You have requested this court to consider placing you on deferred adjudication probation. Pursuant to article 42.12
Section 5, V.C.C.P. it is incumbent upon me to advise you of the possible consequences in the event that I find that you have
violated any of the terms or conditions placed upon you by this court during the term of your deferred adjudication probation.
Upon finding that you have violated a term or condition of your deferred adjudication this court may order your arrest
with or without a warrant by a probation officer, police officer, or other officer with powers of arrest; a bond may or may not
be set allowing you to be released and requiring you to appear before this court; if you are not released on bond you have the
right to a hearing within 20 days of your filing a motion requesting a hearing; you would have the right to counsel at such a
hearing; at that hearing the sole issue will be whether or not to proceed with an adjudication of your guilt; after the hearing
without a jury, the court may continue, extend, modify or revoke the probation; you cannot appeal from the court's
determination to adjudicate your guilt.
If, after a hearing I proceed to adjudicate you guilty, all proceedings including assessment of punishment, pronouncement
of sentence, granting of probation, and any subsequent appeal continue as if the adjudication had not been deferred.
After adjudication I may assess your punishment anywhere within the range of punishment as stated in your
accompanying Plea of Guilty / Nolo Contendere which is a part of this record.
Upon sentencing I may require you to satisfy the judgment of this court in whole or in part by paying a fine and / or being
confined in the county jail, by electronic monitoring, community service, manual labor or any combination of the above.
