How to Request Deferred Adjudication (Probation)
Deferred Adjudication is a program to have your citation dismissed after completion of a 90 to
180 day period in which no additional convictions are received. The Judge will determine
whether the probation is 90 or 180 days. To be approved, you must be eligible and all fees
must be paid at the time of your request.
You may be eligible for deferred adjudication if:






You are not currently on probation in this or any other court.
You are 18 years of age or older.
Your citation was not 25 or more miles over the speed limit in a regular zone.
Your citation was not 15 or more miles over the speed limit in a school zone.
You were not in a construction zone with workers present.
You do not hold a commercial driver’s license.
**If your citation does not meet all of the above requirements, you may NOT request
probation.
In order to request probation, you must submit the following to the court:
1. Deferred Adjudication Fee
Speeding – Non-School Zone 1-10 miles over
10-24 miles over
Speeding – School Zone
1-14 miles over
2. Completed Request Form
3. A copy of your valid Driver’s License

*In accordance with CCP 45.051, if you are 17 years of age and hold a provisional driver
license during the deferral period, you will be required to be examined by the Department of
Public Safety and present evidence of compliance along with a Certificate of Completion of a
Driving Safety Course by the end of your deferral period. There will be a $10.00 fee payable
to the Department of Public Safety for the examination.
*In accordance with CCP 45.051, if you are between the ages of 18 and 24, you will be placed
on a 90 day deferral period and be required to complete a Driving Safety Course. You must
present a Certificate of Completion of a Driving Safety course by the end of your deferral
period.

I wish to enter a plea of No Contest/Guilty, I hereby waive my right to trial by jury and request
Deferred Adjudication. I understand the Court will defer further action for a period of 90 to 180
days. During which time, I must NOT be convicted of any moving traffic violations. I also
understand that if I am under the age of 25 years I will be required to complete a Driving Safety
Course.
