59A‐18.009HomemakersorCompanions.
(1)Thehomemakerorcompanionshallhaveevidenceoftrainingintopicsrelatedtohumandevelopmentandinterpersonal
relationships,nutrition,shopping,foodstorage,useofequipmentandsupplies,planningandorganizingofhouseholdtasksand
principlesofcleanlinessandsafety:
(2)Thehomemakershallhavethefollowingresponsibilities:
(a)Tomaintainthehomeintheoptimumstateofcleanlinessandsafetydependingupontheclient’sandthecaregiver’sresources;
(b)Toperformthefunctionsgenerallyundertakenbythenaturalhomemaker,includingsuchdutiesaspreparationofmeals,laundry,
andshopping;
(c)Toperformcasual,cosmeticassistance,suchasbrushingtheclient’shair,assistingwithmake‐up,filingandpolishingnails,withthe
exceptionofclippingnailsfordiabeticpatients;
(d)Tostabilizetheclientwhenwalking,asneeded,byholdingtheclient’sarmorhand;and
(e)Toreportanyunusualincidentsorchangesinthepatient’sorclient’sbehaviortothenurseregistryadministrationandtothe
caregiver.
(3)Thecompanionshallhavethefollowingresponsibilities:
(a)Toprovidecompanionshipforthepatientorclient;
(b)Toprovideescortservicessuchastakingthepatientorclienttothedoctor;
(c)Toprovidelighthousekeepingtaskssuchaspreparationofamealorlaunderingtheclient’spersonalgarments;
(d)Toperformcasual,cosmeticassistance,suchasbrushingtheclient’shair,assistingwithmake‐up,filingandpolishingnails,withthe
exceptionofclippingnailsfordiabeticpatients;and
(e)Tostabilizetheclientwhenwalking,asneeded,byholdingtheclient’sarmorhand;and
(f)Toreportanyunusualincidentsorchangesinthepatient’sorclient’sbehaviortothenurseregistryadministrationandtothe
caregiver.
(4)Eachnurseregistryshallensurethathomemakersandcompanionsunderstandtheneedsofthepatientsorclientstowhomthey
arereferredandareabletorecognizethoseconditionsthatneedtobereportedtothenurseregistryoffice.
(5)Homemakersandcompanionsshallberesponsibleforprovidingtopatientandnurseregistrycopiesofanydocumentationwhich
reflectstheservicesprovided.Thiswillbestoredbythenurseregistryintheclient’sfile.

400.506Licensureofnurseregistries;requirements;penalties.‐‐
(1)Anurseregistryisexemptfromthelicensingrequirementsofahomehealthagencybutmustbelicensedasanurseregistry.The
requirementsofpartIIofchapter408applytotheprovisionofservicesthatrequirelicensurepursuanttoss.400.506‐400.518and
partIIofchapter408andtoentitieslicensedbyorapplyingforsuchlicensefromtheAgencyforHealthCareAdministrationpursuant
toss.400.506‐400.518.Alicenseissuedbytheagencyisrequiredfortheoperationofanurseregistry.Eachoperationalsiteofthe
nurseregistrymustbelicensed,unlessthereismorethanonesitewithinacounty.Ifthereismorethanonesitewithinacounty,only
onelicensepercountyisrequired.Eachoperationalsitemustbelistedonthelicense.
(2)EachapplicantforlicensureandeachlicenseemustcomplywithallprovisionsofpartIIofchapter408andthissection.
(3)Inaccordancewiths.408.805,anapplicantorlicenseeshallpayafeeforeachlicenseapplicationsubmittedunderss.400.506‐
400.518,partIIofchapter408,andapplicablerules.Theamountofthefeeshallbeestablishedbyruleandmaynotexceed$2,000per
biennium.
(4)Apersonthatprovides,offers,oradvertisestothepublicanyserviceforwhichlicensureisrequiredunderthissectionmust
includeinsuchadvertisementthelicensenumberissuedtoitbytheAgencyforHealthCareAdministration.Theagencyshallassessa
fineofnotlessthan$100againstanylicenseewhofailstoincludethelicensenumberwhensubmittingtheadvertisementfor
publication,broadcast,orprinting.Thefineforasecondorsubsequentoffenseis$500.
(5)(a)Inadditiontotherequirementsofs.408.812,anypersonwhoowns,operates,ormaintainsanunlicensednurseregistryand
who,within10workingdaysafterreceivingnotificationfromtheagency,failstoceaseoperationandapplyforalicenseunderthis
partcommitsamisdemeanoroftheseconddegree,punishableasprovidedins.775.082ors.775.083.Eachdayofcontinuedoperation
isaseparateoffense.
(b)Ifanurseregistryfailstoceaseoperationafteragencynotification,theagencymayimposeafineof$500foreachdayof
noncompliance.
(6)(a)Anurseregistrymayreferforcontractinprivateresidencesregisterednursesandlicensedpracticalnursesregisteredand
licensedunderpartIofchapter464,certifiednursingassistantscertifiedunderpartIIofchapter464,homehealthaideswhopresent
documentedproofofsuccessfulcompletionofthetrainingrequiredbyruleoftheagency,andcompanionsorhomemakersforthe
purposesofprovidingthoseservicesauthorizedunders.400.509(1).Alicensednurseregistryshallensurethateachcertifiednursing
assistantreferredforcontractbythenurseregistryandeachhomehealthaidereferredforcontractbythenurseregistryisadequately
trainedtoperformthetasksofahomehealthaideinthehomesetting.Eachpersonreferredbyanurseregistrymustprovidecurrent
documentationthatheorsheisfreefromcommunicablediseases.
(b)Acertifiednursingassistantorhomehealthaidemaybereferredforacontracttoprovidecaretoapatientinhisorherhomeonly
ifthatpatientisunderaphysician'scare.Acertifiednursingassistantorhomehealthaidereferredforcontractinaprivateresidence
shallbelimitedtoassistingapatientwithbathing,dressing,toileting,grooming,eating,physicaltransfer,andthosenormaldaily
routinesthepatientcouldperformforhimselforherselfwereheorshephysicallycapable.Acertifiednursingassistantorhomehealth
aidemaynotprovidemedicalorotherhealthcareservicesthatrequirespecializedtrainingandthatmaybeperformedonlyby
licensedhealthcareprofessionals.Thenurseregistryshallobtainthenameandaddressoftheattendingphysicianandsendwritten
notificationtothephysicianwithin48hoursafteracontractisconcludedthatacertifiednursingassistantorhomehealthaidewillbe
providingcareforthatpatient.
(c)Whenacertifiednursingassistantorhomehealthaideisreferredtoapatient'shomebyanurseregistry,thenurseregistryshall
advisethepatient,thepatient'sfamily,oranyotherpersonactingonbehalfofthepatientatthetimethecontractforservicesismade
thatregisterednursesareavailabletomakevisitstothepatient'shomeforanadditionalcost.
(7)ApersonwhoisreferredbyanurseregistryforcontractinprivateresidencesandwhoisnotanurselicensedunderpartIof
chapter464mayperformonlythoseservicesorcaretoclientsthatthepersonhasbeencertifiedtoperformortrainedtoperformas
requiredbylaworrulesoftheAgencyforHealthCareAdministrationortheDepartmentofBusinessandProfessionalRegulation.
Providingservicesbeyondthescopeauthorizedunderthissubsectionconstitutestheunauthorizedpracticeofmedicineoraviolation
oftheNursePracticeActandispunishableasprovidedunderchapter458,chapter459,orpartIofchapter464.
(8)Eachnurseregistrymustrequireeveryapplicantforcontracttocompleteanapplicationformprovidingthefollowinginformation:
(a)Thename,address,dateofbirth,andsocialsecuritynumberoftheapplicant.
(b)Theeducationalbackgroundandemploymenthistoryoftheapplicant.
(c)Thenumberanddateoftheapplicablelicenseorcertification.
(d)Whenappropriate,informationconcerningtherenewaloftheapplicablelicense,registration,orcertification.
(e)Proofofcompletionofacontinuingeducationalcourseonmodesoftransmission,infectioncontrolprocedures,clinical
management,andpreventionofhumanimmunodeficiencyvirusandacquiredimmunedeficiencysyndromewithanemphasison
appropriatebehaviorandattitudechange.SuchinstructionshallincludeinformationoncurrentFloridalawanditseffectontesting,
confidentialityoftestresults,andtreatmentofpatientsandanyprotocolsandproceduresapplicabletohumanimmunodeficiency
viruscounselingandtesting,reporting,offeringHIVtestingtopregnantwomen,andpartnernotificationissuespursuanttoss.381.004
and384.25.
1(9)Eachnurseregistrymustcomplywiththeproceduressetforthins.400.512forallpersonsreferredforcontract.However,an
initialscreeningmaynotberequiredforpersonswhohavebeencontinuouslyregisteredwiththenurseregistrysinceOctober1,2000.
(10)Thenurseregistrymustmaintaintheapplicationonfile,andthatfilemustbeopentotheinspectionoftheAgencyforHealthCare
Administration.Thenurseregistrymustmaintainonfilethenameandaddressofthepatientorclienttowhomnurseregistry
personnelarereferredforcontractandtheamountofthefeereceivedbythenurseregistry.Anurseregistrymustmaintainthefile
thatincludestheapplicationandotherapplicabledocumentationfor3yearsafterthedateofthelastfileentryofpatient‐relatedor
client‐relatedinformation.
(11)Nurseregistriesshallassistpersonswhowouldneedassistanceandshelteringduringevacuationsbecauseofphysical,mental,or
sensorydisabilitiesinregisteringwiththeappropriatelocalemergencymanagementagencypursuanttos.252.355.
(12)Eachnurseregistryshallprepareandmaintainacomprehensiveemergencymanagementplanthatisconsistentwiththecriteria
inthissubsectionandwiththelocalspecialneedsplan.Theplanshallbeupdatedannually.Theplanshallincludethemeansbywhich
thenurseregistrywillcontinuetoprovidethesametypeandquantityofservicestoitspatientswhoevacuatetospecialneedsshelters
whichwerebeingprovidedtothosepatientspriortoevacuation.Theplanshallspecifyhowthenurseregistryshallfacilitatethe
provisionofcontinuouscarebypersonsreferredforcontracttopersonswhoareregisteredpursuanttos.252.355duringan
emergencythatinterruptstheprovisionofcareorservicesinprivateresidences.Nurseregistriesmayestablishlinkstolocal
emergencyoperationscenterstodetermineamechanismbywhichtoapproachspecificareaswithinadisasterareainorderfora
providertoreachitsclients.Nurseregistriesshalldemonstrateagoodfaithefforttocomplywiththerequirementsofthissubsection
bydocumentingattemptsofstafftofollowproceduresoutlinedinthenurseregistry'scomprehensiveemergencymanagementplan
whichsupportafindingthattheprovisionofcontinuingcarehasbeenattemptedforpatientsidentifiedasneedingcarebythenurse
registryandregisteredunders.252.355intheeventofanemergencyunderthissubsection.
(a)Allpersonsreferredforcontractwhocareforpersonsregisteredpursuanttos.252.355mustincludeinthepatientrecorda
descriptionofhowcarewillbecontinuedduringadisasteroremergencythatinterruptstheprovisionofcareinthepatient'shome.It
shallbetheresponsibilityofthepersonreferredforcontracttoensurethatcontinuouscareisprovided.
(b)Eachnurseregistryshallmaintainacurrentprioritizedlistofpatientsinprivateresidenceswhoareregisteredpursuanttos.
252.355andareunderthecareofpersonsreferredforcontractandwhoneedcontinuedservicesduringanemergency.Thislistshall
indicate,foreachpatient,iftheclientistobetransportedtoaspecialneedsshelterandifthepatientisreceivingskillednursing
services.Nurseregistriesshallmakethislistavailabletocountyhealthdepartmentsandtolocalemergencymanagementagencies
uponrequest.
(c)Eachpersonreferredforcontractwhoiscaringforapatientwhoisregisteredpursuanttos.252.355shallprovidealistofthe
patient'smedicationandequipmentneedstothenurseregistry.Eachpersonreferredforcontractshallmakethisinformation
availabletocountyhealthdepartmentsandtolocalemergencymanagementagenciesuponrequest.
(d)Eachpersonreferredforcontractshallnotberequiredtocontinuetoprovidecaretopatientsinemergencysituationsthatare
beyondtheperson'scontrolandthatmakeitimpossibletoprovideservices,suchaswhenroadsareimpassableorwhenpatientsdo
notgotothelocationspecifiedintheirpatientrecords.
(e)Thecomprehensiveemergencymanagementplanrequiredbythissubsectionissubjecttoreviewandapprovalbythecounty
healthdepartment.Duringitsreview,thecountyhealthdepartmentshallcontactstateandlocalhealthandmedicalstakeholderswhen
necessary.ThecountyhealthdepartmentshallcompleteitsreviewtoensurethattheplancomplieswiththecriteriaintheAgencyfor
HealthCareAdministrationruleswithin90daysafterreceiptoftheplanandshalleitherapprovetheplanoradvisethenurseregistry
ofnecessaryrevisions.Ifanurseregistryfailstosubmitaplanorfailstosubmitrequestedinformationorrevisionstothecounty
healthdepartmentwithin30daysafterwrittennotificationfromthecountyhealthdepartment,thecountyhealthdepartmentshall
notifytheAgencyforHealthCareAdministration.Theagencyshallnotifythenurseregistrythatitsfailureconstitutesadeficiency,
subjecttoafineof$5,000peroccurrence.Iftheplanisnotsubmitted,informationisnotprovided,orrevisionsarenotmadeas
requested,theagencymayimposethefine.
(f)TheAgencyforHealthCareAdministrationshalladoptrulesestablishingminimumcriteriaforthecomprehensiveemergency
managementplanandplanupdatesrequiredbythissubsection,withtheconcurrenceoftheDepartmentofHealthandinconsultation
withtheDepartmentofCommunityAffairs.
(13)Allpersonsreferredforcontractinprivateresidencesbyanurseregistrymustcomplywiththefollowingrequirementsforaplan
oftreatment:
(a)When,inaccordancewiththeprivilegesandrestrictionsimposeduponanurseunderpartIofchapter464,thedeliveryofcaretoa
patientisunderthedirectionorsupervisionofaphysicianorwhenaphysicianisresponsibleforthemedicalcareofthepatient,a
medicalplanoftreatmentmustbeestablishedforeachpatientreceivingcareortreatmentprovidedbyalicensednurseinthehome.
Theoriginalmedicalplanoftreatmentmustbetimelysignedbythephysician,physicianassistant,oradvancedregisterednurse
practitioner,actingwithinhisorherrespectivescopeofpractice,andreviewedinconsultationwiththelicensednurseatleastevery2
months.Anyadditionalorderorchangeinordersmustbeobtainedfromthephysician,physicianassistant,oradvancedregistered
nursepractitionerandreducedtowritingandtimelysignedbythephysician,physicianassistant,oradvancedregisterednurse
practitioner.Thedeliveryofcareunderamedicalplanoftreatmentmustbesubstantiatedbytheappropriatenursingnotesor
documentationmadebythenurseincompliancewithnursingpracticesestablishedunderpartIofchapter464.
(b)Wheneveramedicalplanoftreatmentisestablishedforapatient,theinitialmedicalplanoftreatment,anyamendmenttothe
plan,additionalorderorchangeinorders,andcopyofnursingnotesmustbefiledintheofficeofthenurseregistry.
(14)Thenurseregistrymustcomplywiththenoticerequirementsofs.408.810(5),relatingtoabusereporting.
(15)(a)Theagencymaydeny,suspend,orrevokethelicenseofanurseregistryandshallimposeafineof$5,000againstanurse
registrythat:
1.Providesservicestoresidentsinanassistedlivingfacilityforwhichthenurseregistrydoesnotreceivefairmarketvalue
remuneration.
2.Providesstaffingtoanassistedlivingfacilityforwhichthenurseregistrydoesnotreceivefairmarketvalueremuneration.
3.Failstoprovidetheagency,uponrequest,withcopiesofallcontractswithassistedlivingfacilitieswhichwereexecutedwithinthe
last5years.
4.Givesremunerationtoacasemanager,dischargeplanner,facility‐basedstaffmember,orthird‐partyvendorwhoisinvolvedinthe
dischargeplanningprocessofafacilitylicensedunderchapter395orthischapterandfromwhomthenurseregistryreceives
referrals.AnurseregistryisexemptfromthissubparagraphifitdoesnotbilltheFloridaMedicaidprogramortheMedicareprogram
orshareacontrollinginterestwithanyentitylicensed,registered,orcertifiedunderpartIIofchapter408thatbillstheFlorida
MedicaidprogramortheMedicareprogram.
5.Givesremunerationtoaphysician,amemberofthephysician'sofficestaff,oranimmediatefamilymemberofthephysician,andthe
nurseregistryreceivedapatientreferralinthelast12monthsfromthatphysicianorthephysician'sofficestaff.Anurseregistryis
exemptfromthissubparagraphifitdoesnotbilltheFloridaMedicaidprogramortheMedicareprogramorshareacontrollinginterest
withanyentitylicensed,registered,orcertifiedunderpartIIofchapter408thatbillstheFloridaMedicaidprogramortheMedicare
program.
(b)Theagencyshallalsoimposeanadministrativefineof$15,000ifthenurseregistryrefersnurses,certifiednursingassistants,
homehealthaides,orotherstaffwithoutchargetoafacilitylicensedunderchapter429inreturnforpatientreferralsfromthefacility.
(c)TheproceedsofallfinescollectedunderthissubsectionshallbedepositedintotheHealthCareTrustFund.
(16)Inadditiontoanyotherpenaltiesimposedpursuanttothissectionorpart,theagencymayassesscostsrelatedtoan
investigationthatresultsinasuccessfulprosecution,excludingcostsassociatedwithanattorney'stime.

400.484Rightofinspection;deficiencies;fines.‐‐
(1)Inadditiontotherequirementsofs.408.811,theagencymaymakesuchinspectionsandinvestigationsasarenecessaryinorder
todeterminethestateofcompliancewiththispart,partIIofchapter408,andapplicablerules.
(2)Theagencyshallimposefinesforvariousclassesofdeficienciesinaccordancewiththefollowingschedule:
(a)AclassIdeficiencyisanyact,omission,orpracticethatresultsinapatient'sdeath,disablement,orpermanentinjury,orplacesa
patientatimminentriskofdeath,disablement,orpermanentinjury.UponfindingaclassIdeficiency,theagencyshallimposean
administrativefineintheamountof$15,000foreachoccurrenceandeachdaythatthedeficiencyexists.
(b)AclassIIdeficiencyisanyact,omission,orpracticethathasadirectadverseeffectonthehealth,safety,orsecurityofapatient.
UponfindingaclassIIdeficiency,theagencyshallimposeanadministrativefineintheamountof$5,000foreachoccurrenceandeach
daythatthedeficiencyexists.
(c)AclassIIIdeficiencyisanyact,omission,orpracticethathasanindirect,adverseeffectonthehealth,safety,orsecurityofa
patient.UponfindinganuncorrectedorrepeatedclassIIIdeficiency,theagencyshallimposeanadministrativefinenottoexceed
$1,000foreachoccurrenceandeachdaythattheuncorrectedorrepeateddeficiencyexists.
(d)AclassIVdeficiencyisanyact,omission,orpracticerelatedtorequiredreports,forms,ordocumentswhichdoesnothavethe
potentialofnegativelyaffectingpatients.Theseviolationsareofatypethattheagencydeterminesdonotthreatenthehealth,safety,or
securityofpatients.UponfindinganuncorrectedorrepeatedclassIVdeficiency,theagencyshallimposeanadministrativefinenotto
exceed$500foreachoccurrenceandeachdaythattheuncorrectedorrepeateddeficiencyexists.
(3)Inadditiontoanyotherpenaltiesimposedpursuanttothissectionorpart,theagencymayassesscostsrelatedtoaninvestigation

(11)"Fairmarketvalue"meansthevalueinarmslengthtransactions,consistentwiththepricethatanassetwouldbringastheresult
ofbonafidebargainingbetweenwell‐informedbuyersandsellerswhoarenototherwiseinapositiontogeneratebusinessforthe
otherparty,orthecompensationthatwouldbeincludedinaserviceagreementastheresultofbonafidebargainingbetweenwell‐
informedpartiestotheagreementwhoarenototherwiseinapositiontogeneratebusinessfortheotherparty,onthedateof
acquisitionoftheassetoratthetimeoftheserviceagreement.
(15)"Homehealthaide"meansapersonwhoistrainedorqualified,asprovidedbyrule,andwhoprovideshands‐onpersonalcare,
performssimpleproceduresasanextensionoftherapyornursingservices,assistsinambulationorexercises,orassistsin
administeringmedicationsaspermittedinruleandforwhichthepersonhasreceivedtrainingestablishedbytheagencyunders.

(17)"Homeinfusiontherapyprovider"meansanorganizationthatemploys,contractswith,orrefersalicensedprofessionalwhohas
receivedadvancedtrainingandexperienceinintravenousinfusiontherapyandwhoadministersinfusiontherapytoapatientinthe
patient'shomeorplaceofresidence.
(18)"Homeinfusiontherapy"meanstheadministrationofintravenouspharmacologicalornutritionalproductstoapatientinhisor
herhome.
(19)"Immediatefamilymember"meansahusbandorwife;abirthoradoptiveparent,child,orsibling;astepparent,stepchild,
stepbrother,orstepsister;afather‐in‐law,mother‐in‐law,son‐in‐law,daughter‐in‐law,brother‐in‐law,orsister‐in‐law;agrandparent
orgrandchild;oraspouseofagrandparentorgrandchild.
