RM 17 SENASKHAH TYPES OF LAND ACQUISITION Two types of “acquisitions” State land by the Federal Government under the provisions of the Federal Constitution 1 Allienated land by the State Government under the provisions of the Land Acquisition Act 1960 2 Article 83 - Land needed for “federal purposes” ( Federal Government & public authorities ) Article 85 - Grant to Federation of land reserve for federal purpose Article 86 - Disposition of land vested in the Federation Article 87 - Determination of disputes as to land values Article 88 - Application of Article 83 - 87 to States not having a Ruler Sec. 3 State Authority Decide to acquire Sec. 7 LA prepare plan and List of the said land Sec. 5 Survey the land Sec. 8 Declare in the Gazettee the State decide to acquire land Sec. 4 Land Administrator (LA) Issue Notice (published in the Gazette that land is likely to be needed) Sec. 6 If anything damage, pay damages Sec. 9 LA marked out the area concerned Procedure at Inquiry: See. 12 – full inquiry (value of land) See. 13 – Summon witnesses Sec. 14 – Make award Sec. 10 LA gives Public Notice for an Inquiry for hearing of claims to Compensation (after 21 days of Issuing Notice)
