In 2006, British Columbia became the second province to enact a civil forfeiture law. Civil forfeiture statutes allow government to seek the forfeiture of the proceeds of unlawful activity, or assets used to commit unlawful acts. As the name "civil forfeiture" implies, forfeitures of this nature utilize civil law process, including the civil standard of proof - balance of probabilities. Civil forfeiture is based upon civil law concepts dealing with unjust enrichment and property rights and is completely distinct from criminal law forfeiture provisions which form part of the criminal law sentencing process. Civil forfeiture laws have proven to be a novel and effective response to profit driven crime and are in use in a number of jurisdictions including the United Kingdom, Australia, the United States and South Africa.
