Report Dumfries and Galloway Integration Joint Board 5 November 2015 Agenda Item 4 MEMBERSHIP OF THE INTEGRATION JOINT BOARD 1. Purpose of Report This report presents the Integration Joint Board (IJB) with the information it needs to consider the membership arrangements in accordance with the Public Bodies Joint Working (Scotland) Act 2014 and associated regulations. 2. Recommendations Board Members are asked to:2.1 note the prescribed membership of the Integration Joint Board as set out at paragraph 3.1; 2.2 agree that substitute voting members should be sought from Dumfries and Galloway Council and NHS Dumfries and Galloway as detailed at paragraphs 3.4 – 3.6; and 2.2 agree to the approach in identifying non-voting members as detailed at paragraphs 3.9 and 3.11. 3. Considerations 3.1 In accordance with the Integration Scheme and the regulations, the membership of the IJB, must comprise of: five voting members nominated by the Council; five voting members nominated by the NHS Board; non-voting members who are holders of key posts within the Parties or IJB; and non-voting members who are representatives of groups who have an interest in adult health and social care and the work of the IJB. There is flexibility to appoint additional members in certain circumstances, set out in the Scottish Government’s regulations. 3.2 The voting membership has been provided by both the Council and the NHS Board. As set out in the Integration Scheme, the IJB members appointed by the Parties will hold office for a maximum period of three years. IJB members appointed by the Parties will cease to be members of the IJB in the event that they cease to be a non-executive Board member of NHS Dumfries and Galloway or, where applicable, cease to be an appropriate person for the purposes of article 3(5) of the Public Bodies (Joint Working) (Integration Joint Boards) (Scotland) Order 2014, or cease to be an Elected Member of the Council. 3.3 In accordance with the regulations the quorum required for a meeting to take place is five, being half of all voting Members. Substitutes 3.4 The regulations provide for the use of substitutes (proxies) for members as detailed below:- Report Dumfries and Galloway Integration Joint Board 5 November 2015 3.4.1 If a voting member is unable to attend a meeting of the integration joint board the constituent authority which nominated the member, is to use its best endeavours to arrange for a suitably experienced proxy, who is either a councillor or, as the case may be, a member of the Health Board, to attend the meeting in place of the voting member. 3.4.2 If a member who is not a voting member is unable to attend a meeting of the integration joint board that member may arrange for a suitably experienced proxy to attend the meeting. 3.4.3 A proxy attending a meeting of the integration joint board by virtue of paragraph 3.4.1 may vote on decisions put to that meeting. 3.4.4 If the chairperson or vice chairperson is unable to attend a meeting of the integration joint board, any proxy attending the meeting may not preside over that meeting. 3.5 Should it be agreed by the IJB that substitutes for voting members should be sought, then a request should be made by the IJB to Dumfries and Galloway Council and Dumfries and Galloway NHS Board for those nominations. It would be a matter for the Council and the NHS to determine how those nominations are determined. 3.6 Given that substitutes for voting members should be “suitably experienced” and have voting rights, in order to make fully informed decisions it is recommended that they are included in all ongoing training and induction for IJB members. 3.7 It is recommended in standing orders, further on the agenda, that any substitution for non-voting members who are unable to attend a meeting is done with prior agreement of the Chair. Non –voting members 3.8 When established, the IJB must include the following professional advisor nonvoting members as specified in the Public Bodies (Joint Working) (Integration Joint Boards) (Scotland) Order 2014: 3.8.1 The Chief Officer of the IJB (subject to a report later on this agenda) 3.8.2 The Chief Social Work Officer of the Council 3.8.3 The Chief Finance Officer of the IJB (subject to a report later on this agenda) 3.8.4 A registered medical practitioner whose name is included in the list of primary medical services performers prepared by NHS Dumfries and Galloway 3.8.5 A registered nurse who is employed by NHS Dumfries and Galloway or by a person or body with which NHS Dumfries and Galloway has entered into a general medical services contract 3.8.6 A registered medical practitioner employed by NHS Dumfries and Galloway and not providing primary medical services 3.9 In order to confirm nominations it is proposed that for the Chief Social Work Officer that the Chair writes to the Leader of Dumfries and Galloway Council, advising of this appointment under the regulation. For the last three on the list above it is proposed that the Chair write to the Chief Executive of NHS Dumfries and Galloway for nominations, Report Dumfries and Galloway Integration Joint Board 5 November 2015 noting that the appointment of the Chief Officer and the Chief Finance Officer are both subject to reports on this agenda. 3.10 When established, the IJB must also appoint at least one non-voting member in respect of each of the following groups as specified in the Public Bodies (Joint Working) (Integration Joint Boards) (Scotland) Order 2014: 3.10.1 Staff of the Parties engaged in the provision of services provided under the Scheme 3.10.2 Third sector bodies carrying out activities related to health or social care in the Dumfries and Galloway area 3.10.3 Service users residing in the Dumfries and Galloway area 3.10.4 Persons providing unpaid care in the Dumfries and Galloway area 3.11 To progress the above, it is proposed that Chief Officer (Designate) will provide further information at the meeting on the groups to be approached for nominations. All such requests shall be done in writing from the Chair. 3.12 The IJB may, from time to time, appoint such additional non-voting members as it considers necessary and expedient for the effective discharge of its functions as specified in the Public Bodies (Joint Working) (Integration Joint Boards) (Scotland) Order 2014. 3.13 In September 2015, the Scottish Government produced guidance on roles, responsibilities and membership of IJBs which is attached at the Appendix for supporting information. 4. Governance Assurance This is a procedural report and all appropriate consultation has been undertaken. 5. Impact Assessment As this report does not propose a change in policy/strategy/plan/project, it is not necessary to complete an Impact Assessment.
