To all involved parties:
The County has no right to give permission to a Seismic Testing Company and/or Gas/Oil
Leasing Company nor does the Gas/Oil Leasing Company(s) have a right to trespass upon my
property to obtain seismic data from my land without my permission.
Since the Geophysical Seismic Testing done on the roadway (of which my property tax is paid
from the center of the road) is an attempt in the obtaining of data that is downward and
OUTWARD and that outward data is being obtained from my property without my permission, it
is a direct violation of my property rights.
The County only has the right on roadways for the purpose of transportation of vehicles and
seismic testing does not fall under that jurisdiction.
If the data collected from the survey (Seismic Test) is not kept confidential, the trespasser also is
liable for lost value of leasing minerals if the survey indicates no underground structural traps
and value of the sale if the data is sold.
Therefore, we will pursue and enforce our rights against the County, the Seismic Testing
Company and the Oil/Gas Leasing Company who requested the testing, for conspiracy to allow
trespass, with the intent to obtain data improperly and without my permission; which may result
in the devaluation of my property and limit my ability to market my mineral rights.
If my request is ignored and if action on my part should become necessary, I will request as part
of my relief in any lawsuit that the court direct the company to deliver all copies of the seismic
data to the court pending the outcome of the lawsuit and that the company be barred from using
that data or transferring it to anyone.
