Context 23/11/2010 J-M DECHAMPS Old system • Wagons P o Registering Railway undertakings (RUs) - Registration of wagons - Operations and maintenance conditions: imposed o (Private) keepers 23/11/2010 J-M DECHAMPS Today (1) • Legal aspect = Railway Safety Directive (2004/49 including amendments) o RU is responsible for safe operation o RU keeps under control all risks including maintenance. Maintenance may not be imposed to Keepers RU, keepers and maintainers may be different o Registration by public authority 23/11/2010 J-M DECHAMPS Today (2) • Old system is not authorised but ... RU may still impose maintenance. RU controls risks by imposing maintenance. 23/11/2010 J-M DECHAMPS Today (3) • RU controls maintenance managed by other entities such as keepers. Economic nonsense: many keepers and RUs exchange wagons. RUs are not capable to control all keepers or all entities in charge of maintenance for keepers! Questions 23/11/2010 J-M DECHAMPS 1) Keeper has no ECM. What happens? Registration must contain identification of ECM incomplete registration the wagon can not be operated! 2) ECM for all wagons? YES, mandatory also for all wagons. Exception: if excluded by the Railway Safety Directive 3) ECM and GCU? No link. ECM is imposed by law, CUU is private contract. 23/11/2010 J-M DECHAMPS 4) Need of approved workshop (atelier agréé)? Legally the workshop must be approved by the ECM.
