This contest (the “Contest”) to win one (1) of ten (12) Gaggia Color Espresso/Cappuccino
Makers is organized by Saputo Foods Limited (the “Sponsors”). The Contest begins on
Monday, September 8, 2008, 8:00 AM Atlantic (the “Contest Start Date”) and terminates on
Friday, October 17, 2008, 6:00 PM Atlantic (the “Contest Close Date”).
HOW TO ENTER
1) The entry form (the “Entry Form”) to participate in the Contest is available on the
Internet at www.BaxterMilk.ca (the “Website”).
2) To enter the Contest, the participant (the “Participant”) must follow the entry
instructions on the Website to complete the information on the Entry Form. Click the
area marked “Enter” (once submitted, entry cannot be deleted, cancelled or
modified) for your chance to win. Limit one submitted Entry Form per person/e-mail
address per day.
3) NON-WEBSITE ENTRY: To enter the Contest without entering via the Website, legibly
hand-print your name, address, e-mail address, age, daytime phone number and
answer to the following skill testing question: Multiply 15 by 5, then subtract 6, then
divide by 3, finally add 7; on a 3” x 5” card and mail it to, Baxter - We’re Family, c/o 38
Sydney Street, Suite 202, Saint John, NB E2L 2L3. Entry Forms must be received by the
Contest Close Date.
4) Entry Forms received after the Contest Close Date are not eligible to participate in
the Contest and will not be accepted by the Sponsor.
5) CONDITIONS OF ENTRY: You may enter the Contest under one name/e-mail address
per day only. In the event of a dispute about Entry Forms submitted by multiple
Participants using the same e-mail account or address, the Entry Form will be deemed
to have been submitted by the authorized holder of the e-mail account used to enter
the Contest at the actual time of entry. The name of the authorized account holder
associated with any e-mail address will be deemed to be the Participant and must
comply with these official rules. The authorized account holder is defined as the
natural person who is assigned to an e-mail address by an Internet access provider,
online service provider or other organization that is responsible for assigning e-mail
addresses or the domain associated with the submitted e-mail address. Multiple
Entry Forms per Participant/e-mail address in excess of the one per day Entry Form
limit, or any use of robotic, repetitive, automatic, programmed or similar entry
methods or agents (including, but not limited to Contest entry services) are
prohibited and will void all Entry Forms submitted by that Participant. The Sponsor
will not be responsible for lost, late, incomplete, illegible, garbled, stolen, postagedue, undelivered or misdirected Entry Forms, which will be void.
-2PRIZE
1) There are twelve (12) Gaggia Color Espresso/Cappuccino Machine (Item Number: 110
381 444) available to be won (each, a “Prize”). The approximate retail value of each
Prize is four hundred dollars in Canadian currency ($CDN 400.00).
SELECTION OF THE PRIZE WINNERS
2) A random draw from all eligible Entry Forms received will take place on Thursday,
October 23, 2008 (the “Draw Date”) at 2.00 p.m. local time, at 38 Sydney Street,
Suite 202 in Saint John, New Brunswick. Chances of winning a Prize are dependent
upon the total number of completed Entry Forms received. The selected Participants
will be notified by telephone within fourteen (14) days of the Draw Date. In the event
that a selected Participant cannot be contacted by telephone after three (3)
attempts within fourteen (14) days of the Draw Date, the Sponsor reserves the right
to disqualify the selected Participant and to randomly select another Participant from
among all of the remaining Entry Forms received.
ELIGIBILITY AND GENERAL CONDITIONS
3) The Contest is only open to persons resident in either the province of New Brunswick
or Nova Scotia, who are the age of majority in his or her province of residence as of
the Contest Start Date, except employees, representatives and agents of the
Sponsor and its affiliates, their advertising and promotional agencies, the
independent judging organization and all those with whom they are domiciled
cannot participate in the Contest. By participating in the Contest, Participants agree
to abide by these official rules and decisions of the Contest judging organization,
which shall be final. The Contest is subject to all applicable federal, provincial and
municipal laws and regulations. Subject to any required government consent, the
Sponsor reserves the right to cancel or suspend the Contest in the event of any
accident, or administrative or other error of any kind.
4) Participants must have completed the Entry Form in full, including having correctly
answered the mathematical skill-testing question that appears on the Entry Form. All
Entry Forms must be received by the Contest Close Date and be received by the
judging organization prior to the Draw Date. The selected Participants will be
required to sign a declaration and release form that will release the Sponsor from all
direct and indirect liability regarding the Contest and the Prizes.
5) All Entry Forms become the sole property of the Sponsor and will not be returned to
the Participants. The Sponsor will not be responsible for Entry Forms that are
received late for any reason, illegible in whole or in part, incomplete, erroneous, lost
or misdirected. There is a maximum of one (1) Prize that can be won per household.
In any case, the Sponsor and its agents cannot be responsible for a value of more
than four hundred dollars in Canadian currency ($CDN $400.00) for the Prizes. In
order to receive a Prize, each selected Participant must sign a document consenting
to the use of his/her name, address and photograph for publicity purposes, without
further compensation, and releasing and indemnifying the Sponsor, its associated
companies, advertising and promotional agencies, distribution companies, Prize
-3suppliers, employees and respective agents from any liability whatsoever occurring
as a result of the participation in the Contest or of a Prize being awarded or used.
Correspondence will only be exchanged with the selected Participants. Please allow
between 45 and 60 days for the reception of the Prize from the date on which the
Sponsor has received the signed declaration and release form from the selected
Participant. The refusal to accept a Prize releases and forever discharges the Sponsor
and its agents of all obligations related to the Contest, including the award of the
Prize and its delivery.
6) The Prize is not transferable, must be accepted as awarded and is not convertible to
other property, in whole or in part, at the request of the selected Participant.
However, the Sponsor reserves the right to substitute all or part of the Prize with an
item or items that are similar to and of equivalent value with any item forming part of
the Prize, without prior notification to the selected Participant, at the Sponsor’s sole
and entire discretion.
7) The Sponsor and its agents are not responsible for printing, distribution or
production errors and, subject to any required government consent, the Sponsor
may, in its sole discretion, terminate the Contest at any time, without any liability
whatsoever.
8) The Sponsor is not responsible for any disruption or failure of the postal service
which results in late delivery of any Entry Form.
9) The Sponsor may, subject to any required government consent, at its sole discretion,
cancel or suspend the Contest should any cause beyond the reasonable control of
the Sponsor corrupt the security or proper administration of the Contest. Any
attempt to deliberately undermine the legitimate progress of the Contest is a
violation of criminal and civil laws, and should such attempt be made, the Sponsor
reserves the right to seek remedies and damages to the fullest extent permitted by
law. Entry Forms are subject to verification and will be declared invalid if they are
illegible, mechanically reproduced, forged, falsified, altered or tampered with in any
way.
