TREE SURGEON HYPO
Facts: Professor Kelly is the owner of a one acre parcel of
land with a private residence. Professor Kelly hires a tree
surgeon to go out & cut down several dying trees in her
backyard. While the tree person is in working in the
backyard, a candidate running for president comes up to
Professor Kelly’s front door to do some direct campaigning.
Professor Kelly explains, “I am just not interested: I am
voting for myself, as always.” The presidential candidate
looks around and starts heading toward the backyard to see
if they will have better luck with the tree surgeon.
Professor Kelly follows the candidate and says “no, forget ityou cannot campaign on my land. You must immediately
leave my property.”
What is the result applying State v Shack & why? Does the
politician have a right of access or do I have the right to
exclude?
