This call for expressions of interest follows the General Procurement Notice for this project that appeared
on-line in dgMarket on November 27, 2008 and in UN Development Business on November 28, 2008, as
well as published on National Commission on Financial Markets web-site of free access.
The Republic of Moldova has received financing from the International Bank for Reconstruction and
Development toward the cost of implementation of the Financial Sector Reform Project (FSRP), and
intends to apply part of the proceeds for procurement of consulting services of a local individual
consultant Development of the secondary normative framework under the law on micro-financing
organizations.
The main objectives of the consultancy assignment are the following:

To assess and provide international benchmarks on best experience and practices in the field of
micro-financing activity regulation.

To develop the secondary normative framework under the Law on micro-financing organizations
harmonized to EU Directives and international best practices in the field.
During the implementation of the assignment, the Consultant is expected to perform the following tasks:
1. Development of the normative secondary framework under the Law on micro financing
organizations, according to the best European and international practices in the field, taking into
account the national legislative framework and requirements of legislative techniques. Therewith,
the normative framework will include:
a) Financial prudential norms, including at least the following aspects:
requirements for capital;
limitation of loan risks;
requirements on transactions with affiliated persons;
classification of loans and interests, and the creation and use of loan loss
provisions;
b) Instruction on submission of financial and specializes reports by micro financing
organizations;
c) Exigency to micro financing organizations administrators;
d) Mode of authorization by the NCFM of the micro financing organization activity;
e) State registration of microfinance organizations, including the mode of notice issuance for
state registration by NCFM;
f) Qualifications to micro financing organization audit;
2. Development of the informative notes on draft regulations, including regulatory impact assessment
(RIA).
The requirements for the individual Consultant are as follows:
 Academic background in law and / or economic;
 Knowledge of the best international practices in micro financing activity regulation;

 Experience in transposition / approximation of national legislation with EU legislation;
 Working experience in the non-banking financial field, including experience in development of
legislative and normative acts;
 Has prior successful experience with donors’ and IFIs’ sponsored projects with similar nature.
The Project Implementation Unit of the World Bank Competitiveness Enhancement Project now
invites eligible individual local consultants (Moldovan Citizen) to indicate their interest in providing the
services. Interested Consultants must provide information indicating that they are qualified to perform the
services (CV, copy of the diploma, description of similar assignments, copy of the certificate(s), etc.).
This Call for Expression of Interest will lead to the preparation of a Short List of consultants. For
evaluation of the expressions of interest the following criteria will be applied:

Academic background in law and / or economics (15 points);
Experience in transposition / approximation of the national legislation with EU legislation
(desirable in the field of micro-financing) (35 points);
Working experience in the non-banking financial field, including experience in development of
legislative and normative acts (40 points);
Successful experience with donor-financed projects of similar nature (10 points)
A consultant will be selected in accordance with the procedures set out in the World Bank’s Guidelines:
Selection and Employment of Consultants by World Bank Borrowers, May 2004 revised October 2006.
The assignment will be implemented in the period from October – December 2011, and will require an
effort of approximately 50 man-days.
