Higher Educational Services FY 2015-2016 Discussion Points Senior Public Institutions of Higher Education 12. State law under section 43 of P.L.2009, c.90 (C.18A:64-85) allows a State college, county college, and Rowan University to enter into a public-private partnership agreement, which allows the private entity to assume full financial and administrative responsibility for a project as long as the State or institution of higher education retains full ownership of the land upon which the project was completed. The law also allows a college to lease to a private entity the operation of a dormitory or other revenue producing facility to which the college holds the title, in exchange for up-front or structured financing by the private entity for the construction of classrooms, laboratories, or other academic buildings. The private entity is then responsible for the management, operation, and maintenance of the facility, while the college continues to hold title to the facility. The private entity can receive some or all of the revenue generated by the facility. • Question: Please provide a list of public-private partnership agreements that the institutions have entered into pursuant to this law, including the name of the project, the cost of the project, and the amount of revenue to be generated for the institution and the private entity annually and throughout the length of the agreement. Have any agreements for payments-in-lieu-of-taxes with respect to a project been concluded with any municipality in which the projects are located? If so, please summarize the terms of the agreement. Rutgers Response: This law does not apply to Rutgers. 13. P.L.2013, c.170, which was approved on December 20, 2013, allows an undocumented student to pay the in-State tuition rate at public institutions of higher education if the student meets certain requirements. Eligible students were eligible to pay in-State tuition beginning in the Spring 2014 semester. • Question: Does your institution collect data on the number of undocumented students, eligible under P.L.2013, c.170, who pay the in-State tuition rate? If so, how many of those students attend the institution? • Rutgers Response: During the Fall 2014 semester, 210 Rutgers students qualified for the in-state tuition rate under the new law, of which 204 were undergraduates and 6 were graduate students. Half of these students were new to the university last fall, and the other half were returning students. Question: Has the institution seen any decline in tuition revenue as a result of charging this group of students the in-State tuition rate? Has the institution changed any admissions policy regarding out-of-State students to compensate for the change? Rutgers Response: It is difficult to determine which, if any, of these students would not have enrolled at Rutgers without the benefit of the in-state tuition rate. If, however, all 210 students were enrolled at Rutgers and still required to pay the out-ofstate tuition rate this year, tuition revenue to the university from this group would be over $3 million higher than will be received under the terms of the new legislation. 1 Higher Educational Services FY 2015-2016 Discussion Points (Cont’d) 14. The FY 2016 budget proposes to reduce direct operating aid to the senior public institutions of higher education by $37.9 million, with reductions by institution/campus ranging from 0.5% (Rutgers-Camden) to 14.3% (Thomas Edison State College). There has been concern among legislators and the public regarding the steady rise of tuition, as it leads to higher student loan debt and decreases the accessibility of higher education. • Question: Please discuss the steps the institution is taking to compensate for the reduction in direct operating aid from the State. While the tuition rate for the 20152016 academic year will not be adopted until this summer after the FY 2016 appropriations act has been enacted, please also discuss the possibility of tuition increases. Rutgers Response: As in past years, the Rutgers Board of Governors will consider many factors – including state appropriations, negotiated salary increases, anticipated enrollment changes, etc. – in adopting an annual budget for the university and in approving any related increases in tuition and student fees. These decisions will be finalized in July. In the face of decades of declining levels of state support, the Board and university administration have strived to keep a Rutgers education as affordable as possible without sacrificing quality. This intent is reflected in a string of modest tuition and fee increases in recent years – including 2.3% for a typical New Brunswick in-state undergraduate in 2014-15 – as well as annual growth in the university’s own need-based aid program, Rutgers Assistance Grants (RAG). 15a. In July 2013, a list of projects selected by the Secretary of Higher Education was deemed approved by the Legislature. These projects were funded under the “Building Our Future Bond Act,” the “Higher Education Equipment Leasing Fund Act,” the “Higher Education Facilities Trust Fund Act,” the “Higher Education Technology Infrastructure Fund Act,” and the “Higher Education Capital Improvement Fund Act.” In total, over $1.2 billion worth of projects were approved. • Question: For each of the bond funds listed above, please provide a table listing the approved projects, total cost, grants from the State, original start and completion dates, and revised start and completion dates, if applicable. Please discuss if there were any unexpected difficulties or problems in complying with reporting requirements or accessing grant funds through the Office of the Secretary of Higher Education? Were there any project timetable delays as a result of process or cash flow issues? Rutgers Response: The requested schedules are attached. To date, there have not been any problems complying with reporting requirements or accessing grant funds and no project delays as a result of funding or cash flow. 2 Higher Educational Services FY 2015-2016 Discussion Points (Cont’d) • Question: What is the institution’s understanding of the process to follow if it perceives that a project’s cost has changed to the extent that it may no longer be feasible to continue without additional State funds? Rutgers Response: The institution has not had difficulty in this area as a result of project cost. 15b. Section 25 of P.L.2012, c.41, the “Building Our Future Bond Act,” requires the Secretary of Higher Education to submit to the State Treasurer and the New Jersey Commission on Capital Budget and Planning with the secretary’s annual budget request a plan for the expenditure of funds from the “Building Our Future Bond Fund” for the upcoming fiscal year. The act requires the plan to include the following information: “a performance evaluation of the expenditures made from the funds to date; a description of programs planned during the upcoming fiscal year; a copy of the regulations in force governing the operation of programs that are financed, in part or in whole, by funds from the “Building Our Future Fund”; and an estimate of expenditures for the upcoming fiscal year.” • Question: Was each institution required to submit a project expenditure plan for FY 2016, along with project progress/expenditure reports, to the Secretary of Higher Education or any other department? If so, when was the information requested and submitted? If any report was prepared by the institution, either for internal use or submission to the secretary, please provide a copy. Rutgers Response: Attached is the report submitted to the Office of the Secretary of Higher Education on March 31, 2015 for the Build Our Future projects. This report is part of the reporting requirement of the Grant Agreement (Section 2.4) between Rutgers and the Secretary of Higher Education. The attached report lists all expenditures of the Grant Amount and Matching Funds for the prior calendar year (CY2014). It also provides the status and progress of the projects and the estimated spending for the current calendar year (CY2015).
