Possible Model of Draft Administrative Order (AO) from UAP-IAPOA Chapters in the Northern Luzon Super Region Republika ng Pilipinas Lungsod/ Bayan ng ____________ Office of the City/ Municipal Mayor ADMINISTRATIVE ORDER NO. ___ DIRECTING THE CITY/ MUNICIPAL BUILDING OFFICIAL AND THE CITY/ MUNICIPAL ENGINEER OF THE CITY/ MUNICIPALITY OF ____________________ TO FULLY IMPLEMENT AND ENFORCE THE PROVISIONS OF THE 2004 REVISED IMPLEMENTING RULES AND REGULATIONS (R-IRR) OF PRESIDENTIAL DECREE (P.D.) NO. 1096, OTHERWISE KNOWN AS THE 1977 NATIONAL BUILDING CODE OF THE PHILIPPINES (NBCP). WHEREAS, Presidential Decree (P.D.) No. 1096, otherwise known as the 1977 National Building Code of the Philippines (NBCP), has been in effect since February 19, 1977 and its 2004 Revised Implementing Rules and Regulations (R-IRR) have been in full effect since 01 May 2005; WHEREAS, The May 2005 Court Injunction issued against Secs. 302.3 & 4 of the 2004 R-IRR of P.D. No. 1096, was LIFTED/ DISSOLVED by a Court Order signed 29 January 2008 and affirmed by another Court Order dated 04 May 2009. The said sections LIMIT/ RESTRICT the SIGNING and SEALING of ARCHITECTURAL DOCUMENTS only to Registered and Licensed Architects (RLAs). WHEREAS, all building permit applications under P.D. No. 1096, require the submission of architectural documents as the main part of the set of building plans/ designs; WHEREAS, such architectural documents generally consist of perspectives site development, architectural floor, ceiling and roof plans, designs, schedules, drawings, specifications, estimates and documents i.e. the drawing sheets labeled as “A” for architectural, and forming part of building plans, contract documents and the like; WHEREAS, R.A. No. 9266 states that only Registered and Licensed Architects (RLAs) must prepare, sign and seal architectural documents i.e. specifically the drawing sheets labeled as “A” in building plans, contract documents, and the like that accompany building permit applications; WHEREAS, United Architects of the Philippines (UAP) through its ________________Chapters, has called on the City/ Municipal Building Official and the City/ Municipal Engineer and on the assistance of the LGU of the City/ Municipality of ____________________ to fully implement and enforce the provisions of 2004 Revised Implementing Rules and Regulations (R-IRR) of P.D. No. 1096, otherwise known as the 1977 National Building Code of the Philippines (NBCP) within its jurisdiction, and to prosecute any person violating provisions of the same; NOW, THEREFORE, I, ______________________, Mayor of the City/ Municipality of ____________, by virtue of the powers vested in me by law, do hereby order: Section 1. City/ Municipal Building Official and the City/ Municipal Engineer. The City/ Municipal Building Official and the City/ Municipal Engineer must fully implement and enforce Sections. 302.3 & 4 of the 2004 Revised Implementing Rules and Regulations (R-IRR) of Presidential Decree (P.D.) No. 1096, otherwise known as the 1977 National Building Code of the Philippines (NBCP) and accept, process and approve only the architectural documents duly signed and sealed by a registered and licensed architect (RLA), and cause the prosecution of any person violating provisions of the same. The City/ Municipal Building Official and/or the City/ Municipal Engineer must fully implement and enforce Sections. 302.3 & 4 of the 2004 Revised Implementing Rules and Regulations (R-IRR) of Presidential Decree (P.D.) No. 1096, otherwise known as the 1977 National Building Code of the Philippines (NBCP) by requiring, accepting and approving only the signatures and seals of registered and licensed architects (RLAs) on all architectural documents accompanying the “Building Permit Application Form” (reference Annex “1”), and cause the prosecution of any person violating provisions of the same. Section 2. Implementation Assistance The City/ Municipal Legal Office, City/ Municipal Building Official and the City/ Municipal Engineer’s Office, City/ Municipal Fire Station, Office of the Planning & Development Coordinator, City/ Municipal Environment & Parks Management Office, City/ Municipal Police Office and all Barangay Offices are hereby directed to assist in whatever capacity, to effectively and efficiently implement this Administrative Order. Section 3. Separability Clause. If any part or provision of the Administrative Order is held invalid or unconstitutional, the other parts or provisions not affected shall remain valid and effective. Section 4. Effectivity. This Administrative Order shall take effect immediately.
