AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE THE FIFTH AMENDMENT TO THE INTERLOCAL
AGREEMENT BETWEEN BROWARD COUNTY AND THE
CITY OF HALLANDALE BEACH FOR THE DESIGNATION OF
SUBRECIPIENT AND DISBURSEMENT NEIGHBORHOOD
STABILIZATION
PROGRAM
(NSP),
AMENDING
THE
GENERAL SCOPE OF SERVICES TO ALLOW FOR
REDEVELOPMENT
INCLUDING
DEMOLITION
IN
SUBSTANTIALLY THE SAME FORM AS ATTACHED IN
EXHIBIT “A”; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on three (3) separate occasions, the agreement has been amended
to extend the terms of the agreement; and
WHEREAS, the City and Broward County have further amended the estimated
project budget and insurance requirements; and

WHEREAS, on January 6, 2012, the City and Broward County entered into a

Third Amendment amending the estimated project budget by adjusting line item
30
amounts, eliminating down payment assistance; and

WHEREAS, the City and Broward County now desire to enter into a Fifth
33
Amendment thereby amending the general scope of services to expand the scope from
34
acquisition, rehabilitation and resale to redevelopment including acquisition, demolition,
35
and resale; and furthermore amending Exhibit B-5 to reflect the change in the scope
36
activity/cost; and

WHEREAS, City staff believe the Fifth Amendment agreement is necessary and
39
reasonable to reflect the expansion in the scope from acquisition, rehabilitation and
40
resale, to redevelopment including acquisition, demolition and resale, and to reflect
41
change in scope activity/cost; and

WHEREAS, the City Administration recommends that the Mayor and City
44
Commission authorize the City Manager to negotiate and execute the Fifth Amendment
45
to Interlocal Agreement for Designation of Subrecipient and Disbursement Neighborhood
46
Stabilization Program (NSP) in substantially the same form as attached as Exhibit A with
47
Broward County.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF HALLANDALE BEACH, FLORIDA:

SECTION 1. City Manager’s Authorization. The Mayor and City Commission
53
hereby authorize the City Manager to negotiate and execute the Fifth Amendment to
54
Interlocal Agreement between Broward County and the City of Hallandale Beach for
55
Designation of Subrecipient and Disbursement Neighborhood Stabilization Program
56
(NSP) in substantially the same form as Exhibit A attached to this resolution.

SECTION 2. Effective Date. This Resolution shall take effect immediately upon
its passage and adoption.
