AUTHORISED BETTING OPERATIONS ACT 2000
Major Betting Operations Licence
1. Grant of Licence
1.1 Pursuant to sections 7(1) and 7(3) of the Authorised
Betting Operations Act 2000 (‘Act’) and all other relevant
enabling powers and with the advice and consent of the
Executive Council, I, Marjorie Jackson-Nelson, Governor
of the State of South Australia grant a major betting
operations licence (‘Licence’) to Unitab Pty Ltd (ACN 097
719 107) (‘Licensee’) authorising the Licensee:
(a) to conduct off-course totalizator betting on races held
by licensed racing clubs;
(b) to conduct off-course totalizator betting on approved
contingencies;
(c) to conduct on-course totalizator betting under agreements with licensed racing clubs on races held by
licensed racing clubs and on approved contingencies;
and
(d) to conduct other forms of betting on approved
contingencies (other than fixed odds betting on races
within Australia on which licensed bookmakers are
authorised to conduct betting).
1.2 The Licence is granted subject to:
(a) the provisions and conditions set out in the Act; and
(b) the supplementary licence conditions set out in the
approved licensing agreement.

2. Term
2.1 This Licence takes effect on and from the date on which
completion occurs under the Business Sale Agreement
between the Minister for Government Enterprises, the
Licensee and TAB Queensland Limited.
2.2 This Licence expires on 30 June 2100 unless sooner cancelled under the Act or surrendered with the approval of the
Authority.
3. Definitions and Interpretation
In this Licence, unless the context otherwise requires, terms
defined in the Act have the same meaning and:
(a) headings are for convenience only and do not affect the
interpretation of this licence;
(b) words importing the singular include the plural and vice
versa;
(c) words importing a gender include any gender;
(d) an expression importing a natural person includes any
company, partnership, trust, joint venture, association,
corporation or other body corporate and any governmental agency;
(e) a reference to a condition, clause, schedule or part is to a
condition, clause, schedule or part of this licence;
(f) a reference to any statute, regulation, proclamation, order
in council, ordinance or by-law includes all statutes,
regulations, proclamations, orders in council, ordinances
or by-laws varying, consolidating, re-enact-ing,
extending or replacing them and a reference to a statute
includes all regulations, proclamations, orders in council,
ordinances, by-laws and determinations issued under that
statute;
(g) a reference to a document or a provision of a document
includes an amendment or supplement to, or replacement or novation of, that document or that provision of
that document.

Division at the 570 km mark (Renmark) River Murray on 30
December 2001.
One 20 m orange cord set line with lead weight
15 fish hooks attached to cord by 15 bronze snap swivels and
various lengths of nylon line.
The above items were suspected to have been used or intended
to be used, in contravention of the Fisheries Act 1982, and were
taken into possession at the Loxton Office.
After the expiration of one month from the date of this notice
the items listed above shall, on the order of the Minister for
Primary Industries, be forfeited to the Crown and shall be either
disposed of by sale or destruction.

northern tip of section 164, Cobdogla Division,
Cobdogla Irrigation Area, Out of Hundreds (Renmark); and for safety reasons, all of the area within
500 m radius of the homestead of section 706,
McIntosh Division, Hundred of Cobdogla Irriga-tion
Area.
Note: Access to Loch Luna is mainly by boat—all hunters
should be aware of dangerous quicksand in a number of
areas.

1. Portion of the public road (Tolley Court) south of Grand
Junction Road and adjoining the western boundaries of

and lettered ‘A’ in Preliminary Plan No. PP32/0680 be closed.
2. The whole of the land subject to closure be transferred to
GENE HOLDINGS PTY LTD in accordance with agreement
for transfer dated 8 October 2001, entered into between the City
of Tea Tree Gully and Gene Holdings Pty Ltd.
3. The following easements are granted over the land subject
to that closure:
Grant to the South Australian Water Corporation an
easement for water supply purposes over the whole of the
land.
Grant to the Distribution Lessor Corporation an easement
for overhead electricity supply purposes over portion of the
land.
On 28 November 2001, that order was confirmed by the
Minister for Administrative and Information Services, conditionally on approval and deposit of the survey plan by the
Registrar-General. The condition has now been fulfilled.
Pursuant to section 24 (5) of the Roads (Opening and Closing)
Act 1991, NOTICE of the order referred to above and its
confirmation is hereby given.

13. (1) The fees fixed by the Schedule are payable to the Authority for the purposes set out
in the Schedule.
(2) The licensee must pay to the Commissioner, before the Commissioner grants an
approval of systems, procedures or equipment that the Authority has determined under section
41(1)(c) of the Act to be subject to that section, a fee of the amount determined by the
Commissioner to be the costs incurred in respect of examination of the systems, procedures or
equipment for the purpose of determining whether or not such an approval should be granted.
(3) The Commissioner may waive the whole or a part of a fee payable to the Commissioner
under subregulation (2).

BY-LAW MADE UNDER THE LOCAL GOVERNMENT ACT 1999
By-law No 6—Bird Scaring Devices
TO regulate the use of bird scaring devices for the prevention of
nuisance.
Definitions
1. ‘device’ means any noise generating device designed and
used for the purpose of scaring birds from land;
‘flammable undergrowth’ means grass, weeds and other
flammable or potentially flammable growth;
‘land’ means any piece or section of land or any aggregation
of contiguous land subject to the same ownership or
occupation;
‘multiple detonation device’ means a device that has more
than one detonation in any 10 minute period;
‘noise sensitive premises’ means a dwelling not associated
with the land upon which the device is located, a library, a
child care centre, a kindergarten, a school or other
educational institution, a hospital, a surgery or other medical
institution, a public park or garden or recreation space.
Prohibited Activities
2. No person being the owner or occupier of land, shall use or
employ any device:
(1) in such a manner as to be a nuisance or danger to any other
person;
(2) on Christmas Day or Good Friday;
(3) where the device is gas powered:
(a) unless all flammable undergrowth within a 4 m radius
of the device is destroyed by cutting, slashing or
utilising other means; and
(b) unless all other flammable material within a 4 m
radius of the device is removed.
Permissive Activities
No person being the owner or occupier of land shall, without
permission:
(1) activate a device:
(a) other than between the hours of 7 a.m. and 8 p.m.;
(b) at frequencies greater than 6 per hour;

In this context an activation:
(i) for a gas powered device is one detonation producing a
single emission; and
(ii) for an electronic noise generating device is a single
noise emission or one which produces a continuous
sequence of noise emissions but which does not
exceed 30 seconds in duration.

4. (1) Where there is a breach of any provision of this by-law
the council may serve notice in writing on the owner or occupier
of any land requiring that person to reduce the number of
activations or to disarm or to remove a device.
(2) Any person on whom a notice is served shall comply with
the notice.
(3) If the notice is not complied with the council may carry out
or cause to be carried out the measures required by the notice and
may recover the cost of so doing from the person to whom the
notice was directed.
Protection of Council
The council shall not be liable for any loss caused in exercising
its powers under this by-law.
The foregoing by law was duly made and passed at a meeting of
the City of Playford held on 28 August 2001, by an absolute
majority of the members for the time being constituting the
council, there being at least two thirds of the members present.

Notification and Minor Matters Plan Amendment Report—
Draft for Public Consultation
NOTICE is hereby given that the City of Unley has prepared a
Plan Amendment Report (PAR) to amend the Unley (City)
Development Plan by introducing policies which clarify the
required public notification of development, and address a range
of other minor amendments, but not to alter the policy intent of
Council’s Development Plan.
In summary the proposed amendment:
• clarifies policy with respect to development public notification categories (but does not change the designation of
the category of particular uses);
• clarifies policy dealing with the classification of uses as
either complying or non-complying (again without changing the classification of existing individual uses);
• ensures that forms of development considered by council to
be minor development can be assigned as Category 1;
• improves grammatical expression of policy;
• corrects typographical errors; and
• clarifies the expression of some policy to improve is
understanding.
The draft PAR will be available for public inspection and
purchase during normal office hours at the Council Office, 181
Unley Road, Unley from 20 December 2001 to 27 February 2002.

BY-LAW MADE UNDER THE LOCAL GOVERNMENT ACT 1999
By-law No. 1—Local Government Land
TO manage the control and use of streets, roads, public places,
parklands, reserves and other land under the control of the council.
Definitions
1. In this by-law:
(1) ‘Local Government Land’ means all local government
land as defined in the Local Government Act 1999
(except roads), that is owned by the Council under the
council’s care, control or management;
(2) ‘Authorised Person’ means any person appointed by
council under Chapter 12, Part 3 of the Local Government Act 1999;
(3) ‘Building’ includes any structure of any kind whether for
human habitation or not;
(4) ‘Firearm’ means any gun or device including an airgun,
speargun or slingshot from or by which any kind of shot,
bullet or missile can be discharged;
(5) ‘Waste’ includes soil, stone, rubble, animal, mineral or
vegetable matter and other debris, waste and refuse of
any kind;
(6) ‘Offensive’ includes threatening, abusive, insulting or
annoying behaviour;
(7) ‘Officer’ means any Council Officer, Police Officer or
authorised person;
(8) a ‘vehicle’ includes:
(a) a motor vehicle, trailer and tram;
(b) a bicycle;
(c) an animal-drawn vehicle and an animal that is being
ridden or drawing a vehicle;

(d) a combination; and
(e) a motorised wheelchair that can travel at over
10 km/h (on level ground),
but does not include another kind of wheelchair, a train,
or a wheeled recreational device or wheeled toy;
(9) ‘Object’ includes any sign, placard, advertisement, box,
article or thing.
Prohibited Activities
2. No person shall, on Local Government Land:
(1) (a) damage, injure, deface or interfere with, or climb
over or upon any buildings, structures or any
property of the council whatsoever;
(b) throw, cast, place, deposit or leave any rubbish, dirt
or refuse of any kind whatsoever except in a garbage
container provided for that purpose;
(c) enter or use any public or sanitary convenience or
urinal set apart for a person of the opposite sex;
Council may do work
(2) if the notice is not complied with the council may cause
the measures required by the notice to be performed, and
may recover the cost of so doing from the person to
whom the notice was directed;
Council employees, Authorised Officers and Exempt Vehicles
(3) (a) the restrictions in this by-law do not apply to any
officer or employee acting in course and within the
scope of that person’s normal duties;
(b) drivers of exempt vehicles and vehicles used by an
officer or employee of the council in the course of
normal duties are exempt from the operation of
paragraphs 3 (11) and 4 (2) of this by-law;
Application of paragraphs
(4) any of subparagraphs 3 (11) (e), 3 (11) (f), 3 (11) (g), 3
(11) (h), 3 (11) (i), 3 (12) (b), 3 (14) of this by-law
shall apply only in such portion or portions of the area as
the council may by resolution direct (pursuant to the
Local Government Act 1999, or any enactment in
substitution therefor).
The foregoing by-law was duly made and passed at a meeting of
the council of the District Council of Tumby Bay held on 10
December 2001, by an absolute majority of the members for the
time being constituting the council there being eight of the nine
members present.

By-law No. 2—Boat Ramps/Cradle
TO regulate the use of the boat ramp/cradle and surrounding lands
at Tumby Bay and Port Neill which are used for access to the boat
ramp and which are under the control of the council.
Definitions
1. In this by-law:
(1) ‘Authorised Person’ means any person appointed by
council under Chapter 12, Part 3 of the Local
Government Act 1999.
(2) ‘Boat Ramp’ means a facility constructed, maintained
and operated for the launching and retrieval of small
craft and located at Saxon Street, Tumby Bay and
Anchor Drive, Port Neill.
(3) ‘Cradle’ means a trailer used for retrieval and maintenance of small craft.
(4) ‘Officer’ means any Council Officer, Police Officer or
authorised person.

(5) ‘Vehicle’ includes trailer and means every sort of
moving contrivance used for the carrying and transporting of persons or things.
Fees
2. (1) Council from time to time may prescribe a fee for use of
the boat ramp/cradle.
(2) No person shall use the boat ramp/cradle without paying the
fee before using the boat ramp/cradle.
(3) Council may grant exemptions to the payment of the fee e.g.
to organisations involved in search and rescue at sea.
(4) Council may erect signs or notices which indicate the fee
and the place where it is to be paid.
(5) A receipt in a format prescribed by the council shall be
issued for payment of the fee and the receipt shall be displayed on
the dashboard of the vehicle or attached to the trailer for it to be
checked by an officer.
(6) No person shall fish or swim within 10 m of the boat ramp.
(7) An officer may affix an account to pay on any vehicle,
which does not display a valid receipt.
Offence
3. Any person who fails to pay the fee commits an offence as
prescribed in By-law No. 4.

By-law No. 4—Permits and Penalties
TO provide for a permit system and continuing penalties in
council by-laws and to clarify the construction of such by-laws.
Permits
1. (1) In any by-law of the council unless the contrary intention
is clearly indicated, the word ‘permission’ means the permission
of the council given in writing.
(2) Council may attach such conditions to a grant of permis-sion
as it thinks fit, and may vary or revoke such conditions or impose
new conditions by notice in writing to the permit holder.
(3) Any permit holder shall comply with every such condition.
Penalties
2. (1) Any person who commits an offence against or is in
breach of any by-law shall be liable to a penalty not exceeding the
maximum penalty prescribed under the Local Government Act
1999 (as at August 2001 this amount is $750).
(2) Unless otherwise decided by resolution of the council, the
expiation fee for our alleged offences against any by-law is 25%
of the maximum penalty.
(3) Any person who attempts to commit any act which is an
offence against or in breach of any by-law shall be guilty of an
offence, which shall be dealt with as if the offence or breach itself
had been committed.
Construction
(4) Every by-law of the council shall be subject to any Act of
Parliament and Regulations made thereunder.
