Internet Policy Compliance Your goal as an Independent Watkins Consultant is to market Watkins products and the Watkins Home Business Opportunity. As part of your business strategy, you may choose to use the Internet for e‐mail or other online promotional methods. Watkins allows you to promote your business online if you follow the rules in this Internet Policy. Before you begin any online marketing, you should: 1. 2. 3. Read this Internet Policy thoroughly. Discuss your online marketing plans and any questions about this policy with your Watkins Home Business Executive.* Submit the Online Marketing Request Form if you plan to use any online marketing method mentioned below that requires explicit approval from Watkins corporate. The form for such requests is on WatkinsOnline.com under My Account. * Note: Your “Home Business Executive” is the Independent Watkins Consultant above you in the organization who has reached the Executive achievement level. If you don’t know whom to contact, the Consultant Support Hotline at webhelp@jrwatkins.com or 507‐457‐3143 can tell you their name and how to reach them. Watkins Home Business Executives will work in conjunction with the Home Business Sales Department from Watkins corporate to ensure that Independent Watkins Consultants comply with Watkins Internet Policy. Please contact your upline Home Business Executive for questions regarding this policy. Home Business Executives will communicate directly with Consultants who are not in compliance with Watkins Internet Policy. (For Consultants without a Home Business Executive in their upline, Watkins Incorporated will communicate any compliance issues.) Violation of Watkins Internet Policy is an offense. Consultants will receive a warning with the first violation. Penalties will be assessed for subsequent infractions to the Internet Policy. Policy Changes Due to the evolving nature of Internet technologies, Watkins will update these policies from time to time. Watkins Incorporated and the Home Business Executives will alert Consultants when the policy changes. Consultants who choose to utilize online marketing methods must accommodate all policy changes in a timely manner. Exceptions Any exceptions to Watkins Internet Policy must be approved in writing by Watkins Incorporated. Definitions Because Consultants sometimes get confused between terminology, we are providing the following definitions of selected Internet Policy terms (presented in logical order from basic to advanced). • WatkinsOnline.com — the official Home Business Opportunity Web site, where customers can order products, prospective Consultants can learn about the business, and enrolled Consultants can find business information, training, and sales reports. • E‐Consultant site — an optional feature of WatkinsOnline.com, which gives Consultants customizable Web pages and their own specific Web address for promoting product sales and the Home Business Opportunity. Updated – January 2013 • • • • • • • • • URL — also known as a Uniform Resource Locator, this is simply a Web address of any particular Web page on the Internet. URLs can point to either the main page of a particular site, or a detailed page. For example, both www.wikipedia.org and http://en.wikipedia.org/wiki/ Bob_dylan are URLs. Domain name — the primary URL of a particular Web site, such as watkinsonline.com, ford.com, google.com, wikipedia.org, etc. Domain name redirect — A domain name that is not set up as a Web site itself, but immediately displays another Web site instead. (You can think of it like an online version of “call forwarding” on your phone‐ someone dials your regular phone number, and it immediately connects them to a different phone number you’ve specified without them having to dial that other number.) Domain name redirects are typically used to give people a short or easily memorized Web address that displays a Web page with a long or complex URL. Search results — a list of Web pages that displays after a person uses a search engine like Google.com, Yahoo.com, or MSN.com to search for particular keyword terms. Sponsored listings — also known as pay‐per‐click ads or PPC listings, this is a list of Web pages that displays on search result screens (usually at the top or upper‐right). Owners of these Web pages pay to have their sites show up at the top of the search results for particular keywords (see example next column). Organic listings — also known as free listings or ranked listings, this is a list of Web pages that displays on search result screens (usually below a block of sponsored listings). The search engine lists Web pages in order of which ones would seem to be most relevant to the terms on which the person searched. Owners of these Web pages do not pay the search engine to have their pages listed (see example next column). HTML Title — also known as the Title Tags or Title Bar Text, is text that displays at the top‐left of an Internet browser window when viewing a particular Web page, and on the tab within the browser window (see example below). The author of the Web page specifies the text through automated page builder software or by manually typing the tags in the behind‐the‐scenes Web page coding. Page Title — also known as the Title or Headline is simply the most prominent text at the top of a Web page (see example below). Social Media — As used in this policy, the term “social media” or “social media tools” refers to blogs, wikis, social networks, twitter, video and photo sharing web sites, online forums, virtual worlds and any other form of publishing or discussion via the Internet or mobile communications technologies including all existing and future forms of social media. Updated – January 2013 E‐mail (and Faxes) E‐mail is a common way for people to share information. The following rules about e mail communications also apply to sending faxes. Allowable E‐mails and Faxes You may use e‐mail and faxes to share information about Watkins products or the business opportunity with people you know, such as friends and relatives (or anyone who has previously exchanged non‐business communications with you). You may also send e‐mails and faxes to people who requested information because you advertised or ran other promotions. You do not need prior approval from Watkins corporate to send e‐mails and faxes to these people. But you must stop e‐mailing or faxing anyone who specifically asks you to stop. Prohibited E‐mails and Faxes You may not promote your business through e‐mails or faxes to strangers (people who have not specifically requested information or with whom you have not previously shared non‐business communications). Specifically, Consultants may not use or transmit unsolicited faxes, mass e‐mail distribution, unsolicited e‐mail, or “spamming” relative to the operation of their Watkins businesses. The terms “unsolicited faxes” and “unsolicited e‐mail” mean the transmission via telephone facsimile or electronic mail, respectively, of any material or information advertising or promoting Watkins, its products, its compensation plan or any other aspect of the company, which is transmitted to any person, except that these terms do not include a fax or e‐mail: A. to any person with that person’s prior express invitation or permission; or B. to any person with whom the Consultant has an established business or personal relationship. The term “established business or personal relationship” means a prior or existing relationship formed by a voluntary two‐way communication between a Consultant and a person, on the basis of: 1. an inquiry, application, purchase or transaction by the person regarding products offered by such Consultant; or 2. a personal or familial relationship, which relationship has not been previously terminated by either party. Updated – January 2013 Chat Groups and News Groups Use of chat groups and news groups is not prohibited for sharing and promoting your individual Watkins business. However, we strongly recommend that you not make product claims or recruit in these areas, as Watkins Incorporated may be held liable for your statements. Telephone Directory Listings Traditional phone book listings from white pages and yellow pages are frequently included in online search engine results. In order for those search results to be in compliance with Watkins Internet Policy, Consultants with business phone lines must ensure that their phone directory listing complies with standard Watkins policies. If you have a business telephone line for your Watkins business, your phone directory listing must be written as “Watkins: Independent Watkins Consultant” followed by your name and phone number. For example: • Watkins: Independent Watkins Consultant John Doe...212‐123‐4567 WatkinsOnline.com Any Consultant may direct their prospective customers or prospective Consultants to the official Watkins Home Business Opportunity Web site at http://www.watkinsonline.com without needing explicit approval from Watkins. On the site, prospects may view the online product catalog and learn about the business opportunity. They can also set up a customer account and order products, or enroll in the business as a Consultant. If you send people to watkinsonline.com, however, it is vital that they have your name and/or Consultant ID# handy. If they set up a customer or Consultant account, they will need to enter your ID# (or use the online lookup to enter your name and find your ID#) so that you can be properly credited if they order products or enroll as a Consultant. E‐Consultant Web Sites This optional feature of WatkinsOnline.com gives a Consultant customizable Web pages where he or she can write stories about products or the business. Having an e‐Consultant site also helps ensure that the Consultant gets credit when prospects place an order or join the business. (Once prospects are on your e‐Consultant site, they will not need to enter your ID# or name in order for you to get credit.) E‐Consultant Web Address and E‐mail Address During the e‐Consultant sign up process, Consultants are offered several choices of a personal Web site address (for example, Consultant John Doe may choose http://www.watkinsonline.com/johndoe as the address of his e‐ Consultant site). The Consultant also gets a corresponding e‐mail address on the Watkins site (for example, johndoe@watkinsonline.com). E‐Consultant Program Enrollment You can learn more about the e‐Consultant option (including set up and maintenance fees) in the Business Bulletin section of WatkinsOnline.com under Programs, Watkins OnlineTM e‐Consultant Program. Updated – January 2013 To enroll and set up your e‐Consultant site: Login at WatkinsOnline.com and go to My Account, then “Upgrade to the e‐Consultant package.” Content for e‐Consultant Web Site After you enroll in the e‐Consultant program, you will be able to create personalized stories and modify other settings for your e‐Consultant site under My Account, then My Web Site. You do not need to get explicit approval from Watkins for personalized content on your site, but you must follow these specific rules when creating your personalized content: • You may personalize your e‐Consultant site using the provided template, but it must not be altered outside of the template in any way. • All information on an e‐Consultant’s site must be consistent with its position as an “Independent Watkins Consultant” site. No part of the e‐Consultant site can imply or suggest that it is the official Watkins site. This includes contact information, e‐mail addresses, and postal mail addresses. To avoid confusion, list all contact information as “Independent Watkins Consultant.” • E‐Consultants must follow and abide by all Watkins Advertising Policies as outlined in the most recent Consultant Reference Guide, and the use of copyrighted material without the written consent of the provider is prohibited. (To view the Consultant Reference Guide, login at WatkinsOnline.com, go to Business Bulletin, then Downloadable Forms, and under the Training & Reference heading, look for “System for Success Training & Reference Guide”.) • E‐Consultants cannot make earnings and income claims. All Consultants shall safeguard and promote the good reputation of Watkins and its products. The marketing and promotion of Watkins, the Watkins opportunity, the International Compensation Plan, and Watkins products shall be consistent with the public interest, and must avoid all discourteous, deceptive, misleading, unethical or immoral conduct or practices. • No product claims (including claims made in personal testimonials) as to therapeutic, curative or beneficial properties of any products offered by Watkins may be made except those contained in official Watkins literature. In particular, no Consultant may make any claim that Watkins products are useful in the cure, treatment, diagnosis, mitigation or prevention of any diseases. Such statements can be perceived as medical or drug claims. Not only are such claims in violation of Watkins policies, but they potentially violate federal and state/provincial laws and regulations, including the Federal Food, Drug, and Cosmetic Act and Federal Trade Commission Act. • The WatkinsOnline web site may utilize cookies to accurately process information. E‐Consultants may not implement programming code that will overwrite or modify these cookies or other functions. • Watkins Incorporated reserves the right to review and remove Web site data from e‐Consultant pages that is not within compliance of these policies and guidelines. TM Note: As a permanent part of the e‐Consultant template, Watkins automatically adds and maintains the corporate branding and appropriate disclaimers (such as identifying it as the site of an “Independent Watkins Consultant”), so Consultants do not have to worry about being in compliance in those areas. Frames Prohibited when Linking to e‐Consultant Site E‐Consultants may direct prospects to their e‐Consultant site from other places online (such as through a domain name redirect or links posted in news groups). However, you cannot use the advanced technique known as “frames” to: 1) display the e‐Consultant site within another Web site; or 2) obscure the actual URL of the e‐ Consultant site from displaying in the address field of the browser window. Updated – January 2013 Domain Names and URLs If a Consultant chooses to register their own domain name for a redirect or external Web site, they must submit the Online Marketing Request Form to get approval of the domain name before using it in their business. Consultants are prohibited from using the word “watkins” as any part of any domain name or URL. For example, “JohnDoeWatkinsBusiness. com” is not acceptable, but “JohnDoeBusiness.com” would be. In addition, Consultants are prohibited from using anything else in a domain name or URL that could imply that it is an official Watkins corporate site. For this reason all domain names and URLs used in a Watkins business must be pre‐approved in writing. Domain Names Redirects Some Consultants choose to register their own domain name, which they configure to automatically redirect to their e‐Consultant site. For example, Consultant John Doe may decide to register the domain name JohnDoeBusiness.com. He then sets it up so that when a prospect uses their computer to view JohnDoeBusiness.com, it immediately displays John’s e‐ Consultant site at http://www.watkinsonline.com/ johndoe. As mentioned above, Consultants must get approval of the domain name from Watkins before using it in their business. Also, as mentioned above, a domain name that redirects to an e‐Consultant site must not use the advanced feature called “frames” when redirecting. However, many domain name registration services have this feature turned on by default. In setting up your redirect, you will need to ensure that this feature is turned off. Different domain services call it by different names, such as frames mode, hidden mode, stealth mode, masking, URL keeper, or display in frame. You must turn off any such feature in order for your redirect to work properly and be in compliance. External Web Sites and URLs Some Consultants choose to generate interest in Watkins products and/or the business opportunity by creating their own external Web sites or Web page URLs, separate from WatkinsOnline.com or an e‐Consultant site. External Web sites and URLs are acceptable only if all of the rules in this section are strictly followed: • Consultants must submit the Online Marketing Request Form to get approval of any external Web site or URL before using it in their business. • Any Consultant who desires to utilize an external Internet Web site to promote his/her business must also be enrolled in the Watkins e‐Consultant program. • Consultants are prohibited from having their own transactional URL, other than their e‐Consultant site, to sell products. (In other words, you cannot build an external Web site that has a shopping cart system for gathering payments from customers‐but you can use an external site without a shopping cart system to create interest in the products and then link customers to your e‐Consultant site where they can place their order.) (Note: Consultants who have achieved Executive title may have their own transactional URL to sell Watkins products. Executives are limited to selling a maximum number of 20 different products. Executives must submit the Online Marketing Request Form with the external web site or URL information.) • Consultants are prohibited from selling Watkins products on any online store websites (in other words, selling on e‐Bay, amazon.com or any other online store is strictly prohibited). Consultants may sell Watkins products online only through their e‐Consultant website. Updated – January 2013 • • • • The external Web site or URL must follow the same guidelines for Web site content as described in “Content for e‐Consultant Web site.” Every page of any external Web site must clearly identify the Independent Watkins Consultant who is the owner of the site at the top of the Web page content. The exact words “Independent Watkins Consultant” must be clearly displayed at the top of every page, immediately followed by either the Consultant’s ID number or the Consultant’s first and last name (as it appears on their account with Watkins). For example: o Independent Watkins Consultant 123456 o Independent Watkins Consultant John Doe Every page of any external Web site must list the Independent Watkins Consultant who is the owner of the site as the first words of the HTML Title. Note: The HTML Title can usually be specified via Web page creation software or manually with the < TITLE > and < /TITLE > tags in the Web page programming. The exact words “Independent Watkins Consultant” plus the Consultant’s ID number or their first and last name (as it appears on their account with Watkins corporate) must appear first in the HTML Title, and can then optionally be followed by a description of the Web page. Examples of acceptable HTML Titles: o Independent Watkins Consultant 123456 — Buy Watkins Products o Independent Watkins Consultant John Doe — Home Based Business • • • • Every page of any external Web site must include the following General Disclaimer: “The statements made and opinions expressed on this page are those of the Independent Watkins Consultant who is the publisher of this document, and are not to be construed as the statements or opinions of Watkins Incorporated.” If any page of any external Web site contains testimonials about the products or business opportunity, that page must include the following Testimonial Disclaimer in addition to the General Disclaimer: o “Testimonials are based on personal experiences, and we cannot guarantee these same results for everyone.” If any page of any external Web site mentions Watkins Dietary Supplements along with descriptions of possible benefits or testimonials from users, then that page must include the following Dietary Supplement Disclaimer: o “These statements have not been evaluated by the Food & Drug Administration. These products are not intended to diagnose, treat, cure or prevent any disease. In Canada, this information is provided for educational purposes only. No claims are being made for any product.” Social Media The use and popularity of social media has increased dramatically in the past few years. These tools are changing the way companies communicate, collaborate, engage and build relationships with colleagues, clients/customers and vendors and Watkins is joining the conversation. Because our participation in social media is new, we have developed this Social Media Policy (http://www.watkinsonline.com/pdf/Social_Media_Policy_100912.pdf). The policy covers all Watkins Consultants who participate in social media. As used in this policy, the term “social media” or “social media tools” refers to blogs, wikis, social networks, twitter, video and photo sharing websites, online forums, virtual worlds, and any other form of publishing or discussion via the Internet or mobile communications technologies, including all existing and future forms of social media. Updated – January 2013 Please note that this Social Media Policy is an addition to Watkins Internet policies. Violation of any Watkins policy may lead to review and possible termination of your Consultant agreement. • If using a social media site, Watkins Consultants must follow the guidelines for site content as described above in “Content for e‐Consultant Web site.” This includes having the words “Independent Watkins Consultant” — along with the first and last name registered with Watkins Incorporated or the Consultants ID number — displayed at the top of each page of the site, within the Title Tags, and the appropriate disclaimers as described below: General Disclaimer: “The statements made and opinions expressed on this page are those of the Independent Watkins Consultant who is the publisher of this document, and are not to be construed as the statements or opinions of Watkins Incorporated.” Testimonial disclaimer: “Testimonials are based on personal experiences, and we cannot guarantee these same results for everyone.” Downline news disclaimer: “The statements made and opinions expressed on this page are those of the Independent Watkins Consultant who is the publisher of this document and are not the statement, opinion or view of Watkins Incorporated, and therefore are not to be construed as the statements, opinions, or views of Watkins Incorporated. Such statements and opinions have not been reviewed or approved by Watkins Incorporated.” Online Advertising and Promotion Some Consultants choose to advertise online. Before investing any significant time or money into online promotions, however, we strongly recommend that you discuss your plans with your Watkins Home Business Executive. He or she can help ensure that you stay in compliance with these rules, and may help you avoid costly mistakes. There are many possible methods for promoting your business online. Regardless of which you might choose, however, this rule always applies: • If a Consultant uses any online advertising or promotion methods that mention his or her Watkins business, then the advertising or promotion must make it clearly apparent that an Independent Watkins Consultant placed it — there must be no possible confusion of Internet users thinking Watkins corporate placed the advertising or promotion. Organic/Free Search Engine Listings Some Consultants with an external Web site or e‐Consultant site may see their site listed free in the “organic” listings when Internet users search on certain keywords in Google, Yahoo, and other search engines. As in other online promotions, Watkins corporate requires organic listings to identify which sites belong to an Independent Watkins Consultant, so there is no possible confusion with the official Watkins corporate site. Watkins realizes, however, that Web site owners have little control over the way their site gets listed in the organic search results (because some search engines use complex programming to determine how the title and description of sites are listed). By following all other applicable rules in this policy (specifically the rules for HTML Titles on external Web sites and/or the rules for e‐Consultant site content), your site should be clearly identifiable in organic listings as being that of an Independent Watkins Consultant. Sponsored Listings on Search Engines Some Consultants pay to have advertisements among the “sponsored listings” when people search on certain keywords. This advanced advertising (also known as pay‐per‐click or PPC) is available through search engines like Google and Yahoo. As a word of caution, however, it can take a lot of time and money to master the complexities Updated – January 2013 of sponsored listings (such as bidding on keywords and setting ad budgets and thresholds), so we do not recommend this method for most Consultants. Watkins has implemented specific rules about the text of sponsored listings and about keywords on which Consultants may and may not bid. If a Consultant chooses to use sponsored listings, they must submit the Online Marketing Request Form to get approval for the exact text of their advertisement before using it. Here are rules for sponsored listings: • You can choose any appropriate headline for the first line of the ad. • The second line of the ad text must begin with the following phrase: • “Independent Watkins Consultant” • In addition, the ad must visibly include either your Consultant ID number or your first and last name (as it appears on your account with Watkins). • The fourth line is typically the URL (Web address) of the page that will load when prospects click on your sponsored listing. Example of an approved ad: Earn Income with Watkins Independent Watkins Consultant 145 years door to door! #365895 www.WatkinsOnline.com/JohnDoe Prohibited Keywords for Sponsored Listings Consultants who pay for sponsored listings are prohibited from bidding on any keywords pertaining to Watkins trademarked brands and corporate image, including the keywords below in any variation or form. First violation will be a warning; second violation will be a $50.00 fine; third violation will be a $150.00 fine; fourth violation will be a $500.00 fine; and subsequent violations will be a $500.00 fine. If non‐compliance continues after the fourth violation, your Consultant agreement will be reviewed by Watkins management team and could be terminated. Violation fines will be deducted from the Consultant’s next commission check (and, if needed, from each future commission check in its entirety until the fine has been paid in full). Watkins has the right to prohibit any ad used in conjunction with a Watkins business that it feels is misleading in any way and/or could negatively affect Watkins company image and brand. Allowable Keywords for Sponsored Listings Consultants who pay for sponsored listings may bid on specific keywords that include the word “Watkins” when followed by a product type, product category, or a specific product name. The following rules apply: • The video or audio must clearly identify that it was created by an “Independent Watkins Consultant.” • The video or audio must clearly identify both the name AND the Consultant ID number of the Consultant who created it. • The video or audio must have the appropriate disclaimer appear on the screen or be read aloud by the announcer. • The video or audio must be up to date.
