Accordingly, this Local Coastal Program Amendment is necessary to ensure consistency between its proposed amended Zoning Ordinance and its Local Coastal Program. This specific Zone Code Amendment is as follows: The amendment would revise the table identifying permitted uses in Zoning Ordinance Chapter 21.36 (Public Utilities Zone) and would change Agriculture Policy 2.3 in the Agua Hedionda Lagoon Land Use Plan. In the Zoning Ordinance, the amendment would clarify that generation of electrical energy must be by public or publicly controlled agencies or by utility companies to the extent the utility companies are regulated by the California Public Utilities Commission. The amendment would also establish that generation of electrical energy is permitted (1) as a primary use outside the City's Coastal Zone only and (2) as an accessory use inside or outside the Coastal Zone and is limited to a generating capacity of fewer than 50 megawatts.
