McCarthy RESOLVED: “That the report of the Audit Committee on its review of the Local Government Auditor’s Reports on the Annual Financial Statements for 2013, for the Town Councils of Fermoy, Mallow, Cobh, Youghal, Midleton, Kinsale, Macroom, Clonakilty, Skibbereen, Bandon, Bantry and Passage West, be hereby approved.” REPORTS & RECOMMENDATIONS OF COMMITTEES Corporate Policy Group: CONFERENCE LIST FOR MAY 5/5-1 Proposed by Councillor D. O’Shea RESOLVED: “That the Conference List for May, 2015, approved by the Corporate Policy Group, at their meeting on 5th May, 2015, be hereby approved.” Housing SPC: HOUSING ALLOCATIONS TO SINGLE PERSONS 6/6-1 Members noted report from the Director of Housing, which outlined as follows:- At SPC Meeting of 28th April , it was proposed by the executive and agreed by the Members that single persons should be considered for a certain proportion of two bedroom properties along with couples and single parents with one/two children. Currently Cork County Council have 6974 applicants on its housing waiting list of which 2983 (42%) are single persons. Currently, where Single Persons are approved for Social Housing Support Elected Members should be aware that: In areas where there is a high refusal rate or low demand then Single Persons may already be considered for two bed units. The existing Allocation Scheme already sets out that where a Local Authority House has been refused twice then Cork County Council has discretion to assign this property to an applicant outside the normal priority and time on the list criteria. Additionally where an Applicant is over 60 years of age then they would generally considered for two bed units in order to provide for any possible carer needs. Likewise if a Single Person applies under 60 and sets out the necessity for an additional bedroom for Medical Reasons then they may be considered for approval for a two bedroom unit. Minmay1.15 Page 3 Where Single Persons with Children can show court ordered access to those children then they will be approved for units larger than a one bed unit. There is currently a Ministerial Direction in force requiring Local Authorities to ensure that 30% of all Allocations are given to those approved with the following basis of need: Homeless/Medical/Disability. Since the implementation of the new Social Housing Regulations in 2011, Cork County Council has adopted a policy whereby any Single Persons applying for SHS for the first time and leaving the family home (where this home is privately owned or a Local Authority House that is not over-crowded), has to provide documentation from a Medical Practitioner, Social Worker or Garda setting out the reasons why they have to leave the family home. If this supporting information is not provided then their application will be refused on the basis that their Housing Need is being met in the family home. Where a 2 bed unit is considered too small to house any household of more than one person then Single Person Households will be considered for those vacancies. Taking into consideration all of the above it is now proposed that: 20% of all 2 bed units would be allocated to Single Persons. Consideration will be given to Applicants with/in particular circumstances such as Medical, Compassionate, Separated Applicants Qualified for SHS - and would, as is the case with all other allocations, have to clear a Garda Check. Additionally the new Housing Assistance Payment would be actively promoted by Housing Staff as a means of Housing Support that could be used by the remaining Single Persons to satisfy their Housing Need. We propose to implement this Change to the Allocations Policy as a temporary measure for a 6 month period initially, and will report back to Members at the expiration of those 6 months. Members made the following points: This is a positive step and will help overcrowding situations in houses; When will the 6 month trial begin; How many units will be given out; 25% of single applicants housed in 2 years will not be achievable; There is a large number of older single males on the housing list for years, and single parents are taking precedence over them; Developers are saying that 2 bed units are not practical and there is no incentive for them to build such units; Council should consider the idea of downsizing elderly people who are living alone; Call for a full debate for Council to discuss the whole issue of housing; This is a problem that is on the increase year after year; Concern at the availability of suitable properties for single people; There is no suitable housing for those living in West Cork; Minmay1.15 Page 4 When these units become available, the Council should not sell them on and keep them in their stock; The Chief Executive advised that the Scheme would commence immediately and a report on progress would issue to Members after six months. The issue of the number of dwellings available will arise from the number of casual vacancies. In 2014, 81 2 bed units were allocated. The Chief Executive said that the issue of downsizing would be taken into account. He said that a debate on all aspects of housing should take place and could be considered at the June Development Committee. Kanturk/Mallow Municipal District: UNFINISHED ESTATE IN LISMIRE 7/5-1 Councillor B. Moynihan proposed, seconded by Councillor T. Collins, the following motion:“That the Kanturk Mallow Municipal District, together with Cork County Council, move to urgently address the terrible conditions present at the unfinished housing estate in Lismire.” During a discussion, Members made the following points: This is one of the worst unfinished housing estates in the country; There are problems with no public lighting and raw sewage; 400 signatures from residents have been gathered calling for the issues to be addressed; The bond needs to be drawn down and finish off the estate; This is a blight on a vibrant community; The Estates Engineer, John Ahern, has been involved in trying to rectify the issues; The Chief Executive now needs to intervene and provide a solution; This is a very dangerous estates and 7 houses in particular are living in atrocious conditions; The Council gave the planning permission to the developer and is now responsible for ensuring that the estate is finished off. The Chief Executive said that the Council is only responsible in these situations when the work is not done. He said that the Council has made significant progress in taking in charge 154 estates and is in the process of taking in charge a further 91. He said that the Council is actively taking proceedings through the County Solicitor’s Department on this estate and will progress through the courts if need be. CORRESPONDENCE FROM GOVERNMENT DEPARTMENTS 8/5-1 MANDATORY SPEED LIMITS IN HOUSING ESTATES Members noted letter dated 27th April, 2015, from the Department of Transport, Tourism and Sport, in response to Council’s motion of 13th April, 2015, relating to the mandatory speed limits in housing estates. NOTICES OF MOTION SUPPORT FOR FAMILY RESOURCE CENTRE Minmay1.15 Page 5 9/5-1 Proposed by Councillor S. McCarthy Seconded by Councillor K. Dawson RESOLVED: “That this Council welcomes steps taken by Minister Reilly of the Department of Children and Youth Affairs to address the current problems associated with Childcare in this state, and asks that the role of the Family Resource Centre be given due recognition when investigating ways to improve the system. Like many other voluntary organisations dependent on subsistence from the state, these Centres have sustained cuts year on year since 2008. Many of these FRCs carry out essential work in the areas of childcare and early intervention and serve as the central focal point within their communities.” Members made the following points: Family Resource Centres are run by Tusla to improve the family unit; Policies should be formulated from the ground up; These centres are vital for communities and should be fully funded; Gaps in services are being provided by Family Resource Centres; TENANT PURCHASE SCHEME 10/5-1 Councillor S. McGrath proposed, seconded by Councillor D. Ó Laoghaire, the following notice of motion:“To request a written report from Management outlining the most up to date information available from the Department regarding a new Tenant Purchase Scheme or Incremental Purchase Scheme for housing tenants. If no firm timeframe is known for the commencement of the scheme at this point, that the Council calls on the Department to initiate such a scheme as a matter of urgency.” Members noted report from the Director of Housing, which outlined as follows:Part 3 of the Housing (Miscellaneous Provisions) Act 2014 underpins a new tenant purchase scheme for existing local authority houses. This section has not yet been commenced. However, the Social Housing Strategy 2020 states that the necessary statutory instruments to introduce the new scheme will be made during Quarter 2, 2015. It was agreed that the Council should write to the Department. JAPENESE KNOTWOOD 11/5-1 Councillor M. D’Alton proposed, seconded by Councillor K. Conway, the following notice of motion:“That in view of its obligations under Articles 49, 50 and 74 of the European Communities (Birds and Natural Habitats) Regulations, Article 56 of the Wildlife (Amendment) Act 2000, Article 8 of the Convention on Biological Diversity Article 4 of the Convention on the Conservation of European Wildlife and Natural Habitats Target 8 of the National Biodiversity Plan 2011 – 2016 Minmay1.15 Page 6 and particularly with regard to EU Regulation 1143/2014 on the prevention and management of the introduction and spread of invasive alien species which entered into force on 1st January 2015 and which lays down rules for the prevention and minimisation of the adverse impact of the spread of invasive alien species and requires a risk assessment within 18 months and a comprehensive control programme within 3 years, 1. Cork County Council would dedicate either new or existing staff resources to addressing the issue of Japanese knotweed and other invasive species 2. Cork County Council would devote some of the financial allocation to the Cork County Biodiversity Action Plan to: Improved training of on-the-ground staff, contractors and subcontractors in controlling the spread of Japanese knotweed Raising general public awareness of Japanese knotweed.” Members made the following points: This is an invasive plant that can take years to eradicate; Call for the Council to use existing staff to map the locations where this weed is present; Council must commence a campaign of awareness to deal with the issue; Need a dedicated officer and an education programme to show what the plant looks like and how to deal with it; Spraying it with roundups is not the solution; Currently a huge issue in a public park in Charleville; Tidy towns are unknowingly spreading the weed; Other statutory bodies must become involved and increase awareness; This is an obnoxious invasive species that needs to be wiped out; The Chief Executive said that the responsibility for enforcement rests with the Department of National Parks and Wildlife but the Council does have responsibilities as a landowner. He said the Council has raised awareness on the website and leaflets through the Biodiversity Plan. It presents challenges and will take years. The Chief Executive said there is no evidence of the Council’s breach of legislation and that its Contractors are also obliged by the same legislation. The Chief Executive advised that the NRA is currently engaging with specialists to carry out a study on knotweed, which should identify sources and appropriate methods of eradication, which would also include other agencies. He said this expertise will show the Council the way forward and how to deal with the issue on the non national road network. He advised Members to await the outcome of the NRA study which should be available in the next few weeks. It was agreed that the proposal would be discussed further at the Environment SPC. EMERGENCY REPAIRS 12/5-1 Councillor P. Buckley proposed, seconded by Councillor N. Collins, the following notice of motion:“That this Council provides a report on how many emergency repairs were carried out in 2014 and 2015. I also ask what constitutes emergency repairs and are roof repairs and electrical classed as emergency.” Members noted report from the Director of Housing, which outlined as follows:Cork County Council carried out 4,613 response maintenance repairs in 2014 and 835 response maintenance repairs up to end of first quarter 2015. Repairs completed consisted of both emergency and urgent repairs. Emergency repairs are classified as any required works that are necessitated by Minmay1.15 Page 7 risk of imminent danger to the tenant or to the structure of the property. In this regard electrical repairs and certain roofing repairs are classified as emergency repairs. SINGLE FARM PAYMENT CUTS 13/5-1 Proposed by Councillor M. Collins Seconded by Councillor K. Conway RESOLVED: “I call on the Minister for Agriculture while a case against the Department of Agriculture in progress that no farm inspections take place until the case is finished. Thirty Three thousand farmers are severely affected by this single farm payment penalty and a group of farmers from disadvantaged areas are taking a high court challenge against the cuts to farm payments based on ineligible ground. We now call for the complete cessation of all eligibility ground and aerial satellite inspections to cease immediately until the high court challenge is complete.” Members made the following points: Land eligibility has been too restrictive; The outcome of the legal challenge should be awaited; The penalties from the EU can be huge; Retrospective approach in this case would be over zealous; Cllr. R. McCarthy proposed that an Individual Working Group would be established this was agreed. 1916 BANNERS IN COUNTY HALL 14/5-1 Councillor D. REPORT ON VACANT AND UNFINISHED HOUSIING ESTATES 15/5-1 Councillor D. O’Grady proposed, seconded by Councillor D. Ó Laoghaire, the following notice of motion:- “To seek a written report on vacant and unfinished housing estates in County Cork. The report to contain a list of unfinished estates and apartment blocks, the number of completed, semi completed or unstarted units in each estate/apartment block. The report to contain whether the units are in NAMA and the number of units in each estate/apartment block that Cork County Council have contractual commitments for, agreements in principal for or part V contractual commitments or interests in, where applicable.” Minmay1.15 Page 8 Members noted report from the Director of Planning, which outlined as follows:Please see on the following pages a listing of current Unfinished Estates in County Cork based on the survey carried out by Department of Environment, Community and Local Government in 2014. An updated survey is scheduled for later this year. In relation to the remaining information requested, it is necessary to recall files from storage to compile the information and as soon as this is completed the information will be issued to Cllr. JOINT INITIATIVES WITH CORK CITY COUNCIL ON MARKETTING 16/5-1 It was agreed that the following notice of motion in the name of Cllr. D. Forde, be deferred to the next Council Meeting:(i) How much was spent during 2011, 2012, 2013 & 2014 on joint initiatives with Cork City Council to market Cork;. (ii) across all departments, directorates and platforms, in 2011, 2012, 2013 & 2014 how much money was spent on marketing and promoting Cork as a tourist destination and attracting visitors to Cork; (iii)across all departments, directorates and platforms, in 2011, 2012, 2013 & 2014 how much money was spent on maintaining, marketing, promoting and staffing tourist attractions in Cork; (iv)across all departments, directorates and platforms, in 2011, 2012, 2013 & 2014 how much money was spent on websites, broken down per website. O’Sullivan proposed, seconded by Councillor P. Buckley, the following notice of motion:“That this Council expresses its deep disappointment that Fáilte Ireland has excluded Youghal and the broader East Cork region not only from the Wild Atlantic Way but now Ireland's Ancient East. This is an extremely short sighted and damaging decision which requires the Minister for Tourism, Transport and Sport, Paschal Donohoe TD to intervene forthwith”. Members made the following points: Not acceptable that Youghal was excluded from the Ancient East; This is an insult to the town of Youghal which is renowned for its tourist attractions; It was always the intention of Failte Ireland to include Youghal in the Ancient East, and they have confirmed this in writing; There needs to be stronger assurances from Failte Ireland regarding the inclusion of Youghal; The Chief Executive advised Members to write to Failte Ireland for clarification and that the response should be considered by the SPC. This was agreed. CIVIC RECEPTION FOR DONNACHA O’DULAING 19/5-1 Proposed by Councillor I. Doyle Seconded by Councillor K. O’Keeffe RESOLVED: “That Cork County Council would grant a civic reception to RTE Radio One Broadcaster, Donnacha O' Dulaing, who recently announced his retirement from over 50 years of broadcasting. Donnacha who was born in Doneraile, Co. Cork, has given his lifetime to journalism and broadcasting and also has been involved in many charitable events.” DOG DNA DATABASE 20/5-1 Councillor K. O’Keeffe proposed, seconded by Councillor K. Murphy, the following notice of motion:“In view of Cork County Council's new policy to microchip all dogs, that when this procedure is being undertaken, that a swab is taken from each dog to establish a DNA database.” It was agreed that the matter would be considered further by the Environment SPC. The Mayor advised that it was agreed at a recent Corporate Policy Group meeting to arrange a meeting with the DAA and that Members would be notified when this has been arranged. SPECIALLY ADAPTED BUS STOP AREAS 22/5-1 Members noted letter dated 16th February, 2015, from Bus Eireann, in response to Council’s motion of 26th January, 2015, regarding specially adapted bus stop areas. CUTS TO HOME HELP HOURS 23(a)/5-1 Members noted letter dated 17th February, 2015, from the Health Service Executive, in response to Council’s motion of 26th January, 2015, regarding cuts to home help hours. Cllr. D. O’Grady asked that the HSE would be written to asking that the budget for the South Lee area be increased to enable elderly people receive the home help they are entitled to. UPGRADING OF COMMUNITY HOSPITALS AND OLDER FACILITIES 23(b)/5-1 Members noted letter dated 16th March, 2015, from the Health Service Executive, in response to Council’s motion of 9th February, 2015, regarding the upgrading of Community Hospitals and Older Care facilities in Cork. Members queried if a response had been received from the Department of Finance regarding funding. CAPPING OF INTEREST RATES ON LOANS FROM MONEYLENDERS 24/5-1 Members noted letter dated 12th March, 2015, from the Central Bank of Ireland, in response to Council’s motion of 23rd February, 2015, regarding capping of interest rates on loans from moneylenders. NAMING OF N40 SOUTHERN LINK ROAD 25/5-1 Members noted letter dated 16th March, 2015, from the National Roads Authority, in response to Council’s motion of 12th January, 2015, regarding the naming of the N40 Southern Link Road. Cllr. A. Moynihan said that the NRA has no role in the naming of this road and that the City and County Councils are in agreement that it should be named after Cumann na mBan. The Chief Executive said that the NRA has a National Signage Strategy and that there may be another form of naming this road so that there is no conflict with the strategy. He said that naming a road is different to signage and that the 1916 Commemoration Committee should look at this further.
