour Program – Reinvestment Budget (4326-A) at line 4693 MHA and is 100% reimbursable through New York State Community Reinvestment Act Funding. RESOLUTION NO. 14-20150107 RESOLUTION - AUTHORIZING CHAIR TO EXECUTE CONTRACT WITH THE NEIGHBORHOOD CENTER, INC. FOR PSYCHIATRIC CRISIS SERVICES AT THE COMMUNITY SERVICES CLINIC LINDBERG, QUACKENBUSH, ROWINSKI WHEREAS, there is a need for psychiatric crisis services at the Otsego County Community Services Clinic; and WHEREAS, The Neighborhood Center, Inc., through a Mobile Crisis Assessment Team serving Otsego, Chenango, Delaware and Schoharie Counties, has expressed a willingness to provide services from January 1, 2015 through December 31, 2015; now, therefore, be it RESOLVED, that the Chair of this Board be and hereby is authorized to execute a contract with The Neighborhood Center, Inc., through a Mobile Crisis Assessment Team serving Otsego, Chenango, Delaware and Schoharie Counties, for the aforesaid services, commencing January 1, 2015 through December 31, 2015, at a rate not to exceed $617,170 for the term of the contract; and be it further RESOLVED, that the services provided by The Neighborhood Center, Inc. are to be arranged by the Clinic Director; and be it further RESOLVED, that The Neighborhood Center, Inc. agrees to maintain malpractice/professional liability insurance during the term of the contract; and be it further RESOLVED, that said contract shall contain such other terms and provisions as are in the best interests of the County of Otsego; and be it further 16 RESOLVED, that the funds for this contract are included in the 2015 Mental Health Budget (4325-A) at line 4810 Crisis Services and consist of 100% reimbursement from state aid funding. RESOLUTION NO. 15-20150107 RESOLUTION – AMENDING RESOLUTION NO. 399-20131204 – AUTHORIZING CHAIR TO ENTER INTO CONTRACT WITH PRESTIGE SERVICES, INC. FOR OPERATION OF THE NUTRITION PROGRAM FOR THE ELDERLY LINDBERG, QUACKENBUSH, ROWINSKI WHEREAS, Resolution No. 399-20131204 authorized the Chair of the Board to execute a contract with Prestige Services, Inc. to operate Otsego County’s nutrition program for the elderly for the period of January 1, 2014 through December 31, 2017; now, therefore, be it RESOLVED, that the cost to operate said program will be as follows: 2015 Meals – Home Delivered Meals not to exceed $7.35 per meal Congregate Meals not to exceed $8.22 per meal; and be it further RESOLVED, that the total cost to operate Otsego County’s Nutrition Program for the Elderly for the year 2015 shall not exceed $771,540; and be it further RESOLVED, that the funds for this contract are included in the 2015 Office for the Aging (6772-A) approved budget and that the funding for this contract consists of approximately 23.6% federal funds, 20.5% state funds, 10% contributions, 7.9% Other and 38% county funds. RESOLUTION NO. 16-20150107 RESOLUTION – AUTHORIZING THE CHAIR OF THE BOARD TO ENTER INTO AN AGREEMENT WITH RESOURCE CENTER FOR INDEPENDENT LIVING FOR THE PROVISION OF VETERANS DIRECTED HOME AND COMMUNITY BASED SERVICES THROUGH THE OFFICE FOR THE AGING LINDBERG, QUACKENBUSH, ROWINKSI 17 WHEREAS, the Veterans Administration has identified a need for Veterans Directed Home and Community Based Services in Otsego County; and WHEREAS, Resolution 77-20110209 authorized the Chairman of the Board to enter into a Provider Agreement with the Veteran’s Administration to provide such services through the Office for the Aging; and WHEREAS, said services require a Fiscal Intermediary to act as employer of record for Veteran Directed Workers, and Resource Center for Independent Living of 409 Columbia Street, PO Box 210, Utica NY 13503 is willing and able to provide this service; and WHEREAS, all services are determined appropriate through the completion of an assessment, care plan and an individual budget approved by the Veterans Administration; and WHEREAS, such reimbursement shall be approximately $66,000; now, therefore, be it RESOLVED, that the Chair of this Board be and hereby is authorized to execute an agreement with Resource Center for Independent Living to provide such services at an amount not to exceed $66,000 for the period of January 1, 2015 through December 31, 2015; and be it further RESOLVED, that these funds are included in the 2015 Office for the Aging Budget, and are 100% reimbursable. RESOLUTION NO. 17-20150107 RESOLUTION – AUTHORIZING RETAINING A CONSULTANT DIETICIAN BY THE OFFICE FOR THE AGING LINDBERG, QUACKENBUSH, ROWINSKI WHEREAS, this Board has heretofore approved the administration of the Title III-C and the Supplemental Nutrition Assistance Program; and within each of the above programs, there is a requirement of a position of Consultant Dietician; and WHEREAS, Title IIID of the Older Americans Act requires provision of Health Promotional Activities; and 18 WHEREAS, Regina M. La Tourette has expressed a willingness to provide these services under these programs; and WHEREAS, the Nutrition Program Standards require that this Consultant Dietician report directly to the Otsego County Office for the Aging for both nutrition programs; now, therefore, be it RESOLVED, that the Chair of the Board be and is hereby authorized to enter into an agreement with Regina M. La Tourette for the period January 1, 2015 to December 31, 2015 for 11.5 hours per week for nutrition services and approximately 62 hours annually for health promotion activities at the rate of $41.50 per hour not to exceed $27,390 for the contract period. In addition, up to a maximum of $1,468 shall be available for mileage reimbursement at the standard IRS rate, for a total not to exceed $28,858; and be it further RESOLVED, that these funds are included in the 2015 Office for the Aging Budget, and the funds consist of approximately 22.4% federal funds, 55.4% state funds and 22.2% local funds. RESOLUTION NO. 18-20150107 RESOLUTION - AUTHORIZING CHAIR OF THE BOARD TO CONTRACT WITH BASSETT HEALTHCARE FOR MEDICAL SERVICES AT THE COUNTY CORRECTIONAL FACILITY POWERS, MCCARTY, QUACKENBUSH, GELBSMAN, LENTZ WHEREAS, there is a need for medical services at the County's Correctional Facility; and WHEREAS, Bassett Healthcare has submitted a proposal to the County for said services; now, therefore, be it RESOLVED, that the Chair of this Board be and hereby is authorized to enter into a contract with Bassett Healthcare at a cost of $25,000 for a period of 6 months for the following: 1. A physician in the employ of Bassett Healthcare to supervise Hospital’s provision of specified medical care pursuant to Section 7010.1 of Title 9, Subtitle AA, Chapter I of the Official Compilation of Codes, Rules and Regulations of the State of 19 New York. 2. The Hospital’s Physician will provide on-site services at the Otsego County Jail once weekly and will review the nurse’s activities and medical record documentation to meet all jail inmate population needs that can be addressed on an outpatient basis. 3. The Hospital’s Physician will write prescriptions as medically necessary, but will not store drugs nor dispense drugs to inmates. 4. Hospital will provide laboratory and radiology services and inpatient and outpatient services as ordered by Physician, to be billed at the Hospital’s usual rate and to be paid by County within 30 days of receipt of invoices. and be it further RESOLVED, that said contract shall contain such other terms and provisions as are in the best interests of the County of Otsego; and be it further RESOLVED, that the funding for this contract is included in the 2015 Jail Budget (3150-A) at line 4900 Contracts. RESOLUTION NO. 19-20150107 RESOLUTION – AUTHORIZING COMMISSIONER OF SOCIAL SERVICES TO CONTRACT WITH COMMUNITY MATERNITY SERVICES FOR PARENTING EDUCATION TO ELIGIBLE CLIENTS KOUTNIK, SCHWERD, HULSE WHEREAS, Otsego County desires to utilize existing programming to obtain parenting education services for eligible families; and WHEREAS, Community Maternity Services has expressed a willingness to provide intensive in-home parent education services for eligible clients; now, therefore be it RESOLVED, that the Commissioner of the Otsego County Department of Social Services is hereby authorized to contract with Community Maternity Services to provide parent education services to eligible clients for the period of 20 January 1, 2015 through December 31, 2015; and that said contract shall include the following terms: 1. In no event shall the Department of Social Services’ liability exceed $79,000 for the term of this agreement; 2. The contract shall contain such other and further conditions as are in the best interest of the County of Otsego; and be it further RESOLVED, that the funding for this contract is included in the 2015 Social Services Administration Budget (6010-A) at line 4900 Contracts and line 6070 Purchase of Services, and consists of either 100% Federal funds, or 64% Federal, 24% State and 12% local funds. RESOLUTION NO. 20-20150107 RESOLUTION - AUTHORIZING COMMISSIONER OF SOCIAL SERVICES AND THE DIRECTOR OF OFFICE FOR THE AGING TO EXECUTE AN AGREEMENT FOR VARIOUS MEDICAID FUNDED LONG TERM CARE IN-HOME SERVICES PROGRAMS AND THE OPERATION OF A POINT OF ENTRY FOR LONG TERM CARE SERVICES KOUTNIK, SCHWERD, HULSE WHEREAS, Social Services has a responsibility to administer and case manage various Medicaid funded long term care in-home service programs including the Personal Care Aide Program, the Long Term Home Health Care Program, Personal Emergency Response Systems, the Consumer Directed Personal Assistance Program, the Assisted Living Program, the Care at Home Program, Private Duty Nursing and the Title XX Family Type Homes for Adult Supervision, and has a long-standing history of providing information and assistance to county residents regarding long term care services; and WHEREAS, the Otsego County Office for the Aging has expressed a willingness to provide the administration and case management of these and any such successor or related programs; now, therefore, be it RESOLVED, that the Commissioner of Social Services and the Director of the Otsego County Office for the Aging are hereby authorized to execute an agreement and other documents that may be necessary for the provision of these services in an amount not to exceed $275,215 for the period of January 1, 21 2015 through December 31, 2015; and be it further RESOLVED, that the funding for this contract is included in the 2015 Social Services Administration Budget (6010-A) at line 4900 Contracts and is 95% Federal and State reimbursable and 5% local costs. RESOLUTION NO. 21-20150107 RESOLUTION – AUTHORIZING OTSEGO COUNTY COMMISSIONER OF SOCIAL SERVICES TO RENEW CONTRACT WITH OPPORTUNITIES FOR OTSEGO, INC. (OFO) TO PROVIDE EMERGENCY HOUSING AT THE OFO HOMELESS SHELTER KOUTNIK, SCHWERD, HULSE WHEREAS, the Otsego County Department of Social Services is required by regulation to provide emergency housing to homeless individuals and families; and WHEREAS, the County desires to meet this requirement in the most cost effective manner while at the same time providing some case management services; and WHEREAS, Opportunities for Otsego, Inc. has established a bed rate of $75.00 per day per person; now, therefore, be it RESOLVED, that the Commissioner of the Department of Social Services, on behalf of the County of Otsego, is hereby authorized to renew a contract with Opportunities for Otsego, Inc. for the term January 1, 2015 through December 31, 2015; and said contract shall include the following: 1. The bed rate will be $75.00 per day per person eligible for Temporary Assistance program funding; and be it further RESOLVED, that said contract shall contain such other terms and provisions as are in the best interest of the County of Otsego; and be it further RESOLVED, that the funding for the contract is included in the 2015 Social Services Family Assistance Budget (6109-A) at line 4734 Family Assistance (consisting of 100% Federal funds) and Social Services Safety Net Budget (6140A) at line 4738 Safety Net Funds (consisting of 29% State and 71% Local), depending upon classification of the client. 22 RESOLUTION NO. 22-20150107 RESOLUTION – AUTHORIZING THE COMMISSIONER OF SOCIAL SERVICES TO RENEW CONTRACT WITH OPPORTUNITIES FOR OTSEGO, INC. TO PROVIDE NON-RESIDENTIAL PROGRAM SERVICES TO VICTIMS OF DOMESTIC VIOLENCE KOUTNIK, SCHWERD, HULSE WHEREAS, Otsego County Department of Social Services is responsible for providing domestic violence services to residents of Otsego County; and WHEREAS, Opportunities for Otsego has expressed a willingness to provide said services; now, therefore, be it RESOLVED, that the Otsego County Commissioner of Social Services is hereby authorized to contract with Opportunities for Otsego, Inc. to continue to provide non-residential program services to victims of domestic violence, in the contract sum not to exceed $55,000 for the period January 1, 2015 through December 31, 2015; and be it further RESOLVED, that said contract shall contain such other terms and conditions as are in the best interest of the County of Otsego; and be it further RESOLVED, that the funding for this contract is included in the 2015 Social Services Administration Budget (6010-A) at line 4900 Contracts and consists of 64% Federal, 24% State, and 12% local funds. RESOLUTION NO. 23-20150107 RESOLUTION – AUTHORIZING OTSEGO COUNTY COMMISSIONER OF SOCIAL SERVICES TO RENEW CONTRACT WITH THE OTSEGO COUNTY PROBATION DEPARTMENT KOUTNIK, SCHWERD, HULSE WHEREAS, Otsego County has been awarded Flexible Funding for Family Services in the overall sum of $2,411,179 for 2014- 2015; and WHEREAS, the New York State Office of Temporary and Disability Assistance has approved the County’s plan for the use of these funds; and 23 WHEREAS, there is a need to provide PINS Diversion Services to the residents of Otsego County; and WHEREAS, the Otsego County Probation Department has expressed a willingness to provide this service; now, therefore be it RESOLVED, that the Otsego County Commissioner of Social Services is hereby authorized to contract with the Otsego County Probation Department for the services of two (2) Probation Officers to provide PINS Diversion services on behalf of the Department of Social Services, at a cost not to exceed $110,316 for the period January 1, 2015 through December 31, 2015; and be it further RESOLVED, that said contract shall contain such other terms and provisions as are in the best interests of the County of Otsego; and be it further RESOLVED, that the funding for the contract is included in the 2015 Social Services Administration Budget (6010-A) at line 4900 Contracts and is 100% reimbursable through Federal funds. RESOLUTION NO. 24-20150107 RESOLUTION - AUTHORIZING OTSEGO COUNTY COMMISSIONER OF SOCIAL SERVICES TO CONTRACT WITH OTSEGO COUNTY COMMUNITY SERVICES KOUTNIK, SCHWERD, HULSE WHEREAS, the County has been awarded Flexible Funding for Family Services in the overall sum of $2,411,179 for 2014 - 2015; and WHEREAS, the New York State Office of Temporary and Disability Assistance has approved the County’s plan for the use of these funds; and WHEREAS, the County desires to utilize a portion of the funds, not to exceed $60,553 to purchase existing services for TANF eligible applicants and recipients in need of mental health services; and WHEREAS, the County desires to utilize existing programming to obtain services for eligible families; and WHEREAS, the Department desires to enter into an agreement with the Otsego County Community Services for the services of two (2) part-time Mental 24 Health Social Workers; now, therefore, be it RESOLVED, that the Otsego County Commissioner of Social Services is hereby authorized to execute an agreement with Otsego County Community Services for the term January 1, 2015 through December 31, 2015; and that the agreement shall include the following terms: 1. In no event shall the Department of Social Services’ liability exceed the sum of $60,553. 2. The contract shall contain such other and further conditions as are in the best interest of the County of Otsego. and be it further RESOLVED, that the funds for the above contract are included in the 2015 Social Services Administration Budget (6010-A) at line 4900 Contracts and consist of 100% Federal funds. RESOLUTION NO. 25-20150107 RESOLUTION – AUTHORIZING COMMISSIONER OF SOCIAL SERVICES TO CONTRACT WITH DELAWARE OPPORTUNITIES TO PROVIDE THE BIG BUDDIES PROGRAM KOUTNIK, SCHWERD, HULSE WHEREAS, Otsego County has been awarded Flexible Funding for Family Services in the overall sum of $2,411,179 for 2014 - 2015; and WHEREAS, the New York State Office of Temporary and Disability Assistance has approved the County’s plan for the use of these funds; and WHEREAS, the County desires to utilize a portion of the funds, not to exceed $25,000, to purchase existing services for eligible youth in need of a mentoring program ; and WHEREAS, Delaware Opportunities has expressed a willingness to provide a mentoring program entitled Big Buddies; now therefore be it RESOLVED, that the Commissioner of the Department of Social Services, on behalf of the County of Otsego, is hereby authorized to contract with Delaware Opportunities for the term January 1, 2015 through December 31, 25 2015; and that said contract shall include the following terms: 1. In no event shall the Department of Social Services’ liability exceed $25,000.00 for the term of the contract; 2. The contract shall contain such other and further conditions as are in the best interest of the County of Otsego; and be it further RESOLVED, that the funding for this contract is included in the 2015 Social Services Administration Budget (6010-A) at line 4900 Contracts and consists of 100% Federal Funds. RESOLUTION NO. 26-20150107 RESOLUTION – AUTHORIZING COMMISSIONER OF SOCIAL SERVICES TO CONTRACT WITH CATHOLIC CHARITIES OF DELAWARE AND OTSEGO COUNTIES FOR CHILD DAY CARE REGISTRATION KOUTNIK, SCHWERD, HULSE WHEREAS, the County has entered into a Memorandum of Understanding with the State of New York through the Office of Children and Family Services of the State of New York to register and inspect Family Day Care and SchoolAge Child Care Programs; and WHEREAS, the County is empowered to receive Federal Child Care and Development Block Grant funds in an amount up to $78,331 from the State of New York for the purpose of this Agreement; and WHEREAS, the County desires to contract with Catholic Charities of Delaware and Otsego Counties for the performance of said services; now, therefore, be it RESOLVED, that the Commissioner of the Department of Social Services on behalf of the County of Otsego, is hereby authorized to execute a contract with Catholic Charities of Delaware and Otsego Counties for the purpose of registration and inspection of Family Day Care Providers and School-Age Child Care Programs for the period January 1, 2015 to December 31, 2015, not to 26 exceed $78,331 for the term of the contract; and be it further RESOLVED, that the funding for this contract is included in the 2015 Social Services Administration Budget (6010-A) at line 4900 Contracts, and is 100% State reimbursable; and be it further RESOLVED, that said contract shall contain such other terms and provisions as are in the best interests of the County of Otsego. RESOLUTION NO. 27-20150107 RESOLUTION – AUTHORIZING COMMISSIONER OF SOCIAL SERVICES TO RENEW CONTRACT WITH DISTRICT ATTORNEY FOR WELFARE FRAUD INVESTIGATION AND PART-TIME ADA SERVICES KOUTNIK, SCHWERD, HULSE RESOLVED, that the Otsego County Commissioner of Social Services and the Otsego County District Attorney are hereby authorized to contract for welfare fraud investigation services through the District Attorney’s Office; the contract will provide three (3) part-time investigators, and part-time ADA services by hourly rate, at a cost not to exceed $91,927 for the period January 1, 2015 through December 31, 2015; and be it further RESOLVED, that said contract is to contain such other terms and conditions as are in the best interests of the County of Otsego; and be it further RESOLVED, that the funding for this contract is included in the 2015 Social Services Administration Budget (6010-A) at line 4900 Contracts and is 33% Federal and 5% State reimbursable and 62% Local cost. RESOLUTION NO. 28-20150107 RESOLUTION - AUTHORIZING THE CHAIR OF THE BOARD TO EXECUTE AN AGREEMENT WITH OTSEGO COUNTY SOIL AND WATER CONSERVATION DISTRICT ROWINSKI, MCCARTY, LENTZ, POWERS WHEREAS, pursuant to Resolution No. 8 of 1944, the Otsego County Board of Supervisors created a Soil and Water Conservation District in the County of Otsego to meet the needs of the agricultural community, landowners and the 27 environment; and WHEREAS, the County of Otsego has allocated funds in its budget for the fiscal year 2015 for the support and maintenance of the conservation work of the Otsego County Soil and Water Conservation District; and WHEREAS, it is appropriate that a contract with the Otsego County Soil and Water Conservation District be authorized to assure proper application of this expenditure; now, therefore, be it RESOLVED, that the Chair of this Board be and hereby is authorized to contract with the Otsego County Soil and Water Conservation District for the purpose of providing funds, not to exceed $118,500, to pay towards the support and maintenance of the conservation work of the Soil and Water Conservation District, for the contract term January 1, 2015 to December 31, 2015; and be it further RESOLVED, that said contract shall contain such other terms and provisions as are in the best interests of the County of Otsego; and be it further RESOLVED, that the funding for this contract is included in the 2015 Soil and Water Conservation Budget (8730-A) at line 4680 Annual Support Agreement. RESOLUTION NO. 29-20150107 RESOLUTION – AUTHORIZING CHAIR OF THE BOARD TO RENEW AN AGREEMENT WITH OTSEGO COUNTY CHAPTER NYSARC, INC. (HEREAFTER REFERRED TO AS ARC OTSEGO) TO CONTINUE THE OPERATION OF THE OTSEGO EXPRESS/ ARC SHARED PUBLIC TRANSPORTATION ROUTES #6 AND #9 SCHWERD, STULIGROSS, ROSENTHAL, GELBSMAN, HULSE WHEREAS, Otsego County, under a partnership with ARC Otsego, entered into an agreement in March of 2010 for the coordination and expansion of the County Public Transportation System (Otsego Express)to open ARC Otsego’s current bus route, referred to as Route 6, Hartwick, Oneonta, to Sidney, for public use; and WHEREAS, in 2011, Otsego County entered into a second agreement with ARC Otsego to include the expansion of the Public Transportation System (Otsego Express) to open ARC Otsego’s current bus route referred to as Route 9, 28 Hartwick, New Lisbon, Garrattsville, Morris, Otego to Oneonta, for public use; and WHEREAS, ARC Otsego expressed an interest to continue the agreements for 2015 and to coordinate the two routes with Otsego County and continue to open the routes to the general public in order to service this area of the county; now, therefore, be it RESOLVED, that the Chair of this Board is authorized to extend an agreement with ARC Otsego for the year 2015 to offer public transportation service Monday through Friday along a fixed Route #6 and Route #9, Monday through Fridays, with a cost share to Otsego County calculated at: Route #6: Hartwick – Oneonta - Sidney $ 1,630 per month ($19,560 per year) based on a 60% (ARC based clients) and 40% (general public) relationship of anticipated ridership Route #9: Hartwick-New Lisbon-Garrattsville-Morris-Gilbertsville-Otego to Oneonta $ 1,721 per month ($20,656 per year)based on a 60% (ARC based clients) and 40% (general public) relationship of anticipated ridership, and be it further, RESOLVED, that the agreement shall include quarterly reviews of ridership to monitor the cost share arrangement which will be adjusted to accurately reflect the percentage of ARC versus non-ARC riders; and be it further RESOLVED, that the County’s share will be allocated through State Transportation Operating Assistance (STOA) and New York State Department of Transportation 5311 operating funding and is included in the 2015 Public Transportation Service Budget (5630-A) at line 4900 Contracts. RESOLUTION NO. 30-20150107 RESOLUTION – AUTHORIZING CHAIR TO EXECUTE AGREEMENT WITH NYCAMH FOR PROVIDING FIREFIGHTERS/EMS PHYSICALS FRAZIER, LINDBERG, SCHWERD, HULSE WHEREAS, federal Occupational Safety and Health Administration (OSHA) regulations require firefighters or EMS to have pre-employment physical examinations, and to have physical examinations periodically thereafter, and 29 Otsego County has established a physical examination policy consistent therewith dated January 2000, prepared by Lyle Jones, Otsego County Emergency Services Coordinator, and the Otsego County Self-Insurance (Workers Compensation) Plan; and WHEREAS, the New York Center for Agricultural Medicine and Health Program (hereinafter referred to as NYCAMH) has provided such required firefighters/EMS physicals in the past; and WHEREAS, the COUNTY and NYCAMH desire to renew the contract for the year 2015 under the fee schedule as set forth below; now, therefore, be it RESOLVED, that the Chair of the Board is hereby authorized to contract with NYCAMH for the provision of required firefighters/EMS physicals for the year 2015, under the following fee schedule: The County will pay on behalf of any firefighter or EMS electing to use the services of NYCAMH/HealthWorks the sum of $35.00 for the following services: Physical Examinations Medical History $35.00 Respiratory Clearance Evaluation Additional services and screening will be provided when indicated per the following schedule: Respiratory Fit Test, OSHA History Fitness Certification $25.00 PFT $25.00 EKG $15.00 Cardiac Risk Screening (total & HDL Cholesterol) includes counseling $25.00 Audiograms $22.00 and be it further 30 RESOLVED, that said agreement shall contain such other terms and provisions as are in the best interest of the County of Otsego; and be it further RESOLVED, that the funding for these fees is included in the 2015 Workers Compensation Fund (1710-S) at line 4000 Physicals. RESOLUTION NO. 55-20150107 RESOLUTION - AUTHORIZING THE CHAIR TO ENTER INTO A POWER PURCHASE AGREEMENT WITH SOLAR CITY CORPORATION ROWINSKI, MCCARTY, LENTZ, POWERS WHEREAS, New York State Energy Research and Development Authority (“NYSERDA”) has announced the award of funding to Solar City Corporation (“the Seller”) for the development of a 2,325.60 kW solar photovoltaic system (“the Project”) at the site of property owned and/or leased by Otsego County, to be determined, through the NY-SUN Competitive Program; and WHEREAS, Otsego County (“the County”) previously submitted a nonbinding letter of intent to NYSERDA indicating mutual intent between the Seller and the County to develop the project and to enter into a power purchase agreement (“PPA”); and WHEREAS, the Project will be designed, installed, and maintained at no cost to the County and would provide a reduced cost of electricity during the project’s 20 year life beginning on the Commercial Operation Date, with up to two (2) additional terms of five (5) years each; and WHEREAS, the County will pay to the Seller a fixed contract price of $0.0690/kWh for power produced by the Project; and WHEREAS, pursuant to a Performance Guarantee, the Seller will guarantee that during the term of the PPA, the system will generate the guaranteed kilowatt-hours (kWh) of energy as set forth below: True Up Term Years Years 1-5 Years 6-10 Years 11-15 Years 16-20 Guaranteed kWh 13,504,360 13,170,110 12,844,133 12,526,225 and WHEREAS, at the end of each successive sixty (60) month anniversary of 53 the Commercial Operations date the cumulative actual kWh as defined above generated by the system is less than the guaranteed kWh, then the Seller will send the County a refund check equal to the difference between the guaranteed kWh and the cumulative actual kWh multiplied by the guaranteed energy price per kWh as defined above, within 30 days after the end of the relevant calendar year; and WHEREAS, at the end of the successive sixty (60) month anniversary of the Commercial Operations date the actual kWh is greater than the guaranteed kWh during any sixty (60) month period, this surplus will be carried over and will be used to offset any deficits that may occur in the next true up period; and WHEREAS, all figures as presented in the PPA and Performance Guarantee are subject to the final site determination, installation and design of the system; and WHEREAS, the County wishes to pursue this partnership and seeks to enter into a PPA and a Performance Guarantee with the Seller for the purchase of electricity to be utilized at county properties owned and/or leased by the County; now, therefore, be it RESOLVED, that the County Chair of the Board of Representatives is hereby authorized to enter into a Power Purchase Agreement and a Performance Guarantee with Solar City Corporation for the project containing the terms and conditions stated herein, said agreement to contain such additional terms and conditions as are in the best interest of Otsego County and subject to approval by the County Attorney’s office. RESOLUTION NO. 56-20150107 RESOLUTION - RATIFYING AND FUNDING COLLECTIVE BARGAINING AGREEMENT WITH THE OTSEGO COUNTY DEPUTY SHERIFF’S POLICE BENEVOLENT ASSOCIATION LINDBERG, FRAZIER, STULIGROSS WHEREAS, the County of Otsego (“County”), Otsego County Sheriff (“Sheriff”) and the Otsego County Deputy Sheriff’s Police Benevolent Association (“PBA”) concluded negotiations on January 6, 2015 for a successor agreement 54 to the collective bargaining agreement between the County, Sheriff and the PBA which covered the period of January 1, 2010 through December 31, 2016 (“2010 – 2016 Agreement”); and WHEREAS, this Board has been notified that the PBA’s members have voted in favor of ratification of the successor agreement; and WHEREAS, this Board has reviewed the terms of said agreement; now, therefore, be it RESOLVED, that this Board hereby ratifies the terms of the successor agreement, a copy of which is on file with the Clerk of the Board, to which reference is made as if the terms were fully set forth in this Resolution, and authorizes the Board’s Chair to execute the successor agreement on behalf of the County; and be it further RESOLVED, that this Board hereby approves the appropriation of any additional funds necessary to implement the terms of said successor agreement.
