CONDITIONS:

1. Interested bidders can purchase the tender documents online from website

2. The tenderers will have to deposit earnest money which is to be paid through e-mode online( NEFT/RTGS, Net Banking, OTC, IPG ). Other mode of payment DD/Manual will not be considered.

3. Tender Form fee Rs 1000/- shall be strictly paid through online mode.

Other mode of payment will not be considered.

4. Bidders have to pay the processing fee through IPG/Net-Banking. Other mode of payment will not be considered.

5. Bidders can access tender documents on the website, fill it and submit the completed tender document into Electronic Tender on the website itself.

Bidders shall attach scanned copies of all the documents, i.e. Earnest Money,

Tender Form Cost & Processing fee etc. as required in the Bid.

6. The tenders without earnest money, tender form fee & processing fee will not be considered.

7. Corrigendum / Addendum / Corrections, if any will be published on the website.

8. If the date of opening of tenders happens to be a holiday then the tenders will be opened on the next working day at the same time.

9. The Tenders shall be valid for 30 days from date of opening of Tenders.

10. The Committee reserves the right to accept/reject any or all tenders without assigning any reasons.

127, Sector 17-B, 3 rd floor, Chandigarh invites on line tender from Manufacturers of HDPE/PP Woven Sacks for packing 50 kg. sugar for the Cooperative Sugar

Mills in the State of Punjab located at Morinda, Nawanshahr, Batala, Gurdaspur,

Fazilka, Nakodar, Budhewal, Bhogpur and Ajnala as per specifications given below. Total bags required are 24,67,135 Nos.

NOTES :

1. The specified dimensions provide for optimum free space of minimum 20 percent of length when measured along the surface of the fabric from mouth- stitch line of the sacks upto the surface level of contents.

2. The mass of sack is based on fabrics weighing 106 g/m2 and 96 g/m2 for Type 1 and Type 2 sacks respectively. i) Width after raveling = 50 mm. Gauge length = 200 mm ii) N = 0.102 kgf (approx.)

1. Only original Manufacturers of HDPE/PP bags with liner can participate in the tender. Manufacturers should attach the proof of themselves to be the manufacturers from any Govt. authority.

2. The Manufacturer should quote their rates of HDPE/PP Bags with liner conforming to IS specifications with tested samples and test report

(comprising of all tests as per ISI standards) from Govt./Govt approved laboratory. Two (2) samples be deposited in the office before opening of Technical Bid.

3. The tenderer should be genuine composite Woven Sacks manufacturer (i.e. from processing PP virgin granules upto the making of woven sacks) and not merely a fabricator.

4. Weaving pattern of HDPE/PP bags should be anti-slip and shelf life of the bag should be of minimum one year.

5. The sack shall be printed in black/dark blue colour conforming to IS

9833 with identification mark of sack manufacturer alongwith the information as required by the buyer mill using suitable ink by flexography.

6. The sack shall be packed to form a bale using a layer of HDPE/PP woven fabric and suitably secured. The bale shall contain 500 sacks and multiple thereof. Each bale containing HDPE/PP sack may also be marked with the standard mark.

7. Tender should be submitted strictly as per the terms & conditions of

DNIT. Any variation will result in rejection of the tender.

8. The rate should be quoted per bag basis on F.O.R. inclusive of all taxes, duties (VAT, CENVAT, Sales Tax, Freight, Service Tax, Entry

Tax, Levies, Custom duties etc.) The supplier will make all the transport arrangements for transporting the material to the respective

Coop. Sugar Mills. The rates will remain firm for the whole crushing season 2015-16 and no escalation will be payable on any account.

9. Mills reserves the right to get the bags tested from Shri Ram Industrial

Research Institute, Delhi at the risk and cost of supplier. However sample of bag will be drawn randomly by the Sugarfed/Sugar mills in presence of supplier or his authorized representative. The rejected bags shall have to be taken back by the supplier at their own cost for replacement. Rejection by mill/Federation at mill end shall be treated as final and neither supplier nor the inspecting agency shall be opened to contest the decision taken by the mill/Federation nor this issue can be raised in any court of law.

10. Supplier has to give warranty for 12 months from the date of supply of material. If manufacturing defect is found during warranty period the same will be replaced free of cost by supplier within 2 weeks.

11. The tenderers are required to deposit Rs. 5.00 lac (Rs. Five lac only) as earnest money through e-mode online (NEFT/RTGS, Net Banking,

OTC, IPG). No interest shall be paid on Earnest money which shall be retained in case of successful tenderer in the fulfillment of terms and conditions of the supply. No tender would be accepted without earnest money.

12. The successful tenderer will have to give a refundable security of 10%

4 of ordered value (inclusive of earnest money already deposited) in the shape of demand draft of Scheduled bank in favour of “The Punjab

State Federation of Cooperative Sugar Mills Ltd.,” payable at

Chandigarh or through e-mode online (NEFT/RTGS, Net Banking,

OTC, IPG). No interest shall be payable on this security. The security amount will be refunded after complete and satisfactory supply as per order.

13. The technical bid should be attached with documents as per clause 1

& 2 above. The technical bid without required documents, earnest money, tender form fee and processing fee will be rejected. The technical bids will be opened first. Financial bids of the bidders whose technical bids meet the eligibility criteria and are found to be responsive shall be opened thereafter.

14. The contract shall be subject to the provisions of Section 56 of the

Indian Contract Act, 1872.

15. The supplier shall be liable to replace defective/rejected material, if any within 15 days at his own cost.

16. 100% payment will be released by the mills against the receipt of the specified material in good condition as per specifications.

17. The Finance Committee reserves the right to accept or reject any or all of the tenders or modify the terms and conditions of tender documents without assigning any reason and the tenderer shall be required to abide by such decision.

18. Delivery schedule for 50kg HDPE/PP bags with liner will be given by the respective Cooperative Sugar Mills.

19. The quantity of material may vary upto 20% at the sole discretion of the Federation/Mill at any time. Delivery schedule can also be changed by the Sugar Mill concerned. Tendered quantity shall further be keeping in view the existing package/policy of the Govt. of India. In case of any change in the package/policy of Govt. of India and subsequent variation in requirement, Mills shall not be bound to purchase the tendered quantity.

20. The tenderer will ensure that the fortnightly supply to the mill is received by the end of the fortnight as per delivery schedule. Delay upto 3 days will not invite any action. In case of any further delay, in receipt of material as per delivery schedule, a penalty @1% per week subject to maximum 5% of the value of the material to be received during that fortnight will be imposed. In case the supplier is unable to supply the material as per specifications, even after this i.e. 38 days

(3+ 35), the Managing Director, Sugarfed Punjab shall have the absolute powers to purchase the material at the risk and cost of the supplier.

21. The earnest money of the successful tenderer will be forfeited, if he withdraw his offer/rates or modify the terms and conditions of the same during the validity of their offer which are adverse to the conditions of

NIT issued by Sugarfed, Punjab. In case of evidence of cartel formation by the bidder(s), the EMD is liable to be forfeited alongwith

other actions as are permissible to Govt. like filling complaints with

5 the Competent Commissions of India and/or other appropriate forums.

22. If any time during the period of contract, the supplier supplies the said material of similar specifications on similar payment terms to any other sugar mills in Punjab on the rates lower than the ones agreed upon, the supplier shall notify such reduction forthwith and rates shall stand automatically reduced for all mills to that extent with effect from the date of supplies made on reduced rates. The supplier shall also give a certificate on the bills that rates charged by them are not higher than those charged by them from any other sugar mills in Punjab during the corresponding period.

Any dispute arising between the parties hereto shall be referred to the sole arbitration of Managing Director, Sugarfed Punjab whose decision shall be final and binding on the parties. The said decision shall not be open to challenge before any courts.
