A ttorneys for the Saint Mary’s n u r
sing stu d en t w ho was raped last May
on the road betw een the College
and N otre Dame filed a S3 million
law suit against the University in
federal co u rt in Chicago yesterday.
The suit charges that N otre Dame
did not supply adequate security on
the road b etw een the tw o schools
for the victim and now claim ant
w hose nam e was unavailable as o f
last night
N otre Dame ow ed the w om an
"the duty o f exercising ordinary and
reasonable care to p ro tect h e r from
crim inal activity and harm ," a c c o rd
ing to the suit. The University acted
"w antonly, willfully, recklessly and
w ith a conscious disregard for the
rights o f invitees," the suit states.
At approxim ately 11 p.m. May 12,
the student was retu rn in g from
N otre Dame alone along th e road
co n n ectin g the tw o schools w hen
she was attacked from behind. She
said she could not hear h er assailant
approach because she was w earing
earphones and listening to music.
The victim then was dragged into
a w ooded area 180 feet from U.S.
Route 31 w here the assailant b ru
tally assaulted and raped h er a c co rd
ing to the law suit.
Besides failing to p ro te c t the
victim, the suit alleges that N otre
Dame did not w arn stu d en ts and
patrol the road. The University failed
to provide "adequate p recau tio n s to
p ro tect the safety o f the stu d en ts
and those w ho w ere invited to its
prem ises, such as Saint Mary’s stu

In an o th e r
charge, the suit challenges that th e
lighting on the road betw een N otre
Dame and Saint Mary's is inadequate.
The C hicago law firm o f Harvy J.

Hoffman, w ho is lecturing as part

He added Hoffman definitely will

"T he idea for bringing Hoffman is

“T hose stu d en ts o f the 60s are in

Beginning his activism in the early

That w as not his only stunt,

In April 1967, Hoffman and

he led an effort to su rro u n d the P en

Hoffman and o th e r “Yippics" c o n

As a national television audience
w atched, th e police brutally beat the

process.
But Hoffman was destin ed to gain

incident in 1969, w hen he and seven

conspiracy and crossing state lines
to incite a riot.

Federal loan subsidizes

LeMans and Holy Cross Halls at
Saint Mary’s are receiving m uchn eed ed renovation s due to a low

A low in terest college housing

Saint Mary’s had to apply in o rd e r

“The co m p etitio n for th e loans w as

Not wearing seatbelts foolishly endangers drivers

A utom obiles are dangerous things. W e

in a w hile, on e com es to a su d d en sto p and
som eone is in ju red o r dies.
This d o es n o t have to happen. P eople can
save th eir lives, b u t m ost d o not. M ost p eop le
do not w ear th e ir seatbelts w h e n th ey ride in a
car. A ccording to a re c e n t study, only 19 p e r
c en t o f A m erican adults use th eir seatbelts
everytim e th ey ride in o r drive a car. O th ers
adm it to w earing them occasionally, b u t m ost
peo p le n ev er do. Is th e re a reaso n for this?
Why do supposedly in telligent p e o p le do
som ething as foolish as n o t w earing a seatbelt?
Before w e answ er this, let us look at the
facts. Every year, 23,000 p e o p le die in
autom obile accidents. T hat w orks o u t to 63
p eo p le each day. A nother tw o and a half mil
lion p eo p le are injured each year, o r ap
proxim ately 6,050 peo p le each day. And h ere
is an o th er im p o rtan t fact: using seatb elts cu ts
y o u r ch an ces o f becom ing o n e o f th o se statis
tics in half. And the odds are th at every o n e
w ill b e involved in at least o n e serio u s acci
d en t in his o r h e r life.
So w hy do so m any peop le ch o o se to ignore
th e tru th and take th eir chances? T he excuses
w e h ear are incredibly inane, m u ch like those
fo und in a th ird grader w ith a dislike for
hom ew ork. Instead o f “I can ’t find a p en cil,”
o r “My dog ate it,” w e get su ch rational
answ ers as “I d o n ’t w ant to w rinkle my
clo th es,” “I always forget,” o r “T hey’re to o u n
com fortable."
Let us b e realistic. The seatbelts in today’s
cars are m uch b e tte r designed than th ey w e re
five years ago. All o n e m ust do is take a few
seconds to adjust th em for co m fo rt and so that
o n e ’s clo th e s do n o t get w rinkled. And if you
think a b o u t it, it is likely th a t o n e w o u ld rath er
b e a little u n com fortable than dead. People
look m uch b e tte r w h en they are alive and in a
slightly w rin k led set of clo th es than w h en
they are dead and in perfectly p ressed c lo th
ing. And as for p o o r m em ory, every p erso n
m ust make th e conscious ch o ice to buckle up.
People w h o d o w ear th e ir seatbelts for th e
first tim e usually w o n d e r h o w su ch a flexible
device w h ich allows o n e to lean forw ard can
p ro te c t th em in an accident. The seatb elts are
designed for som e freedom o f m ovem ent
w hile th e car is in norm al o peration. But if the
brakes are suddenly applied, o r th e car stops
suddenly, th e seatb elt holds a p erso n securely
in his o r h e r seat. Anyone w h o has rid d e n in an
Audi w ith a seatb elt know s th at they just need
to pull o n th e b elt to o fast for it to lock up.
Most A m erican cars’ belts o p erate o n an in e r
tia dev ice w h ich locks up th e belts o n c e the
car stops o r slow s suddenly.
Many p eo p le claim th at they co u ld brace
them selves in an accident, and th erefo re they
do n o t n e e d to w ear th e ir seatbelts. Yet in o r
d e r to b ra c e yourself, you w o u ld n eed to be
incredibly strong. A su d d en sto p from thirty
miles p e r h o u r is roughly eq uivalent to taking
a sw an dive from a th ird story w indow . Even a
crash in a parking lo t can cause facial injury. If
you do n o t believe this, try w alking into a wall
at five m iles p e r h o u r and see if it hurts.
Every o n c e in a w hile, w e h ear a b o u t those
dreadful accid en ts w h ere th e car cau g h t on
fire o r becam e subm erged in w ater. People
use th ese accid en ts as an e x cu se for not
w earing th e ir seatbelts, saying they d o not
w ant to b e trap p ed inside. Yet the facts are
that accid en ts involving b o th fire and su b m er
sion u n d e r w ate r acco u n t for only o ne p e r
c e n t of all accidents. And even if you are
involved in su ch an accident, y o u r seatbelt
w ill p re v e n t you from being knocked u n c o n
scious so th a t you can escape quickly.
In addition, w e occasionally hear about
so m eo n e’s u n cle w h o was th ro w n from a car
and lived to tell about it. Well, that p erson
m ust b e in credibly lucky, for being th ro w n

With their banners and signs held high, they

A nother rep o rt detailed the activities o f one

The w ater shortage because of broken

Senator points to CLC
and its shortcomings
D ear Editor:
I w ould like lo clear up the confusion about
th e Cam pus Life Council that has c lo u d ed the
issue o f disbanding the Student Senate.
First, the CLC cannot serve as a voice o f the
student body because it is not designed to do
so. The com position of the CLC is eight stu
dents, six recto rs and tw o faculty m em bers.
The students do not even have a m ajority o f
the scats. Do recto rs o r faculty m em bers
express the "legitimate ”voice o f the students?
Second, the CLC is far less accessible than is
the senate. Student governem n t’s co n stitu tio n
states clearly that the senate will m eet o n ce a
w eek during the school year. This enables any
student to bring an issue that c o n cern s him
w hile it still affects him. However, the CLC,
w hich has m et less than ten tim es in th e last
four years, does not have any such provision,
and th ere is no reason to assum e that it will
make one.
Finally, the pro p o n en ts o f the d isbandm ent
state that anything the senate d o es needs the
approval of the CLC. This is sim ply not tru e
The CLC docs not approve delegations sen t to
the trustees o r approve cabinet positions. It
d o es not w atch over the funds o f the stu d en t
body or question the prerogatives of the stu
d ent leaders; rather, the senate perform s these
needed functions.
M oreover, w hy should w e stop at just dis
banding the Senate? We should disband the
CLC, too. Anything it approves can be vetoed
by Father Tyson and that falls in th e line w ith
the prevailing logic: if you cannot have your
way, you should quit.
I hope that the CLC is clearer now , and that
you realize that the CLC is n o t th e panacea
that has been described.

Farley and P.E. win games, set up Sunday final
B y FRANK HUEMMER
Sports Writer
If the playoffs are any indication of
w hat to exp ect, th e w o m en ’s flag
football cham pionship gam e this
Sunday at 2 p.m. in N otre Dame
Stadium should be a real b a rn
burner. Farley and Pasquerilla East
will m eet in th e finals after w inning
close gam es o v er Lyons and
Pasquerilla W est respectively.
Farley im p ro v ed its rec o rd to 8-0
w ith a 14-8 o v ertim e win. Lyons
jum ped o u t to an 8-0 lead by scoring
w ith less than o n e m inute rem aining
in the first half. Farley cam e back to
tie the gam e at 8-8, how ever, w h en
Joanna Branick to o k a pass from
q uarterb ack Marilu Almeida and
raced 40 yards in to th e en d zone for
th e score.
In the o vertim e, b o th team s got
o ne ch an ce to sc o re from th e five
yard-line. Farley receiv ed th e ball
first and sc o re d as Almeida ran th e
ball aro u n d end. Lyons th e n to o k
possession o f th e ball b u t failed to
sco re as th e Farley defense m ade a
goal-line stand.
A lthough his team cam e away
w ith th e victory, Farley co ach Pete
Janicki praised Lyons’ perform ance.
“You can ’t take anything away
from Lyons, ” said Janicki. “They are
a very good team and d eserv ed to
have a lot b e tte r re c o rd than they
d id .”
He later ad d ed that th e Farley fans
played a big role in th e game.
“The fans o n th e Farley side really
m ade a difference in helping us play
b e tte r in th e seco n d half,” said
Janicki. “They riled us up and go t the
w hole team pum ped. They really
help ed to change th e m o m en tu m of
th e game. ”
M eanwhile, th e seco n d c o n test on
th e day’s sch ed u le featured many
shifts o f m o m en tu m as P.E. w as able
to outlast P.W. by a score of 26-22.
P.W. sco red th e first tw o to u c h
dow ns o f th e gam e to take an early
16-0 lead. P.E. sto rm ed back,
how ever, b eh in d the right arm of
q u arterb ack C olleen D onnelly w ho
fired tw o long to u c h d o w n passes to
run n in g back Annie Schrenk to make
it 16-14 at th e half.
In the seco n d half, P.E. again w as
led by D onnelly w h o tossed a to u c h
dow n pass to w ide receiv er Regi
R ichter to m ake it 20-14. P.W.
regained th e lead soon after, though,
scoring to m ake it 22-20 in its favor.
Still, P.E. w as n o t to be d en ied the
v ictory as th e gam e w inning score
cam e on y et a n o th e r pass from D on
nelly to Richter. This one forged the
26-22 final.
W hen it w as all over, it was again a
case o f th e w in n in g co ach heaping
praise o n th e losing team . East’s
coach Dave H aimes felt P.W. played
a tough gam e thro u g h o u t.
“I can ’t com plain, ” said Haimes.
“P.W. really played a great game.
They have an explosive offense that
gave us a lot o f trouble.
“Any team could have w on that
game today. We just happened to
have o n e e x tra big play. ”
Later, H aimes praised his team ’s
offensive perform ance
“O u r offense definitely carried us.
It w as o u r best offensive p erfo r
m ance o f the
year
C olleen
(D o n n elly ) m ust have throw n for

“The
defense
finally
cam e
through w h en it c o u n ted ,” c o n
tin u ed Haimes. "N ow, w e need to
keep up th e m om entum into the
cham pionship gam e.”
M om entum should not be a
problem for eith e r team in the final
o n Sunday, for the cham pionship is
w hat b o th team s have been w orking
for all season.
"I’m looking forw ard to playing I
P E ,” n o ted Farley m en to r Janicki.
“D efensively they are very sim ilar to I
us. Offensively, they have th e best
offensive line o f any team in th e |
league.
“H ow ever, th e ex citem en t a n d l
enthusiasm in Farley is becom ing a n l
unstoppable thing. O u r girls really#
w ant to win, and playing in th e !
stadium will be w hat w e’ve w orked |
all year to do.”
Pasquerilla East's co ach Haimes,]
m eanw hile, is p rep arin g his team for ]
an upset o f u n d efeated Farley.
“Everyone has picked Farley to ]
take it all,” said Haimes. “They have a |
lot o f talent, b u t w e will be p ractic
ing real hard. O u r team will be ready

G reen w as a stan d o u t receiv er

decisions had to be m ade w h en he

“Flanker w as my position in high

things like that. I’d d o a lo t o f outsid e

The sp e e d ste r certainly took full

was th e Big Five C onference player
of the year in 1984 and a tw o tim e

Federation, all-county, and all
co n ference player.
To add to th e confusion for c o l
lege coaches, G reen p ro v ed to be a
solid defensive back during his high
school career. His 10 in tercep tio n s
in a season and 21 c a reer pick offs
set school records.
“C oach (R o n ) H udson had been
recru itin g m e all along,” notes
Green. “They got the w ord about me
as a defensive back, b u t Coach H ud

that I w as a b e tte r offensive player
than I w as defensively. N otre Dame
and N ebraska w ere th e only schools
that told m e that ”
This seem s surprising in light of
his perform ance th u s far at N otre
Dame, as w ell as th e fact that G reen
w as invited o n recru itin g visits to
strong football schools like Was

few. But the decision to offer G reen
a position on the Irish offense
becam e unanim ous w hen head
coach G erry Faust w atched him
scam per for to u ch d o w n s o f 70 and
50 yards in a playoff gam e last year.
“They re c ru ite d me, m ore o r less,
as an athlete, and let me make up my
m ind w h e th e r I w anted to play of
fense o r defense,” says Green. “They
told m e they w anted m e to com e
and give tailback a sh o t and that if I
d id n ’t like it I could m ove over to
the secondary. In th e m iddle o f the

w ould be going in as a defensive

A nother sw itch w as still ahead for
G reen, how ever. The decision to
m ove him to flanker was finalized
tw o w eeks before the Irish o p ened
the season at Michigan, and has since
proved advantageous to both G reen
and N otre Dame. Offensive c o o r
dinator Mike Stock can attest to that.
“He w as an outstanding all

Stock says. “To have Allen Pinkett,
