GOVERNMENT REGULATION OF THE REPUBLIC OF INDONESIA NUMBER 28 YEAR 2005 ON TARIFFS OF THE KINDS OF NON-TAX STATE INCOME APPLICABLE AT THE DEPARTMENT OF COMMUNICATION AND INFORMATION TECHNOLOGY BY THE GRACE OF GOD THE ALMIGHTY PRESIDENT OF THE REPUBLIC OF INDONESIA Considering: that by the establishment of the Department of Communication and Information Technology as an implementation of Law Number 20 Year 1997 on Non-Tax State Income, it is considered necessary to ratify the Government Regulation on Tariffs of the Kinds of Non-Tax State Income applicable at the Department of Communication and Information Technology; Bearing in mind: 1. DECIDES To ratify: THE GOVERNMENT REGULATION ON TARIFFS OF THE KINDS OF NON-TAX STATE INCOME APPLICABLE AT THE DEPARTMENT OF COMMUNICATION AND I INFORMATION TECHNOLOGY Article 1 (1) The kinds of Non-Tax State Income applicable at the Department of Communication and Information Technology are emanating from the postal and telecommunication services. (2) The tariffs on the kinds of Non-Tax State Income applicable at the Department of Communication and Information Technology as stipulated in paragraph (1) are fixed in accordance with this Government Regulation and its attachment. 2 When there is different interpretation between the translated regulation document (in English), should be referred to the original version (in Indonesia) 3 (3) The tariffs on the kinds of Non-Tax State Income applicable at the Department of Communication and Information Technology which are not covered yet by this Government Regulation, will subsequently be fixed and form part and parcel of this Government Regulation and included in a separate Government Regulation. Article 2 (1) The kinds of Non-Tax State Income as stipulated in Article 1 are stated in tariffs of Rupiah and Percentage. (2) The charge for the right to use (CRU = BHP) radio frequency is calculated in the function of the band width and the transmission power with the following formula: BHP frequency (Rupiah) = (lb x HDLP x b) + (lp x HDDP x p) 2 (3) The charge of band width location index and the charge of transmission power index as stated in paragraph (2) are decided by the Minister in charge of telecommunication after obtaining consideration from the Minister of Finance. Article 3 (1) The license fee for the use of radio frequency spectrum band for the provision of telecomunication services is determined through selection mechanism, offer and choice taking into account the appropriateness and purchasing power of the people. (2) The process of determining and deciding the amount of the fee as stated in paragraph (1) is done by the Minister in charge of telecommunication after obtainng consideration from the Minister of Finance. (3) The charge collected for the use of radio frequency spectrum band for the provision of telecommunication services is done at the time of the issue of license for the use of radio frequency spectrum band. 3 When there is different interpretation between the translated regulation document (in English), should be referred to the original version (in Indonesia) 4 (4) The license for the use of radio frequency spectrum band as stated in paragraph (3) is provided for the period of ten (10) years. Article 4 The Non-Tax State Income originating from the contribution for the Universal Service Obligation/USO may only be used to finance the implementation of the development, operation, and maintenance of the provision of telecommunication services in the area of universal service. Article 5 The whole income emanating from the Non-Tax State Income as stated in Article 1 paragrah (2) must be deposited directly to the State Cashier. Article 6 This Government Regulation comes into force on the date of its promulgation. In order to make it known to every body, it is instructed to promulgate this Government Regulation by its placement at the State Gazette of the Republic of Indonesia. In line with the social, economic and technological development in the provision of post and telecommunication, the types and tariffs of the kinds of Non-Tax State Income emanating from postal and telecommunication services are considered necessary to be adjusted. In view of the above and in order to optimize the Non-Tax State Income at the Department of Communication and Information Technology as one of the resources for the state income, such income needs to be managed and benefited for the improvement of services to the people.
