1.
Short title
This notice may be cited as the Notice of Adoption of South
East Queensland Design and Construction Code.
2.
Notice of adoption of the Code – Act, s.99BD and 99BE
(a) Pursuant to section 99BD of the South-East Queensland
Water (Distribution and Retail Restructuring) Act 2009 , the
South East Queensland Design and Construction Code
has been adopted by Unitywater, Queensland Urban
Utilities, Logan City Council, Gold Coast City Council and
Redland City Council.
(b) Pursuant to section 99BE(1) of the South-East Queensland
Water (Distribution and Retail Restructuring) Act 2009
I must, by gazettal notice, notify the adoption of the Code.
3.
Date of effect –
Pursuant to section 99BE(2) the date of effect of the South
East Queensland Design and Construction Code is the date
of this gazette notice.

OF LAND FOR COMMUNITY INFRASTRUCTURE
UNDER THE SUSTAINABLE PLANNING ACT 2009
A Ministerial designation has been made
I, Hon John-Paul Langbroek MP, Minister for Education, Training
and Employment, gives notice that under the Sustainable Planning
Act 2009 , chapter 5, part 2, I made a Ministerial designation of
land for community infrastructure.
Description of the land to which the designation applies
The Ministerial designation applies to land located at 1 Hunter Street,
Brassall.
The land is described as Lot 581 on SP145243.
Type of community infrastructure for which the land has been
designated
The land has been designated for Ipswich State High School.
The community infrastructure is described under Schedule 2 of
the Sustainable Planning Regulation 2009 as follows:
(4) Community and cultural facilities, including facilities where an
education and care service under the Education and Care
Services National Law (Queensland) is operated or a child care
service under the Child Care Act 2002 is conducted, community
centres, meeting halls, galleries and libraries;
(6) Educational facilities;
(15) Storage and works depots and similar facilities, including
administrative facilities associated with the provision or
maintenance of the community infrastructure; and
(16) Any other facility not mentioned in this part that is intended
primarily to accommodate government functions.

Short title
1. This notice may be cited as the Objections to Proposed
Road Closure Notice (No 25) 2013.
Application for road closure [s.100 of the Act]
2. Applications have been made for the permanent closure
of the roads mentioned in the Schedule.
Objections
3.(1) An objection (in writing) to a proposed road closure
mentioned in the Schedule may be lodged with the Regional
Service Director, Department of Natural Resources and
Mines, at the regional office for the region in which the road
is situated.
(2) Latest day for lodgement of objections is 15 August
2013.
(3) Any objections received may be viewed by other parties
interested in the proposed road closure under the provisions of
the Right to Information Act 2009. If you lodge an objection,
please include in your objection letter whether you would like
to be consulted if this issue becomes the subject of an access
request under the Right to Information Act 2009.

The parts of the State-controlled road to which access is to be limited are as shown on Limited Access Plans LA11984 to LA11999 (inclusive), in
accord with the Access Management Policy as described hereunder. Copies of these plans and policy are held in the office of the Director-General,
Department of Transport and Main Roads, Brisbane and the North Queensland Region Office, Department of Transport and Main Roads, 146 Wills
Street, Townsville.
The reason for the declaration is to achieve a high level of access control to:
-
ensure that the required arterial road functionality of this major road transport asset is achieved and preserved, and
maximise the traffic carrying and safety characteristics of that link.
Any person whose interests are affected by the declaration may—
(i)
under section 485 of the Transport Infrastructure Act 1994 —
ask for the decision to be reviewed and appeal against the reviewed decision; and
(ii)
under the Transport Planning and Coordination Act 1994, part 5 —
ask for the decision or the reviewed decision to be stayed.
Notice is hereby given that there is a policy in place in relation to the application of section 62 of the Transport Infrastructure Act 1994 to manage
access between the Flinders Highway described in The Schedule and adjacent land. This policy is outlined below.
POLICY FOR ACCESS MANAGEMENT ALONG THE FLINDERS HIGHWAY (Stuart Bypass to Woodstock – Giru Road)
1.0
Purpose and Scope of Policy
Pursuant to section 54 of the Transport Infrastructure Act 1994, this policy has been developed about the application of section 62 of the Transport
Infrastructure Act 1994 to manage access between the Flinders Highway (Stuart Bypass to Woodstock – Giru Road), a limited access road, and
individual properties.
The purpose of declaring the Flinders Highway (Stuart Bypass to Woodstock – Giru Road) as a limited access road is to enable the Department of
Transport and Main Roads (the department) to achieve a high level of access control to:
-
ensure that the required arterial road functionality of this major road transport asset is achieved and preserved, and
maximise the traffic carrying and safety characteristics of that link.
It is only through managing direct individual access to adjacent land and maintaining high levels of operational safety and efficiency required by road
users of this vital interregional link, that the department can achieve the above outcomes demanded by the community.
The policy sets out the matters the Chief Executive will consider, either on the initiative of the Chief Executive, or in response to an application from
a person, when deciding whether or not to permit access to the road under section 62 of the Transport Infrastructure Act 1994.
In addition, the policy sets out the objectives and rationale for the management of access.
2.0
The department’s powers and policy concerning access between a State-controlled road and adjacent land
Pursuant to the Transport Infrastructure Act 1994, the department is responsible for the design, construction, maintenance and management of Statecontrolled roads to a standard suitable for a particular road’s function within the constraints of available budgets.
As access management is critical to the ongoing operational effectiveness of all arterial roads, the department has substantial legislative powers to
control access between any State-controlled roads and adjacent land.
The department has an overarching Access Policy (1 July 2000), which sets out its general policy position.
3.0
Objectives
The Flinders Highway (Stuart Bypass to Woodstock – Giru Road) forms part of the Mt Isa to Townsville section of the National road network. It
provides a direct link for Queensland’s north west mineral province to the Bruce Highway and the Port of Townsville. It has been designed to cater
for four lanes in the future and provides intersections at defined locations to cater for future development.
The Queensland Government’s objective is to continue planning and investing in the upgrading of this road link to provide a facility which satisfies
predicted road travel and freight demand to the Port of Townsville. The highway is of high importance to Townsville’s economy and network
efficiency.
The Flinders Highway (Stuart Bypass to Woodstock – Giru Road) will have a general speed limit of 100km/h and 80kms within urban areas as
assessed by the department. Design standards utilised for the highway are of a very high standard and public cost, and are in accordance with relevant
Austroads and the department’s guidelines and standards.
To achieve the desired functionality of the Flinders Highway (Stuart Bypass to Woodstock – Giru Road) and to maintain the appropriate standards of
safety and traffic efficiency, the control and rationalisation of access to adjacent properties is required along the highway.

In managing access to these adjacent properties, the department will make all efforts to ensure that the impacts of private access do not have an
adverse impact on the operation of the Flinders Highway (Stuart Bypass to Woodstock – Giru Road).
4.0
Management of Access – existing access
Plan No’s LA 11984 to LA 11999 shows the area of the Flinders Highway (Stuart Bypass to Woodstock – Giru Road) that are subject to limitation of
access. Within this area access to the highway would only be permitted at the locations shown on the above plans for the existing land uses on the
adjacent land, and in accordance with any current Section 62 access approvals.
If the accesses shown on these plans are not currently constructed or in use then the owner of the property is required to seek access approval from the
department. It is an offence to construct an access or alter an access to any road in the limited access area without the approval of the department.
For all accesses shown on these plans, it is not anticipated at this time that there will be any initiatives of the department that will alter these existing
accesses. However, should the operation of any access prove to cause unacceptable interference with traffic safety or efficiency, a Section 62 decision
about the access may be made. This decision may, for example, prohibit the access, alter its form or apply a condition to its use (see Section 62 of the
Transport Infrastructure Act 1994).
Triggers for reviewing the management of access may include the following:
(i)
Road infrastructure planning projects;
(ii)
Adverse changes in adjacent land use that impinges on road safety and efficiency;
(iii)
Adverse traffic impacts; and
(iv)
A generic review period of up to 10 years.
Planning will be updated from time to time and particular access arrangements may be varied.
5.0
Management of Access – on the Chief Executive’s initiative
It is not anticipated that any further access will be permitted to the limited access area on the initiative of the department.
6.0
Management of Access - in response to application by a person for a Section 62 decision
The department will exercise its powers under the Transport Infrastructure Act 1994 to maintain the integrity and operation of the Flinders Highway
(Bruce Highway to Woodstock – Giru Road), and its associated intersections and accesses to the appropriate standard, in accordance with the
outcomes and objectives outlined in the previous sections of this policy.
Where an application is received for access for land adjacent to the Flinders Highway (Stuart Bypass to Woodstock – Giru Road), the department will
assess an application under Section 62 of the Transport Infrastructure Act 1994 to ensure any proposal does not adversely impact on the safety and
efficiency of the highway, in line with the purpose and objectives of this policy.
Where an application that does not involve a proposed development nor change in use of land adjacent to the Flinders Highway (Stuart Bypass to
Woodstock – Giru Road) is made by a person, access may only be permitted on a temporary or indirect basis.
Where an application involves a proposed development or change in use of land adjacent to the Flinders Highway (Stuart Bypass to Woodstock –
Giru Road) this may involve either:
-
more traffic intensive or different traffic use of the access points shown on the above referenced plans; or
use of any other access point directly to the limited access area.
To achieve the objectives of this policy it is not intended that:
-

use of existing approved access points be approved where this is associated with a change of land use, reconfiguration of a lot, more
intensive use or different traffic use; and
additional permanent direct access locations will be approved.
Adjacent Land Use Planning
Typical land use and planning that forms part of the considerations for this policy include:
(i)
Townsville City Council City Plan 2005;
(ii)
Townsville-Thuringowa Integrated Regional Transport Plan 2001;
(iii)
Townsville-Thuringowa Strategy Plan 2000; and
(iv)
Townsville State Development Area Development Scheme 2003.

This policy shall:
-
apply to those sections of the Flinders Highway (or land) defined by Limitation of Access Drawings referred to in this policy; and
be utilized when applying section 62 of the Transport Infrastructure Act 1994.

This policy may in future be amended at any time without a gazette notice if—
(i)
the amendment merely changes or repeals specific provision for one or more particular properties; and
(ii)
the owner or occupier of each property has been given written notice of the amendment;
Any person whose interests are affected by this policy may—
(i)
under section 485 of the Transport Infrastructure Act 1994—
ask for the decision to be reviewed and appeal against the reviewed decision; and
(ii)
under the Transport Planning and Coordination Act 1994, part 5—
ask for the decision or the reviewed decision to be stayed.
Under section 62G of the Transport Infrastructure Act 1994, a person must not construct or change a physical means of entry or exit for traffic
between land and a limited access road without first obtaining a decision under section 62(1) that authorises the construction or change. Maximum
penalty—200 penalty units.
This limited access road declaration on Flinders Highway supersedes previous limited access road legislation as proclaimed in Queensland Government
Gazette No. 56, page 1305, on 9 March 1985, and Queensland Government Gazette No. 27, page 559, on 21 May 1988.

2. This notice commences on the date it is published in the gazette.
Making of local law and subordinate local law
3. Gold Coast City Council (the “Council”) has, by resolution
dated 11 June 2013, made—
(a) Local law No. 17 (Maintenance of Works in Waterway
Areas ) 2013 ; and
(b) Subordinate Local Law No. 17.1 (Works in Non-Coastal
Waterway Areas ) 2013 .
Local law that authorises a subordinate local law to be made
4. Local Law No. 17 (Maintenance of Works in Waterway Areas)
2013 authorises the making of Subordinate Local Law
No. 17.1 (Works in Non-Coastal Waterway Areas) 2013 .
Purpose and general effect
5. The purpose and general effect of each of the local law and
subordinate local law identified in paragraph 3 is to—
(a) provide for the maintenance and repair of works in
waterway areas in Council's local government area; and
(b) regulate the maintenance and repair of works in
waterway areas in Council's local government area; and
(c) ensure that prescribed works are maintained by persons
whose lands are subject to, or where the land is
waterfront land or waterfront (separated) land, benefits
from, those works at the cost of such persons and in
accordance with all relevant laws; and
(d) ensure that works in waterway areas in Council's local
government area do not—
(i) fall into disrepair; or
(ii) result in—
(A) harm to human health or safety or personal
injury; or
(B) property damage or a loss of amenity; or
(C) environmental harm or environmental
nuisance; and
(e) ensure that appropriate persons, at their cost, build
required works in accordance with all relevant laws in
Council's local government area to—

6. Each of Local Law No. 17 (Maintenance of Works in Waterway
Areas) 2013 and Subordinate Local Law 17.1 (Works in NonCoastal Waterway Areas) 2013 does not contain any anticompetitive provisions.

7. A copy of each of the local law and subordinate local law
identified in paragraph 3 may be—
(a) inspected and purchased at Council’s public office at
Surfers Paradise Administration Centre, 135 Bundall
Road, Surfers Paradise, and at any of the Council’s
branch offices or available from Council’s website; and
(b) inspected at the State office of the Department of
Local Government at 63 George Street, Brisbane; and
(c) viewed by the public on the Department’s website.

Her Excellency the Governor, acting by and with the advice of the Executive Council, and in pursuance of the provision of the Financial
Accountability Act 2009, has approved the undermentioned transfer of the unexpended portion of monies appropriated for departmental
services, equity adjustments and administered items, as set out in the Schedule below.
The Schedule also shows the appropriation available for payment to the transferring and receiving departments after the transfer. Under

Handbook Amendment Notice (No. 2) 2013.
Amendments
Section 1.3 of the Members’ Entitlements Handbook (the
Handbook) shall be amended to provide for the variation of
the timing and amount of certain allowances at the direction
of the Premier where a review of Members’ allowances and
entitlements is referred by the Premier to the Committee of
the Legislative Assembly, so long as such review, report and

Writ of inquisition
3. If at any time not later than 2 months after the making of this
instrument, any person claiming any estate or interest in or
to the property requests that a writ of inquisition in respect
of the State’s title be issued, and gives security to the
satisfaction of a Crown law officer for the costs of the issue
and execution of such writ, such writ may issue under
schedule 1 to the Property Law Act and this instrument shall
cease to have effect from the date when it was made.

Operations (Marine Safety) Regulation 2004 that require a person to
hold an appropriate licence to operate a recreational ship as its
master pursuant to s95(1); and that require the master of a ship to
not allow its operation by an unlicensed person section 87(1):
